1515 SYNOPSIS:
1616 This bill would amend Section 25-2-2, Section
1717 25-2-3, and Section 25-2-6, Code of Alabama 1975, to
1818 rename the Alabama Department of Labor to the Alabama
1919 Department of Workforce, to change the title of the
2020 head of the department from Secretary of Labor to
2121 Secretary of Workforce, to further provide for the
2222 duties and responsibilities of the secretary, and to
2323 transfer certain state and federal workforce programs,
2424 staff, and assets from the Department of Commerce to
2525 the department.
2626 This bill would also add Chapter 15 of Title 25,
2727 Code of Alabama 1975, and amend Section 41-29-282, Code
2828 of Alabama 1975, to establish the Alabama Workforce
2929 Board as the State Workforce Development Board, to
3030 establish seven regional workforce boards, add
3131 responsibilities of the new Department, and further
3232 provide for the responsibilities of the Department of
3333 Commerce and the Alabama Industrial Development and
3434 Training Institute.
3535 This bill would also repeal Sections 41-29-290,
3636 Section 41-29-291, Section 41-29-292, Section
3737 41-29-293, Section 41-29-294, Section 41-29-295,

125125 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
126126 Section 1. This act shall be known and may be cited as
127127 the Alabama Workforce Transformation Act.
128128 Section 2. The Alabama Department of Labor is hereby
129129 renamed the Alabama Department of Workforce, and the head of
130130 the department shall be known and designated as the Secretary
131131 of Workforce. Any reference in Alabama law or in any contract,
132132 deed, financial instrument or other legal document to the
133133 Alabama Department of Labor or Secretary of Labor shall be
134134 interpreted to mean the Alabama Department of Workforce or the
135135 Secretary of Workforce as necessary to accomplish the purposes
136136 of this act. The Code Commissioner shall conform references in
137137 the Code of Alabama 1975, to existing departments, offices,
138138 officers, and other state entities or positions to reflect the
139139 changes required by this act. Code changes shall be made at a
140140 time determined to be appropriate by the Code Commissioner.
141141 Section 3. Section 25-2-2, Code of Alabama 1975, is
142142 amended to read as follows:
143143 "§25-2-2
144144 (a) The general functions and duties of the Department
145145 of LaborWorkforce shall be as follows:
146146 (1) To administer all labor laws and all laws relating
147147 to the relationship between employer and employee, including
148148 laws relating to hours of work, and working conditions in
149149 places of employment.
150150 (2) To make or cause to be made all necessary
151151 inspections to determine whether or not the laws, the
152152 administration of which is delegated to the Department of
153153 LaborWorkforce, and rules and regulations issued pursuant

184184 thereto, are being complied with by employers and employees,
185185 and to take such action as may be necessary to enforce
186186 compliance; provided, however, that there shall be no
187187 inspection of boilers which have been inspected, approved, and
188188 insured by an insurance company authorized to do business in
189189 the State of Alabama. Provided, however, that this provision
190190 may not prevent compliance verification by the department.
191191 (3) To propose to the board of appeals, provided for in
192192 this chapter, such rules and regulations, or amendments as may
193193 be deemed advisable for the prevention of accidents or the
194194 prevention of sickness and diseases in mines. The Secretary of
195195 LaborWorkforce may appoint committees composed of employers,
196196 employees, and experts to suggest and assist in the
197197 preparation of rules and regulations or amendments.
198198 (4) To administer and perform, by and under the
199199 direction of the Secretary of LaborWorkforce, all functions
200200 and duties of Chapter 4 of this title, and it shall have power
201201 and authority to adopt and enforce all reasonable rules and
202202 orders necessary or suitable to that end, and to require any
203203 reports, and to take any other action, consistent with Chapter
204204 4 of this title, necessary or suitable to that end.
205205 (5) To cooperate with all authorities of the United
206206 States having powers and duties under the Wagner-Peyser Act,
207207 approved June 6, 1933 (48 Stat. 113, United States Code, Title
208208 29, Section 49) entitled "An Act to provide for the
209209 establishment of a national employment system and for
210210 cooperation with the states in the promotion of such system
211211 and for other purposes," and to do and perform all things

