15	15	SYNOPSIS:
16	16	This bill would amend Section 25-2-2, Section
17	17	25-2-3, and Section 25-2-6, Code of Alabama 1975, to
18	18	rename the Alabama Department of Labor to the Alabama
19	19	Department of Workforce, to change the title of the
20	20	head of the department from Secretary of Labor to
21	21	Secretary of Workforce, to further provide for the
22	22	duties and responsibilities of the secretary, and to
23	23	transfer certain state and federal workforce programs,
24	24	staff, and assets from the Department of Commerce to
25	25	the department.
26	26	This bill would also add Chapter 15 of Title 25,
27	27	Code of Alabama 1975, and amend Section 41-29-282, Code
28	28	of Alabama 1975, to establish the Alabama Workforce
29	29	Board as the State Workforce Development Board, to
30	30	establish seven regional workforce boards, add
31	31	responsibilities of the new Department, and further
32	32	provide for the responsibilities of the Department of
33	33	Commerce and the Alabama Industrial Development and
34	34	Training Institute.
35	35	This bill would also repeal Sections 41-29-290,

125	125	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
126	126	Section 1. This act shall be known and may be cited as
127	127	the Alabama Workforce Transformation Act.
128	128	Section 2. The Alabama Department of Labor is hereby
129	129	renamed the Alabama Department of Workforce, and the head of
130	130	the department shall be known and designated as the Secretary
131	131	of Workforce. Any reference in Alabama law or in any contract,
132	132	deed, financial instrument or other legal document to the
133	133	Alabama Department of Labor or Secretary of Labor shall be
134	134	interpreted to mean the Alabama Department of Workforce or the
135	135	Secretary of Workforce as necessary to accomplish the purposes
136	136	of this act. The Code Commissioner shall conform references in
137	137	the Code of Alabama 1975, to existing departments, offices,
138	138	officers, and other state entities or positions to reflect the
139	139	changes required by this act. Code changes shall be made at a
140	140	time determined to be appropriate by the Code Commissioner.
141	141	Section 3. Section 25-2-2, Code of Alabama 1975, is
142	142	amended to read as follows:
143	143	"§25-2-2
144	144	(a) The general functions and duties of the Department
145	145	of LaborWorkforce shall be as follows:
146	146	(1) To administer all labor laws and all laws relating
147	147	to the relationship between employer and employee, including
148	148	laws relating to hours of work, and working conditions in
149	149	places of employment.
150	150	(2) To make or cause to be made all necessary
151	151	inspections to determine whether or not the laws, the
152	152	administration of which is delegated to the Department of
153	153	LaborWorkforce, and rules and regulations issued pursuant

184	184	thereto, are being complied with by employers and employees,
185	185	and to take such action as may be necessary to enforce
186	186	compliance; provided, however, that there shall be no
187	187	inspection of boilers which have been inspected, approved, and
188	188	insured by an insurance company authorized to do business in
189	189	the State of Alabama. Provided, however, that this provision
190	190	may not prevent compliance verification by the department.
191	191	(3) To propose to the board of appeals, provided for in
192	192	this chapter, such rules and regulations, or amendments as may
193	193	be deemed advisable for the prevention of accidents or the
194	194	prevention of sickness and diseases in mines. The Secretary of
195	195	LaborWorkforce may appoint committees composed of employers,
196	196	employees, and experts to suggest and assist in the
197	197	preparation of rules and regulations or amendments.
198	198	(4) To administer and perform, by and under the
199	199	direction of the Secretary of LaborWorkforce, all functions
200	200	and duties of Chapter 4 of this title, and it shall have power
201	201	and authority to adopt and enforce all reasonable rules and
202	202	orders necessary or suitable to that end, and to require any
203	203	reports, and to take any other action, consistent with Chapter
204	204	4 of this title, necessary or suitable to that end.
205	205	(5) To cooperate with all authorities of the United
206	206	States having powers and duties under the Wagner-Peyser Act,
207	207	approved June 6, 1933 (48 Stat. 113, United States Code, Title
208	208	29, Section 49) entitled "An Act to provide for the
209	209	establishment of a national employment system and for
210	210	cooperation with the states in the promotion of such system
211	211	and for other purposes," and to do and perform all things

