19+SYNOPSIS:
20+Under existing law, an adult with a disability
21+may be the subject of a guardianship or
22+conservatorship.
23+Also under existing law, an adult with a
24+guardianship or conservatorship may not make certain
25+major decisions for himself or herself. The guardian or
26+conservator generally holds the decision-making
27+authority.
28+This bill would provide that, in lieu of a
29+guardianship or conservatorship, an adult may enter
30+into a supported decision-making agreement with
31+supporters who may assist and advise the adult with
32+making certain decisions without impeding the adult's
33+self-determination.
34+This bill would also provide for the procedures
35+and limitations related to a supported decision-making
36+agreement.

2240 Relating to guardianships and conservatorships; to
23-create the Colby Act; to provide for a supported
24-decision-making agreement as an alternative to a guardianship
25-or conservatorship; and to provide the scope and limitations
26-of a supported decision-making agreement.
27-BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
28-Section 1. This act shall be known and may be cited as
29-the Colby Act.
30-Section 2. For the purposes of this act, the following
31-terms have the following meanings:
32-(1) SUPPORTED DECISION-MAKING. The process of
33-supporting and accommodating an adult in the decision-making
34-process without impeding the self-determination of the adult.
35-This term includes assistance in making, communicating, and
36-effectuating life decisions.
37-(2) SUPPORTED DECISION-MAKING AGREEMENT. A written
38-agreement detailing decision-making supports and
39-accommodations that an adult chooses to receive from one or
40-more supporters.
41-(3) SUPPORTER. An individual at least 18 years of age
42-who has voluntarily entered into a supported decision-making
43-agreement with an adult and is designated as such in a
44-supported decision-making agreement.
45-Section 3. (a) An adult may not enter into a supported
46-decision-making agreement as an alternative to guardianship or
47-conservatorship unless the adult meets both of the following

71+decision-making agreement as an alternative to a guardianship
72+or conservatorship; and to provide the scope and limitations
73+of a supported decision-making agreement.
74+BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
75+Section 1. This act shall be known and may be cited as
76+the Colby Act.
77+Section 2. For the purposes of this act, the following
78+terms have the following meanings:
79+(1) SUPPORTED DECISION-MAKING. The process of
80+supporting and accommodating an adult in the decision-making
81+process without impeding the self-determination of the adult.

7896 (1) The adult enters into the agreement voluntarily and
7997 without coercion or undue influence.
80-(2) The adult understands the nature and effect of the
81-agreement.
82-(b) An adult may make, change, or revoke a supported
83-decision-making agreement.
84-(c) A court may not consider an adult's execution of a
85-supported decision-making agreement as evidence of the adult's
86-incapacity. The existence of an executed supported
87-decision-making agreement does not preclude the adult from
88-acting independently of the supported decision-making
89-agreement.
90-(d) An adult may not enter into a supported
91-decision-making agreement under this section if the agreement
92-supplants the authority of a guardian or conservator of the
93-adult.
94-(e) No third-party individual or entity may require an
95-adult to execute a supported decision-making agreement for any
96-purpose. For the purposes of this act, the term "third-party
97-individual or entity" does not include a guardian or
98-conservator.
99-Section 4. A document substantially in the following
100-format may be used to create a supported decision-making
101-agreement that has the meaning and effect prescribed by this
102-act.

146+(3) Act within the scope set forth in the adult's
147+supported decision-making agreement.
148+(4) Avoid conflicts of interest.
149+(5) Timely notify the adult in writing, in the adult's
150+preferred language and mode of communication, of his or her
151+intent to resign as a supporter.
152+(b) A supporter is a fiduciary and shall make and
153+communicate decisions in cooperation with the adult and
154+preserve the adult's authority to make decisions.

190+making a specific decision authorized by the supported
191+decision-making agreement.
192+(4) Obtain, without the consent of the adult, nonpublic
193+personal information, as defined by 15 U.S.C. ยง 6809(4).
194+(5) Act outside the scope of authority provided in the
195+supported decision-making agreement.
196+(d) A supporter who is expressly given relevant
197+authority in a power of attorney may act within the scope of
198+that authority to sign instructions or other documents on
199+behalf of the adult, or to communicate or implement decisions
200+made by the adult.
201+(e) A request or decision made or communicated with the
202+assistance of a supporter in conformity with the supported
203+decision-making agreement shall be recognized as the request
204+or decision of the adult for the purposes of any provision of
205+law.
206+Section 5. (a) A supported decision-making agreement
207+shall meet all of the following requirements:
208+(1) Name at least one supporter.
209+(2) Describe the decision-making assistance that each
210+supporter may provide to the adult and how supporters may work
211+together.