242242 necessary to secure for the State of Alabama the benefits of
243243 such act and the promotion and maintenance of a system of
244244 public employment offices. The Department of LaborWorkforce is
245245 hereby designated as the state agency and vested with all
246246 powers necessary to cooperate with the United States
247247 Employment Service or its successor.
248248 (6) To administer and perform, by and under the
249249 direction of the Secretary of LaborWorkforce, all functions
250250 and duties of Chapter 5 of this title, and it shall have power
251251 and authority to adopt and enforce all reasonable rules and
252252 orders necessary or suitable to that end, and to require any
253253 reports, and to take any other action, consistent with Chapter
254254 5 of this title, necessary or suitable to that end.
255255 (7) To make investigations and studies and to collect,
256256 collate, and compile statistical information and to make and
257257 publish reports concerning the state’s labor force
258258 participation rate, unemployment rate, barriers to employment,
259259 conditions of labor generally, including living conditions,
260260 hours of work, wages paid, and all matters relating to the
261261 enforcement and effect of the provisions of this title coming
262262 under the jurisdiction of the Department of LaborWorkforce and
263263 the rules and regulations issued pursuant thereto and other
264264 laws relating to the Department of LaborWorkforce. The
265265 Secretary of LaborWorkforce shall deliver a copy of each such
266266 report to every person making application therefor.
267267 (8) To make an annual report to the Governor covering
268268 the activities and accomplishments of the Department of
269269 LaborWorkforce during the preceding fiscal year, accompanied

299299 LaborWorkforce during the preceding fiscal year, accompanied
300300 by the recommendations of the Secretary of LaborWorkforce. The
301301 report shall be printed and the Secretary of LaborWorkforce
302302 shall deliver a copy to every person making application
303303 therefor.
304304 (9) To make recommendations to the Legislature for the
305305 enactment of laws which, on the basis of information and
306306 statistics compiled by the Department of LaborWorkforce,
307307 appear to be desirable for the development and training of the
308308 state’s labor force, protection of laborers , and for promoting
309309 and fostering amicable relations between employers and
310310 employees.
311311 (10) To administer and perform, by and under the
312312 direction of the Secretary of LaborWorkforce, all functions
313313 and duties of Section 25-2-7, and it shall have power and
314314 authority to adopt and enforce all reasonable rules and orders
315315 necessary or suitable to that end, and to require any reports,
316316 and to take any other action, consistent with Section 25-2-7,
317317 necessary or suitable to that end.
318318 (11) To administer and perform, by and under the
319319 direction of the Secretary of LaborWorkforce, all functions
320320 and duties of Chapter 7 of this title and such other statutes
321321 as may be provided by law and to advise the Governor with
322322 respect to the provisions thereof, and it shall have power and
323323 authority to adopt and enforce all reasonable rules and orders
324324 necessary or suitable to that end, and to require any reports,
325325 and to take any other action, consistent with Chapter 7 of
326326 this title, necessary or suitable to that end.

371371 (14) To administer and perform, by and under the
372372 direction of the Secretary of LaborWorkforce, all functions
373373 and duties of Chapter 10 of this title, and it shall have
374374 power and authority to adopt and enforce all reasonable rules
375375 and orders necessary or suitable to that end, and to require
376376 any reports, and to take any other action, consistent with
377377 Chapter 10 of this title, necessary or suitable to that end.
378378 (15) To administer and perform, by and under the
379379 direction of the Secretary of LaborWorkforce, all functions
380380 and duties of Chapter 11 of this title, and it shall have
381381 power and authority to adopt and enforce all reasonable rules
382382 and orders necessary or suitable to that end, and to require
383383 any reports, and to take any other action, consistent with
384384 Chapter 11 of this title, necessary or suitable to that end.