242	242	necessary to secure for the State of Alabama the benefits of
243	243	such act and the promotion and maintenance of a system of
244	244	public employment offices. The Department of LaborWorkforce is
245	245	hereby designated as the state agency and vested with all
246	246	powers necessary to cooperate with the United States
247	247	Employment Service or its successor.
248	248	(6) To administer and perform, by and under the
249	249	direction of the Secretary of LaborWorkforce, all functions
250	250	and duties of Chapter 5 of this title, and it shall have power
251	251	and authority to adopt and enforce all reasonable rules and
252	252	orders necessary or suitable to that end, and to require any
253	253	reports, and to take any other action, consistent with Chapter
254	254	5 of this title, necessary or suitable to that end.
255	255	(7) To make investigations and studies and to collect,
256	256	collate, and compile statistical information and to make and
257	257	publish reports concerning the state’s labor force
258	258	participation rate, unemployment rate, barriers to employment,
259	259	conditions of labor generally, including living conditions,
260	260	hours of work, wages paid, and all matters relating to the
261	261	enforcement and effect of the provisions of this title coming
262	262	under the jurisdiction of the Department of LaborWorkforce and
263	263	the rules and regulations issued pursuant thereto and other
264	264	laws relating to the Department of LaborWorkforce. The
265	265	Secretary of LaborWorkforce shall deliver a copy of each such
266	266	report to every person making application therefor.
267	267	(8) To make an annual report to the Governor covering
268	268	the activities and accomplishments of the Department of
269	269	LaborWorkforce during the preceding fiscal year, accompanied

299	299	LaborWorkforce during the preceding fiscal year, accompanied
300	300	by the recommendations of the Secretary of LaborWorkforce. The
301	301	report shall be printed and the Secretary of LaborWorkforce
302	302	shall deliver a copy to every person making application
303	303	therefor.
304	304	(9) To make recommendations to the Legislature for the
305	305	enactment of laws which, on the basis of information and
306	306	statistics compiled by the Department of LaborWorkforce,
307	307	appear to be desirable for the development and training of the
308	308	state’s labor force, protection of laborers , and for promoting
309	309	and fostering amicable relations between employers and
310	310	employees.
311	311	(10) To administer and perform, by and under the
312	312	direction of the Secretary of LaborWorkforce, all functions
313	313	and duties of Section 25-2-7, and it shall have power and
314	314	authority to adopt and enforce all reasonable rules and orders
315	315	necessary or suitable to that end, and to require any reports,
316	316	and to take any other action, consistent with Section 25-2-7,
317	317	necessary or suitable to that end.
318	318	(11) To administer and perform, by and under the
319	319	direction of the Secretary of LaborWorkforce, all functions
320	320	and duties of Chapter 7 of this title and such other statutes
321	321	as may be provided by law and to advise the Governor with
322	322	respect to the provisions thereof, and it shall have power and
323	323	authority to adopt and enforce all reasonable rules and orders
324	324	necessary or suitable to that end, and to require any reports,
325	325	and to take any other action, consistent with Chapter 7 of
326	326	this title, necessary or suitable to that end.

374	374	power and authority to adopt and enforce all reasonable rules
375	375	and orders necessary or suitable to that end, and to require
376	376	any reports, and to take any other action, consistent with
377	377	Chapter 10 of this title, necessary or suitable to that end.
378	378	(15) To administer and perform, by and under the
379	379	direction of the Secretary of LaborWorkforce, all functions
380	380	and duties of Chapter 11 of this title, and it shall have
381	381	power and authority to adopt and enforce all reasonable rules
382	382	and orders necessary or suitable to that end, and to require
383	383	any reports, and to take any other action, consistent with

429	429	and duties of Chapter 14 of this title, and it shall have
430	430	power and authority to adopt and enforce all reasonable rules
431	431	and orders necessary or suitable to that end, and to require
432	432	any reports, and to take any other action, consistent with
433	433	Chapter 14 of this title, necessary or suitable to that end.
434	434	(19) To perform the duties set forth in subsection
435	435	(a)(5) of this chapter related to the administration of Title
436	436	III of the Wagner-Peyser Act and the Employment Service and
437	437	the Alabama Career Center Systems within the State.
438	438	(20) To cooperate with all authorities of the United
439	439	States concerning the development, management, and delivery of
440	440	workforce and labor market information funded through the
441	441	Workforce and Labor Market Information Grants to States (WIGS)
442	442	implementation of the federal Workforce Information Grant.

