1313 SYNOPSIS:
1414 This bill would authorize any county, any
1515 municipality in the county, or any governmental entity
1616 in the county subject to a countywide civil service
1717 system established by a local law to elect by a
1818 majority vote of the governing body of the county,
1919 municipality, or governmental entity to be exempt from
2020 the recruitment and hiring provisions of the countywide
2121 civil service system.
2222 This bill would also require the county,
2323 municipality, or governmental entity to adopt a human
2424 resources policy and procedures manual and to provide
2525 written notification to the director of the countywide
2626 civil service system.
2727 This bill would provide that employees, after a
2828 probationary period, would be merit system employees
2929 subject to all rights and protections under the
3030 countywide civil service system.

6565 established by a local law to elect by a majority vote of the
6666 governing body of the county, municipality, or governmental
6767 entity to be exempt from the countywide civil service system
6868 for the recruitment and hiring of all employees; to require
6969 the county, municipality, or governmental entity to adopt a
7070 human resources policy and procedures manual and to notify the
7171 director of the countywide civil service system of its
7272 decision to withdraw from the system for the recruitment and
7373 hiring of employees; and to provide that employees, after a
7474 probationary period, would be merit system employees subject
7575 to all rights and protections under the countywide civil
7676 service system.
7777 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7878 Section 1. (a) For the purposes of this section, the
7979 term "countywide civil service system" means a civil service
8080 system established by a local law that did not require
8181 approval by a referendum and that applies only to a named
8282 county that does not sponsor a retirement plan for its
8383 employees and was not established by a general law of local
8484 application that at the time of its enactment applied only to
8585 a county or counties based on population, certain
8686 municipalities in the county, and any governmental entity in
8787 the county to which the civil service system applies.
8888 (b) Any county, municipality, or governmental entity
8989 subject to a countywide civil service system, by a majority
9090 vote of the county commission, the city or town council, or
9191 the governmental entity, may elect to opt out of the
9292 countywide civil service system for the recruitment, testing,

122122 interviewing, and hiring of all employees.
123123 (c) Any county, municipality, or governmental entity
124124 making the election authorized by subsection (b), prior to the
125125 effective date of the partial withdrawal, shall adopt a human
126126 resources policy and procedures manual, which shall include
127127 personnel policy guidelines; operational standards; employee
128128 management, recruitment, testing, hiring and termination
129129 procedures; equal employment opportunities policies; and
130130 workplace harassment policies to ensure compliance with
131131 applicable federal and state laws, rules, and regulations.
132132 (d) A county, municipality, or governmental entity
133133 making the election pursuant to this section shall provide
134134 written notice to the director of the countywide civil service
135135 system of its decision to conduct its own recruitment and
136136 hiring outside of the countywide civil service system.
137137 (e) Any employee hired by a county, municipality, or
138138 governmental entity shall immediately become subject to the
139139 countywide civil service system, provided that the employee
140140 shall complete a probationary period of twelve months during
141141 which probationary period the employee shall be an at-will
142142 employee with no property right in his or her position. Upon
143143 satisfactory completion of the probationary period, the
144144 employee shall be subject to all rights and protections
145145 currently provided by the countywide civil service system.
146146 Section 2. This act shall become effective immediately
147147 following its passage and approval by the Governor, or its
148148 otherwise becoming law.