415415 (16) To administer and perform, by and under the

417417 and duties of Chapter 12 of this title, and it shall have
418418 power and authority to adopt and enforce all reasonable rules
419419 and orders necessary or suitable to that end, and to require
420420 any reports, and to take any other action, consistent with
421421 Chapter 12 of this title, necessary or suitable to that end.
422422 (17) To administer and perform, by and under the
423423 direction of the Secretary of LaborWorkforce, all functions
424424 and duties of Chapter 13 of this title, and to require any
425425 reports, and to take any other action, consistent with Chapter
426426 13 of this title, necessary or suitable to that end.
427427 (18) To administer and perform, by and under the
428428 direction of the Secretary of LaborWorkforce, all functions
429429 and duties of Chapter 14 of this title, and it shall have
430430 power and authority to adopt and enforce all reasonable rules
431431 and orders necessary or suitable to that end, and to require
432432 any reports, and to take any other action, consistent with
433433 Chapter 14 of this title, necessary or suitable to that end.
434434 (19) To perform the duties set forth in subsection
435435 (a)(5) of this chapter related to the administration of Title
436436 III of the Wagner-Peyser Act and the Employment Service and
437437 the Alabama Career Center Systems within the State.
438438 (20) To cooperate with all authorities of the United
439439 States concerning the development, management, and delivery of
440440 workforce and labor market information funded through the
441441 Workforce and Labor Market Information Grants to States (WIGS)
442442 implementation of the federal Workforce Information Grant.

474474 States concerning the management and delivery of the Jobs for
475475 Veterans State Grants Program.
476476 (22) To cooperate with all authorities of the United
477477 States concerning the management and delivery of the federal
478478 Work Opportunity Tax Credit.
479479 (23) To cooperate with all authorities of the United
480480 States concerning the management and delivery of the Federal
481481 Bonding Program.
482482 (24) To administer the Alabama Workforce Board, its
483483 Executive Committee, and the Regional Workforce Boards.
484484 (25) To collaborate with the Alabama Workforce Board,
485485 its Executive Committee, and other state agencies,
486486 departments, boards, and commissions to develop cohesive and
487487 coordinated workforce development strategies, programs, and
488488 budget recommendations.
489489 (26) To administer all workforce development programs
490490 currently administered by the Department of Commerce, except
491491 for the Alabama Industrial Development Training Institute,
492492 including, but not limited to:
493493 a. Programs funded by Title I of the federal Workforce
494494 Innovation and Opportunity Act.
495495 b. The Alabama Office of Apprenticeship.
496496 c. The Alabama Committee on Credentialing and Career
497497 Pathways established by Act 2019-506.
498498 d. The Alabama Committee on Credential Quality and
499499 Transparency established by Act 2023-365.
500500 e. The Alabama STEM Council.
501501 f. The Office of Education and Workforce Statistics.

532532 (b) The combining of the functions of the Department of
533533 Industrial Relations and Department of Labor made by Act
534534 2012-496 shall reduce administrative costs and expenses paid
535535 from the State General Fund by an amount equal to at least 20
536536 percent of the amount appropriated from the State General Fund
537537 to the Department of Labor for the fiscal year ending
538538 September 30, 2012.
539539 (b) All state-level staff and state-owned assets
540540 assigned to Regional Workforce Councils at the Department of
541541 Commerce shall be transferred to the Department of Workforce. "
542542 Section 4. Section 25-2-3, Code of Alabama 1975, is
543543 amended to read as follows:
544544 "§25-2-3
545545 (a) The Secretary of LaborWorkforce, with the approval
546546 of the Governor, may establish such division or divisions as
547547 may, in his discretion, be necessary or desirable for the
548548 administration or enforcement of any law or any rule or
549549 regulations with which the Department of LaborWorkforce is
550550 charged or the performance of any of its functions or duties.
551551 Each division in the Department of LaborWorkforce shall be
552552 headed by and be under the direction, supervision and control
553553 of an officer who shall be designated as the chief of such
554554 division. All chiefs of divisions shall be appointed by the
555555 Secretary of LaborWorkforce, subject to the provisions of the
556556 Merit Systemand shall serve in the exempt service . Before
557557 entering upon the discharge of their duties, such chiefs of
558558 divisions shall take the constitutional oath of office. Each
559559 of such officers shall devote his full time to his official

