77 | 77 | | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: |
---|
78 | 78 | | Section 1. (a) For the purposes of this section, the |
---|
79 | 79 | | term "countywide civil service system" means a civil service |
---|
80 | 80 | | system established by a local law that did not require |
---|
81 | 81 | | approval by a referendum and that applies only to a named |
---|
82 | 82 | | county that does not sponsor a retirement plan for its |
---|
83 | 83 | | employees and was not established by a general law of local |
---|
84 | 84 | | application that at the time of its enactment applied only to |
---|
85 | 85 | | a county or counties based on population, certain |
---|
86 | 86 | | municipalities in the county, and any governmental entity in |
---|
87 | 87 | | the county to which the civil service system applies. |
---|
88 | 88 | | (b) Any county, municipality, or governmental entity |
---|
89 | 89 | | subject to a countywide civil service system, by a majority |
---|
90 | 90 | | vote of the county commission, the city or town council, or |
---|
91 | 91 | | the governmental entity, may elect to opt out of the |
---|
92 | 92 | | countywide civil service system for the recruitment, testing, |
---|

123 | 123 | | (c) Any county, municipality, or governmental entity |
---|
124 | 124 | | making the election authorized by subsection (b), prior to the |
---|
125 | 125 | | effective date of the partial withdrawal, shall adopt a human |
---|
126 | 126 | | resources policy and procedures manual, which shall include |
---|
127 | 127 | | personnel policy guidelines; operational standards; employee |
---|
128 | 128 | | management, recruitment, testing, hiring and termination |
---|
129 | 129 | | procedures; equal employment opportunities policies; and |
---|
130 | 130 | | workplace harassment policies to ensure compliance with |
---|
131 | 131 | | applicable federal and state laws, rules, and regulations. |
---|
132 | 132 | | (d) A county, municipality, or governmental entity |
---|
133 | 133 | | making the election pursuant to this section shall provide |
---|
134 | 134 | | written notice to the director of the countywide civil service |
---|
135 | 135 | | system of its decision to conduct its own recruitment and |
---|
136 | 136 | | hiring outside of the countywide civil service system. |
---|
137 | 137 | | (e) Any employee hired by a county, municipality, or |
---|
138 | 138 | | governmental entity shall immediately become subject to the |
---|
139 | 139 | | countywide civil service system, provided that the employee |
---|
140 | 140 | | shall complete a probationary period of twelve months during |
---|
141 | 141 | | which probationary period the employee shall be an at-will |
---|
142 | 142 | | employee with no property right in his or her position. Upon |
---|
143 | 143 | | satisfactory completion of the probationary period, the |
---|
144 | 144 | | employee shall be subject to all rights and protections |
---|
145 | 145 | | currently provided by the countywide civil service system. |
---|
146 | 146 | | Section 2. This act shall become effective immediately |
---|
147 | 147 | | following its passage and approval by the Governor, or its |
---|
148 | 148 | | otherwise becoming law. |