490	490	currently administered by the Department of Commerce, except
491	491	for the Alabama Industrial Development Training Institute,
492	492	including, but not limited to:
493	493	a. Programs funded by Title I of the federal Workforce
494	494	Innovation and Opportunity Act.
495	495	b. The Alabama Office of Apprenticeship.
496	496	c. The Alabama Committee on Credentialing and Career
497	497	Pathways established by Act 2019-506.
498	498	d. The Alabama Committee on Credential Quality and
499	499	Transparency established by Act 2023-365.
500	500	e. The Alabama STEM Council.

532	532	(b) The combining of the functions of the Department of
533	533	Industrial Relations and Department of Labor made by Act
534	534	2012-496 shall reduce administrative costs and expenses paid
535	535	from the State General Fund by an amount equal to at least 20
536	536	percent of the amount appropriated from the State General Fund
537	537	to the Department of Labor for the fiscal year ending
538	538	September 30, 2012.

540	540	assigned to Regional Workforce Councils at the Department of
541	541	Commerce shall be transferred to the Department of Workforce. "
542	542	Section 4. Section 25-2-3, Code of Alabama 1975, is
543	543	amended to read as follows:
544	544	"§25-2-3
545	545	(a) The Secretary of LaborWorkforce, with the approval
546	546	of the Governor, may establish such division or divisions as
547	547	may, in his discretion, be necessary or desirable for the
548	548	administration or enforcement of any law or any rule or
549	549	regulations with which the Department of LaborWorkforce is
550	550	charged or the performance of any of its functions or duties.
551	551	Each division in the Department of LaborWorkforce shall be
552	552	headed by and be under the direction, supervision and control
553	553	of an officer who shall be designated as the chief of such
554	554	division. All chiefs of divisions shall be appointed by the
555	555	Secretary of LaborWorkforce, subject to the provisions of the
556	556	Merit Systemand shall serve in the exempt service . Before
557	557	entering upon the discharge of their duties, such chiefs of
558	558	divisions shall take the constitutional oath of office. Each
559	559	of such officers shall devote his full time to his official

590	590	duties and shall hold no other lucrative position while
591	591	serving as such.
592	592	(b) It is one of the purposes of this chapter to
593	593	coordinatein a single Unemployment Compensation Division , in
594	594	one division of the Department of Labor, all of the state's
595	595	unemployment compensation services and employment service .
596	596	Unemployment compensation services and employment service
597	597	shall be in one division of the Department of LaborWorkforce
598	598	under the direction of the chief of said division. Within said
599	599	division, but subordinate to the chief thereof, there shall be
600	600	a full-time salaried director of unemployment compensation and
601	601	a full-time salaried director of employment service. The
602	602	salariessalary of said the division chief and directors
603	603	shallmay be paid solely from federal grants and shall be
604	604	comparable to those paid similar officers in comparable
605	605	states, notwithstanding any limitation or maximum in any other
606	606	law.The division chief may employ personnel in the classified
607	607	service of the Merit System to carry out the duties of this
608	608	division.
609	609	(c) It is another purpose of this chapter to coordinate
610	610	in a single Workforce Pathways Division, all of the
611	611	department’s workforce development functions and workforce
612	612	funding mechanisms, including the Alabama Workforce Board; the
613	613	regional workforce boards; the employment service and Alabama
614	614	Career Center System; the Alabama Office of Apprenticeship;
615	615	the Alabama STEM Council; the Office of Education and
616	616	Workforce Statistics; programs funded by Title I of the
617	617	federal Workforce Innovation and Opportunity Act; the Alabama