590590 duties and shall hold no other lucrative position while
591591 serving as such.
592592 (b) It is one of the purposes of this chapter to
593593 coordinatein a single Unemployment Compensation Division , in
594594 one division of the Department of Labor, all of the state's
595595 unemployment compensation services and employment service .
596596 Unemployment compensation services and employment service
597597 shall be in one division of the Department of LaborWorkforce
598598 under the direction of the chief of said division. Within said
599599 division, but subordinate to the chief thereof, there shall be
600600 a full-time salaried director of unemployment compensation and
601601 a full-time salaried director of employment service. The
602602 salariessalary of said the division chief and directors
603603 shallmay be paid solely from federal grants and shall be
604604 comparable to those paid similar officers in comparable
605605 states, notwithstanding any limitation or maximum in any other
606606 law.The division chief may employ personnel in the classified
607607 service of the Merit System to carry out the duties of this
608608 division.
609609 (c) It is another purpose of this chapter to coordinate
610610 in a single Workforce Pathways Division, all of the
611611 department’s workforce development functions and workforce
612612 funding mechanisms, including the Alabama Workforce Board; the
613613 regional workforce boards; the employment service and Alabama
614614 Career Center System; the Alabama Office of Apprenticeship;
615615 the Alabama STEM Council; the Office of Education and
616616 Workforce Statistics; programs funded by Title I of the
617617 federal Workforce Innovation and Opportunity Act; the Alabama

648648 Committee on Credentialing and Career Pathways; the Alabama
649649 Committee on Credential Quality and Transparency; the
650650 Workforce and Labor Market Information Grants for States Grant
651651 program and the Labor Market Division; the Federal Bonding
652652 Program; the federal Jobs for Veterans State Grants Program;
653653 and the federal Work Opportunity Tax Credit. The division
654654 chief may employ personnel in the classified service of the
655655 Merit System to carry out the duties of this division. It is
656656 the intent of the Legislature that the Workforce Pathways
657657 Division of the Department of Workforce serve as the
658658 centralized data and information repository for the workforce
659659 development activities of the state. "
660660 Section 5. Chapter 15 of Title 25, Code of Alabama
661661 1975, is added to read as follows:
662662 § 25-15-1. Alabama Workforce Board; creation; purpose.
663663 (a) The Governor shall establish the Alabama Workforce
664664 Board as the State Workforce Development Board for purposes of
665665 Section 101 of the Workforce Innovation and Opportunity Act of
666666 2014 (P.L. 113-128), as amended, and to carry out its purposes
667667 pursuant to state law; provided, that in the event of a
668668 conflict between state law and WIOA, WIOA shall prevail.
669669 (b) It is the intent of the Legislature that all state
670670 and local entities that receive state-appropriated funding and
671671 are engaged in workforce development activities will fully
672672 participate in and cooperate with the activities and
673673 recommendations of the Board, but the Board shall not directly
674674 exercise governing control of state and local agencies,
675675 departments, educational institutions, boards, commissions,

