1515 AN ACT
1616 Relating to Lauderdale County; to amend Section
1717 45-39-246, providing for the distribution of Tennessee Valley
1818 Authority in lieu-of-taxes payments, to reallocate payments
1919 from the county and municipalities to the Agriculture Center
2020 Authority.
2121 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2222 Section 1. Section 45-39-246 of the Code of Alabama
2323 1975, is amended to read as follows:
2424 "§45-39-246
2525 (a) In Lauderdale County, the payments made to the
2626 county commission as authorized in Section 40-28-2 shall be
2727 distributed by the county commission as follows: 10 percent of
2828 the payments shall be distributed to the county to be used in
2929 the county road and bridge fund; 30 percent of such the
3030 payments shall be disbursed on the same formula as school
3131 funds according to how the State Department of Education’s
3232 current expense ratio are apportioned , to the two local school
3333 systems - the Lauderdale County Board of Education and the
3434 Florence Board of Education; 60 70 percent of the payments
3535 shall be distributed to the county general fund and the

6565 general funds of the City of Florence, the City of
6666 Rogersville, the City of Lexington, the City of Killen, the
6767 City of Anderson, the City of St. Florian, and the City of
6868 Waterloo. The county shall share the 60 percent with the
6969 cities in the same ratio that the population of each named
7070 city bears to the population of the entire county Lauderdale
7171 County Agriculture Center Authority .
7272 (b) Notwithstanding the provisions of subsection (a),
7373 after the establishment of an agriculture authority in the
7474 county, the county commission shall annually distribute one
7575 million two hundred thousand dollars ($1,200,000) to the
7676 authority; however, the percentages for the distribution of
7777 the balance of the payments shall remain the same for the
7878 entities listed in subsection (a). "
7979 Section 2. This act shall become effective on the first
8080 day of the third month following its passage and approval by
8181 the Governor, or its otherwise becoming law.