651	651	program and the Labor Market Division; the Federal Bonding
652	652	Program; the federal Jobs for Veterans State Grants Program;
653	653	and the federal Work Opportunity Tax Credit. The division
654	654	chief may employ personnel in the classified service of the
655	655	Merit System to carry out the duties of this division. It is
656	656	the intent of the Legislature that the Workforce Pathways
657	657	Division of the Department of Workforce serve as the
658	658	centralized data and information repository for the workforce
659	659	development activities of the state. "
660	660	Section 5. Chapter 15 of Title 25, Code of Alabama
661	661	1975, is added to read as follows:
662	662	§ 25-15-1. Alabama Workforce Board; creation; purpose.
663	663	(a) The Governor shall establish the Alabama Workforce
664	664	Board as the State Workforce Development Board for purposes of
665	665	Section 101 of the Workforce Innovation and Opportunity Act of
666	666	2014 (P.L. 113-128), as amended, and to carry out its purposes
667	667	pursuant to state law; provided, that in the event of a
668	668	conflict between state law and WIOA, WIOA shall prevail.
669	669	(b) It is the intent of the Legislature that all state
670	670	and local entities that receive state-appropriated funding and
671	671	are engaged in workforce development activities will fully
672	672	participate in and cooperate with the activities and
673	673	recommendations of the Board, but the Board shall not directly
674	674	exercise governing control of state and local agencies,
675	675	departments, educational institutions, boards, commissions,

708	708	(c) For purposes of this chapter, “WIOA” means the
709	709	Workforce Innovation and Opportunity Act of 2014 (P.L.
710	710	113-128), as amended.
711	711	§ 25-15-2. Duties of the Board.

718	718	(2) Assisting the Governor in performing the functions

721	721	(3) Coordinating the federal WIOA funding component of

766	766	§ 25-15-3. Composition of the Board; chair; bylaws.
767	767	(a) The Alabama Workforce Board shall consist of no
768	768	more than forty (40) members, or their designees, and meet the
769	769	membership criteria established by WIOA. All members, unless
770	770	otherwise provided in this subsection, shall be appointed by
771	771	the Governor. A majority of members shall be representatives
772	772	of business and industry, at least one of which shall
773	773	represent small business. Twenty percent of the members shall
774	774	be representatives of workforce, including two (2) labor
775	775	representatives and one (1) apprenticeship program
776	776	representative. The Board shall also include one
777	777	representative of the WIOA Title I-b programs; the State Adult

790	790	(b) The Governor shall appoint a chairperson from the

829	829	(c) of this section.
830	830	§ 25-15-4. Board meetings; committees.
831	831	(a) The Alabama Workforce Board shall meet at least
832	832	four times per year but may meet more frequently at the call
833	833	of the chairperson or the Governor.
834	834	(b) Meetings of the Board and any committee established
835	835	pursuant to this subsection shall be conducted pursuant to the
836	836	Open Meetings Act.
837	837	(c) The Governor, or the chairperson with the consent
838	838	of the Governor, may establish and dissolve standing and ad
839	839	hoc committees. The Governor, or the chairperson with the
840	840	consent of the Governor, shall appoint the chair and members
841	841	of all standing and ad hoc committees.
842	842	§ 25-15-5. Alabama Workforce Board Executive Committee;
843	843	creation; purpose.
844	844	(a) There is hereby established the Executive Committee
845	845	of the Alabama Workforce Board that shall be comprised of

897	897	Workforce to provide oversight of the Alabama Workforce Board.
898	898	(e) Meetings of the Executive Committee shall be
899	899	subject to the Open Meetings Act.
900	900	§ 25-15-6. Strategic Workforce Plan and WIOA State
901	901	Plan.
902	902	(a) It is the intent of the Legislature that a single,
903	903	unified Strategic Workforce Plan should guide state and
904	904	federal workforce development policies and budget priorities
905	905	that are administered by the State. The Strategic Workforce
906	906	Plan shall be prepared by the Executive Committee, with

943	943	include, among other things, statewide labor market
944	944	projections for the quadrennium and recommendations for
945	945	meeting labor market demand. The Plan should also include
946	946	recommendations for expenditure of state and federal funds for
947	947	workforce development activities; analyze previous
948	948	expenditures for workforce development activities and
949	949	programs; make recommendations for sunsetting existing
950	950	programs and developing new programs; and provide
951	951	recommendations for performance and accountability metrics for
952	952	all state and federal workforce programs.
953	953	(c) The Plan may be updated through an annual addendum,
954	954	which shall be submitted to the Governor on or before November
955	955	1 of each year. The annual addendum to the four-year Strategic
956	956	Workforce Plan should include recommendations for the next
957	957	fiscal year, including the expenditure of state and federal
958	958	funds for workforce development activities, and should make
959	959	recommendations for sunsetting existing programs and
960	960	developing new programs.
961	961	(d) The Board shall assist the Governor and the
962	962	Secretary of Workforce in preparing the WIOA State plan, as
963	963	required by federal law. The WIOA State Plan shall demonstrate
964	964	that the membership of the Alabama Workforce Board satisfies