708708 (c) For purposes of this chapter, “WIOA” means the
709709 Workforce Innovation and Opportunity Act of 2014 (P.L.
710710 113-128), as amended.
711711 § 25-15-2. Duties of the Board.
712712 The duties of the Alabama Workforce Board include:
713713 (1) Advising and supporting the Governor, Legislature,
714714 and state agencies concerning the administration, development,
715715 and continual improvement of the state’s workforce development
716716 system consistent with the Strategic Workforce Plan, WIOA, and
717717 other federal workforce development programs.
718718 (2) Assisting the Governor in performing the functions
719719 set forth in 20 C.F.R. § 679.130 and as contemplated by any
720720 other WIOA provision or regulation.
721721 (3) Coordinating the federal WIOA funding component of
722722 the state’s workforce development programs.
723723 (4) Developing accountability metrics for state and
724724 federal workforce programs, in addition to the metrics already
725725 prescribed by law.
726726 (5) Supporting the efforts of the Secretary of
727727 Workforce, who shall serve as the principal point of contact
728728 for state agencies and departments, public officials,
729729 businesses, and the public with respect to all aspects of the
730730 state’s workforce development activities.
731731 (6) Consulting with officials, leaders, and experts in
732732 workforce development including, but not limited to, federal,
733733 state, and local agencies, departments, educational

766766 § 25-15-3. Composition of the Board; chair; bylaws.
767767 (a) The Alabama Workforce Board shall consist of no
768768 more than forty (40) members, or their designees, and meet the

771771 the Governor. A majority of members shall be representatives
772772 of business and industry, at least one of which shall
773773 represent small business. Twenty percent of the members shall
774774 be representatives of workforce, including two (2) labor
775775 representatives and one (1) apprenticeship program
776776 representative. The Board shall also include one
777777 representative of the WIOA Title I-b programs; the State Adult
778778 Education Director; one representative of the Wagner-Peyser
779779 Program; the Commissioner of the Alabama Department of
780780 Rehabilitation Services; the Chancellor of the Alabama
781781 Community College System; the Secretary of Workforce; one
782782 member of the Alabama Senate appointed by the presiding
783783 officer of the Senate; one member of the Alabama House of
784784 Representatives appointed by the Speaker of the House; one
785785 county commissioner appointed by the Governor; one mayor

790790 (b) The Governor shall appoint a chairperson from the

829829 (c) of this section.
830830 § 25-15-4. Board meetings; committees.
831831 (a) The Alabama Workforce Board shall meet at least
832832 four times per year but may meet more frequently at the call
833833 of the chairperson or the Governor.
834834 (b) Meetings of the Board and any committee established
835835 pursuant to this subsection shall be conducted pursuant to the
836836 Open Meetings Act.
837837 (c) The Governor, or the chairperson with the consent
838838 of the Governor, may establish and dissolve standing and ad
839839 hoc committees. The Governor, or the chairperson with the
840840 consent of the Governor, shall appoint the chair and members
841841 of all standing and ad hoc committees.
842842 § 25-15-5. Alabama Workforce Board Executive Committee;
843843 creation; purpose.
844844 (a) There is hereby established the Executive Committee
845845 of the Alabama Workforce Board that shall be comprised of
846846 seven (7) members, including the Governor or the Governor’s
847847 designee, the Chair of the Alabama Workforce Board, and five
848848 (5) executive level business leaders who shall be appointed by

887887 (d) The Executive Committee shall be responsible for
888888 reviewing budget requests, making recommendations for the

890890 development activities, assisting the Secretary of Workforce
891891 in preparing the consolidated workforce development budget
892892 recommendation, working with the Secretary of Workforce to
893893 prepare the Strategic Workforce Plan, developing recommended
894894 performance goals and evaluation metrics related to the
895895 expenditure of state and federal funds for workforce
896896 development activities, and working with the Secretary of
897897 Workforce to provide oversight of the Alabama Workforce Board.
898898 (e) Meetings of the Executive Committee shall be
899899 subject to the Open Meetings Act.
900900 § 25-15-6. Strategic Workforce Plan and WIOA State
901901 Plan.
902902 (a) It is the intent of the Legislature that a single,
903903 unified Strategic Workforce Plan should guide state and
904904 federal workforce development policies and budget priorities
905905 that are administered by the State. The Strategic Workforce
906906 Plan shall be prepared by the Executive Committee, with
907907 support from the Secretary of Workforce, and published by the