246+(5) Contain a separate consent signed by each supporter
247+named in the agreement indicating each of the following:
248+a. The supporter's relationship to the adult.
249+b. The supporter's willingness to act as a supporter.
250+c. The supporter's acknowledgment of his or her duties
251+as a supporter.
252+(b) A supported decision-making agreement may do any of
253+the following:
254+(1) Appoint more than one supporter.
255+(2) Appoint an alternate supporter to act in the place
256+of a supporter under circumstances specified in the agreement.
257+(3) Authorize a supporter to share information with any
258+other supporter or others named in the agreement.
259+Section 6. (a) An adult may revoke a supported
260+decision-making agreement at any time. A revocation under this
261+section shall be in writing, and a copy of the revocation
262+shall be provided to each supporter.
263+(b) Except as provided in the supported decision-making
264+agreement, a supported decision-making agreement terminates in
265+each the following situations:
266+(1) The adult who is the subject of the supported
267+decision-making agreement dies.
268+(2) The adult who is the subject of the supported

310+temporary or permanent guardian or conservator for the person
311+or property of the adult, unless the court's order of
312+appointment does each of the following:
313+a. Expressly modifies, but continues, the supported
314+decision-making agreement alongside a partial guardianship or
315+conservatorship.
316+b. Limits the powers and duties of the guardian or
317+conservator.
318+(7) The adult signs a valid durable power of attorney,
319+except to the extent that the power of attorney expressly
320+continues, in whole or in part, the supported decision-making
321+agreement.
322+(c) The court may enter an order pursuant to
323+subdivision (b)(4), (b)(5), or (b)(6) only after providing
324+notice and a hearing to the adult and all supporters named in
325+the agreement.

355+Section 7. A supported decision-making agreement that
356+complies with Section 5 is presumed valid. A party may rely on
357+the presumption of validity unless the party has actual
358+knowledge that the supported decision-making agreement was not
359+validly executed.
360+Section 8. (a) A person who in good faith relies on an
361+authorization in a supported decision-making agreement is not
362+subject to discipline for unprofessional conduct.
363+(b) This section does not apply to a person whose act
364+or omission amounts to fraud, misrepresentation, recklessness,
365+or willful or wanton misconduct.
366+Section 9. (a) The meaning and effect of a supported
367+decision-making agreement is determined by the law of the
368+jurisdiction in which the supported decision-making agreement
369+was executed, unless the supported decision-making agreement
370+provides otherwise.
371+(b) A person who receives a copy of a supported
372+decision-making agreement or is aware of the existence of a
373+supported decision-making agreement and reasonably believes
374+that an adult is being abused, neglected, or exploited shall
375+report the alleged abuse, neglect, or exploitation to an adult
376+protective services agency or an authorized law enforcement
377+agency.
378+Section 10. This act shall become effective on the
379+first day of the third month following its passage and
380+approval by the Governor, or its otherwise becoming law.

468-Section 5.(a) A supporter shall do all of the

528-(e) A request or decision made or communicated with the

533-Section 6. (a) A supported decision-making agreement

653-Section 8. A supported decision-making agreement that
654-complies with Section 34 is presumed valid. A party may rely
655-on the presumption of validity unless the party has actual
656-knowledge that the supported decision-making agreement was not

658-Section 9. (a) A person who in good faith relies on an
659-authorization in a supported decision-making agreement is not
660-subject to discipline for unprofessional conduct.
661-(b) This section does not apply to a person whose act
662-or omission amounts to fraud, misrepresentation, recklessness,
663-or willful or wanton misconduct.
664-Section 10. (a) The meaning and effect of a supported
665-decision-making agreement is determined by the law of the
666-jurisdiction in which the supported decision-making agreement

698-(b) A person who receives a copy of a supported
699-decision-making agreement or is aware of the existence of a
700-supported decision-making agreement and reasonably believes
701-that an adult is being abused, neglected, or exploited shall
702-report the alleged abuse, neglect, or exploitation to an adult
703-protective services agency or an authorized law enforcement
704-agency.
705-Section 11. This act shall become effective on the
706-first day of the third month following its passage and
707-approval by the Governor, or its otherwise becoming law.