1004	1004	Workforce Plan as approved by the Executive Committee.
1005	1005	§ 25-15-7. Regional Workforce Boards; establishment;
1006	1006	duties; meetings; objectives.
1007	1007	(a) At the direction of the Governor, the Secretary of
1008	1008	Workforce shall establish seven regional workforce boards to
1009	1009	serve as Alabama’s local workforce development boards for
1010	1010	purposes of Section 107 of the Workforce Innovation and
1011	1011	Opportunity Act of 2014 (P.L. 113-128), as amended. The
1012	1012	Department of Workforce shall establish bylaws governing the
1013	1013	membership and activities of the regional workforce boards in
1014	1014	compliance with WIOA. Such local workforce development boards
1015	1015	shall be certified by the Governor pursuant to 29 U.S.C.
1016	1016	§3122(a).
1017	1017	(b) The Secretary of Workforce shall establish
1018	1018	geographic boundaries of the regional workforce boards and
1019	1019	criteria for the appointment of members to the regional
1020	1020	workforce boards consistent with WIOA, including 29 U.S.C.

1064	1064	use, workforce research and regional labor market analysis
1065	1065	using primary state labor market information provided by the

1067	1067	(3) Convene local workforce development system
1068	1068	stakeholders to assist in the development of the local plan.
1069	1069	(4) Lead local efforts to engage with a diverse range
1070	1070	of employers.
1071	1071	(5) Lead local efforts to develop and implement career

1073	1073	(6) Lead local efforts to identify and promote

1120	1120	§ 25-15-8. Reimbursement for expenses.
1121	1121	The members of the Alabama Workforce Board, including
1122	1122	members of the Executive Committee, and members of the
1123	1123	regional workforce boards shall not receive a salary or per
1124	1124	diem allowance but shall be entitled to reimbursement for
1125	1125	reasonable expenses incurred in the performance of the duties
1126	1126	of the office at the same rate allowed state employees.

1174	1174	for any reason shall be filled in the same manner as original

1176	1176	(c) Before entering upon the discharge of his or her
1177	1177	duties, the Secretary of LaborWorkforce shall take the
1178	1178	constitutional oath of office. Before entering upon the duties
1179	1179	of office, the Secretary of LaborWorkforce shall execute to
1180	1180	the State of Alabama a bond, to be approved by the Governor,
1181	1181	in an amount to be fixed by the Governor, but not less than
1182	1182	$10,000.00, for the faithful performance of the duties of the
1183	1183	office. The annual salary of the Secretary of LaborWorkforce
1184	1184	shall be fixed by the Governor at a sum comparable to salaries
1185	1185	paid similar officers in other states, notwithstanding any
1186	1186	limitation or maximum in any other law , $1,200.00 of which sum
1187	1187	shall be paid from moneys of the State of Alabama and the
1188	1188	remainder from grants of the United States of America to this

1303	1303	Workforce and the Executive Committee all budget requests
1304	1304	submitted by the departments and agencies referenced in
1305	1305	subsection (g) of this section, along with any other budget

1465	1465	its buildings, the AIDT director must first certify to the
1466	1466	Governor that the proposal is consistent with the Strategic
1467	1467	Workforce Plan. AIDT shall continue to be headed by the
1468	1468	director, who shall be appointed by the Secretary of Commerce
1469	1469	and shall serve at his or her pleasure. The powers, duties,
1470	1470	and qualifications required of the director shall be as set
1471	1471	forth in the AIDT Policy Manual, as amended from time to time
1472	1472	and approved by the Secretary of Commerce."

1534	1534	implemented not later than October 1, 2025.

1536	1536	1, 2024, following its passage and approval by the Governor,
1537	1537	or its otherwise becoming law.