939939 (b) The Secretary of Workforce shall submit the
940940 Strategic Workforce Plan to the Governor and the Legislature
941941 on or before February 1 of the first year of each legislative
942942 quadrennium. The four-year Strategic Workforce Plan shall
943943 include, among other things, statewide labor market
944944 projections for the quadrennium and recommendations for
945945 meeting labor market demand. The Plan should also include
946946 recommendations for expenditure of state and federal funds for
947947 workforce development activities; analyze previous
948948 expenditures for workforce development activities and
949949 programs; make recommendations for sunsetting existing
950950 programs and developing new programs; and provide
951951 recommendations for performance and accountability metrics for
952952 all state and federal workforce programs.
953953 (c) The Plan may be updated through an annual addendum,
954954 which shall be submitted to the Governor on or before November
955955 1 of each year. The annual addendum to the four-year Strategic
956956 Workforce Plan should include recommendations for the next
957957 fiscal year, including the expenditure of state and federal
958958 funds for workforce development activities, and should make
959959 recommendations for sunsetting existing programs and
960960 developing new programs.
961961 (d) The Board shall assist the Governor and the
962962 Secretary of Workforce in preparing the WIOA State plan, as
963963 required by federal law. The WIOA State Plan shall demonstrate
964964 that the membership of the Alabama Workforce Board satisfies

10051005 § 25-15-7. Regional Workforce Boards; establishment;
10061006 duties; meetings; objectives.
10071007 (a) At the direction of the Governor, the Secretary of
10081008 Workforce shall establish seven regional workforce boards to
10091009 serve as Alabama’s local workforce development boards for
10101010 purposes of Section 107 of the Workforce Innovation and
10111011 Opportunity Act of 2014 (P.L. 113-128), as amended. The
10121012 Department of Workforce shall establish bylaws governing the
10131013 membership and activities of the regional workforce boards in
10141014 compliance with WIOA. Such local workforce development boards
10151015 shall be certified by the Governor pursuant to 29 U.S.C.
10161016 §3122(a).
10171017 (b) The Secretary of Workforce shall establish
10181018 geographic boundaries of the regional workforce boards and
10191019 criteria for the appointment of members to the regional
10201020 workforce boards consistent with WIOA, including 29 U.S.C.
10211021 §3122 and 20 C.F.R. §679.110. One such criterion shall be a

10691069 (4) Lead local efforts to engage with a diverse range

10731073 (6) Lead local efforts to identify and promote
10741074 promising workforce development strategies.
10751075 (7) Lead local efforts to integrate data and technology

10771077 (e) A regional workforce board shall submit an annual
10781078 budget request to the Secretary of Workforce and the Executive
10791079 Committee that is consistent with the Strategic Workforce
10801080 Plan. A regional workforce board’s annual budget submission

11701170 by the Governor and shall hold office at the pleasure of the
11711171 Governor. To the extent reasonable, the Governor should
11721172 consider an individual’s experience in workforce development
11731173 matters, human resources, and the private sector. Vacancies
11741174 for any reason shall be filled in the same manner as original
11751175 appointments are made.
11761176 (c) Before entering upon the discharge of his or her
11771177 duties, the Secretary of LaborWorkforce shall take the
11781178 constitutional oath of office. Before entering upon the duties
11791179 of office, the Secretary of LaborWorkforce shall execute to
11801180 the State of Alabama a bond, to be approved by the Governor,
11811181 in an amount to be fixed by the Governor, but not less than
11821182 $10,000.00, for the faithful performance of the duties of the
11831183 office. The annual salary of the Secretary of LaborWorkforce
11841184 shall be fixed by the Governor at a sum comparable to salaries
11851185 paid similar officers in other states, notwithstanding any
11861186 limitation or maximum in any other law , $1,200.00 of which sum
11871187 shall be paid from moneys of the State of Alabama and the
11881188 remainder from grants of the United States of America to this
11891189 state. Such salary shall be payable at the same time and in
11901190 the same manner as the salaries of other state officers. The
