1515 SYNOPSIS:
1616 Under existing law, federal income taxes are
1717 deductible from gross income prior to computation of
1818 Alabama income tax liability.
1919 Also under existing law, the state levies sales
2020 taxes upon the sale of food items.
2121 This bill would propose an amendment to the
2222 Constitution of Alabama of 2022, relating to the
2323 elimination of the deductibility of federal income
2424 taxes from Alabama gross income for individual
2525 taxpayers; and to remove the state sales tax on food
2626 items.

2929 AN ACT
3030 Relating to income tax and sales tax; proposing an
3131 amendment to Section 211.04 of the Constitution of Alabama of
3232 2022, to eliminate the state income tax deduction for federal
3333 income taxes for individual taxpayers; and to eliminate the
3434 state sales tax on food.
3535 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

6666 of Alabama of 2022, is proposed and shall become valid as a
6767 part of the constitution when approved by a majority of the
6868 qualified electors voting thereon and in accordance with
6969 Sections 284, 285, and 287 of the Constitution of Alabama of
7070 2022:
7171 PROPOSED AMENDMENT
7272 (a) Section 211.04 of the Constitution of Alabama of
7373 2022, is repealed.
7474 (b) Effective for all tax years beginning after
7575 December 31, 2023, federal income taxes shall no longer be
7676 allowed to be deducted in computing income subject to the
7777 state individual income tax.
7878 (c) Beginning January 1, 2024, the sale of food shall
7979 be exempt from state sales tax. The sale of food to
8080 corporations, S corporations, and limited liability entities,
8181 as defined in Section 40-14A-1, Code of Alabama of 1975, shall
8282 not be exempt from state sales tax. For purposes of this
8383 amendment, "food" is defined in 7 U.S.C ยง 2011, et seq., for
8484 the purposes of the federal Supplemental Nutrition Assistance
8585 Program, regardless of where or by what means food is sold. In
8686 the event that the federal Supplemental Nutrition Assistance
8787 Program definition no longer exists, the Legislature shall
8888 provide a new definition of "food" by general law.
8989 Upon ratification of this constitutional amendment, the
9090 Code Commissioner shall number and place this amendment as
9191 appropriate in the constitution omitting this instructional
9292 paragraph and may make the following nonsubstantive revisions:
9393 change capitalization, spelling, and punctuation for purposes

124124 clerical, and typographical errors; and correct incorrect

126126 Section 2. An election upon the proposed amendment
127127 shall be held in accordance with Sections 284 and 285 of the
128128 Constitution of Alabama of 2022, and the election laws of this
129129 state.
130130 Section 3. The appropriate election official shall
131131 assign a ballot number for the proposed constitutional
132132 amendment on the election ballot and shall set forth the
133133 following description of the substance or subject matter of
134134 the proposed constitutional amendment:
135135 "Proposing an amendment to the Constitution of Alabama
136136 of 2022, to the "Tax Fairness Amendment of 2023," which would
137137 remove the four percent state sales tax on food and remove the
138138 individual income tax deduction for federal income taxes paid
139139 or accrued.
