1717 AN ACT
1818 Relating to Marshall County, to amend 45-48-161 of the
1919 Code of Alabama 1975, to provide further for the distribution
2020 of in-lieu-of-taxes payments of the Tennessee Valley
2121 Authority.
2222 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2323 Section 1. Section 45-48-161 of the Code of Alabama
2424 1975, is amended to read as follows:
2525 "ยง45-48-161
2626 In each fiscal year, the distribution of the share of
2727 in-lieu-of-taxes payments of the Tennessee Valley Authority
2828 for Marshall County shall be as follows:
2929 (1) Twenty-five percent of the total amount allocated
3030 to Marshall County shall be distributed to the Marshall County
3131 Board of Education, the Arab City Board of Education, the
3232 Guntersville City Board of Education, the Albertville City
3333 Board of Education, and the Boaz Board of Education, on a per
3434 pupil basis based upon the student enrollment of the
3535 respective schools on the last day of the first monthly
3636 attendance report of each school year.
3737 (2)a. Four percent of the remaining 75 percent or two

6767 (2)a. Four percent of the remaining 75 percent or two
6868 hundred thousand dollars ($200,000), whichever is greater,
6969 shall be allocated for the operation of the Marshall County
7070 Legislative Delegation Office.
7171 b. Any funds not expended for the operation of the
7272 legislative office may be used for educational purposes or
7373 industrial or economic development projects in Marshall County
7474 as approved by unanimous consent of the legislative
7575 delegation.
7676 (3) The remaining 71 funds percent shall be allocated
7777 as provided herein and shall be reviewed by the county
7878 legislative delegation every four years.
7979 a.1. Six percent of the remaining 71 funds percent or
8080 two hundred thirty twothirty-two thousand dollars ($232,000),
8181 whichever is greater, shall be allocated to the Marshall
8282 County Economic Development Office. These moneys monies shall
8383 be used to employ a director and staff and to carry out the
8484 operation of recruiting industries and job opportunities for
8585 Marshall County and each of the municipalities in the county.
8686 The director shall be employed by the Economic Development
8787 Board.
8888 2. All money previously allocated to the Marshall
8989 County Economic Development Board which is accumulated and
9090 held in a designated fund for industrial or economic
9191 development projects in Marshall County is released for
9292 further allocation at the direction of the board.
9393 b. Thirty thousand dollars ($30,000) shall be allocated
9494 to the Marshall County Commission to help provide for school
9595 resource officers in the Marshall County school system.

125125 resource officers in the Marshall County school system.
126126 c. Fifteen thousand dollars ($15,000) shall be
127127 allocated to the Marshall County Economic Development Board in
128128 addition to the allocation in paragraph a.
129129 d. Twenty-five thousand dollars ($25,000) shall be
130130 allocated to the Mountain Valley Council on the Arts
131131 commencing on October 1, 2006 .
132132 e. Thirteen thousand dollars ($13,000) shall be
133133 allocated to the City of Albertville for ambulance use so long
134134 as ambulance service is provided by the city; and twenty-seven
135135 thousand dollars ($27,000) shall be allocated to the City of
136136 Arab for ambulance use so long as the ambulance service is
137137 provided by the city.
138138 f. Fifty thousand dollars ($50,000) shall be allocated
139139 to Mountain Lakes Behavioral Health Care, for mental health
140140 services, including substance abuse treatment and prevention.
141141 g. Eighteen thousand dollars ($18,000) shall be
142142 allocated to the Marshall County Convention and Visitors
143143 Bureau.
144144 h. Twenty-five thousand dollars ($25,000) shall be
145145 allocated to the Marshall County Coalition Against Domestic
146146 Violence.
147147 i. Twenty-five thousand dollars ($25,000) shall be
148148 allocated to CASA of Marshall County, Inc., for services to
149149 the aging and homebound.
150150 j. Twenty-five thousand dollars ($25,000) shall be
151151 allocated to the Marshall County RSVP.
152152 (4) All remaining amounts after the preceding
153153 allocations shall be paid to the county governing body to be

183183 allocations shall be paid to the county governing body to be

186186 Section 2. This act shall become effective on June 1,
