A BILL
TO BE ENTITLED
AN ACT
Relating to Marshall County, to amend 45-48-161 of the
Code of Alabama 1975, to provide further for the distribution
of in-lieu-of-taxes payments of the Tennessee Valley
Authority.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. Section 45-48-161 of the Code of Alabama
1975, is amended to read as follows:
"ยง45-48-161
In each fiscal year, the distribution of the share of
in-lieu-of-taxes payments of the Tennessee Valley Authority
for Marshall County shall be as follows:
(1) Twenty-five percent of the total amount allocated
to Marshall County shall be distributed to the Marshall County
Board of Education, the Arab City Board of Education, the
Guntersville City Board of Education, the Albertville City
Board of Education, and the Boaz Board of Education, on a per
pupil basis based upon the student enrollment of the
respective schools on the last day of the first monthly
attendance report of each school year.
(2)a. Four percent of the remaining 75 percent or two

(2)a. Four percent of the remaining 75 percent or two
hundred thousand dollars ($200,000), whichever is greater,
shall be allocated for the operation of the Marshall County
Legislative Delegation Office.
b. Any funds not expended for the operation of the
legislative office may be used for educational purposes or
industrial or economic development projects in Marshall County
as approved by unanimous consent of the legislative
delegation.
(3) The remaining 71 funds percent shall be allocated
as provided herein and shall be reviewed by the county
legislative delegation every four years.
a.1. Six percent of the remaining 71 funds percent or
two hundred thirty twothirty-two thousand dollars ($232,000),
whichever is greater, shall be allocated to the Marshall
County Economic Development Office. These moneys monies shall
be used to employ a director and staff and to carry out the
operation of recruiting industries and job opportunities for
Marshall County and each of the municipalities in the county.
The director shall be employed by the Economic Development
Board.
2. All money previously allocated to the Marshall
County Economic Development Board which is accumulated and
held in a designated fund for industrial or economic
development projects in Marshall County is released for
further allocation at the direction of the board.
b. Thirty thousand dollars ($30,000) shall be allocated
to the Marshall County Commission to help provide for school
resource officers in the Marshall County school system.

resource officers in the Marshall County school system.
c. Fifteen thousand dollars ($15,000) shall be
allocated to the Marshall County Economic Development Board in
addition to the allocation in paragraph a.
d. Twenty-five thousand dollars ($25,000) shall be
allocated to the Mountain Valley Council on the Arts
commencing on October 1, 2006 .
e. Thirteen thousand dollars ($13,000) shall be
allocated to the City of Albertville for ambulance use so long
as ambulance service is provided by the city; and twenty-seven
thousand dollars ($27,000) shall be allocated to the City of
Arab for ambulance use so long as the ambulance service is
provided by the city.
f. Fifty thousand dollars ($50,000) shall be allocated
to Mountain Lakes Behavioral Health Care, for mental health
services, including substance abuse treatment and prevention.
g. Eighteen thousand dollars ($18,000) shall be
allocated to the Marshall County Convention and Visitors
Bureau.
h. Twenty-five thousand dollars ($25,000) shall be
allocated to the Marshall County Coalition Against Domestic
Violence.
i. Twenty-five thousand dollars ($25,000) shall be
allocated to CASA of Marshall County, Inc., for services to
the aging and homebound.
j. Twenty-five thousand dollars ($25,000) shall be
allocated to the Marshall County RSVP.
(4) All remaining amounts after the preceding
allocations shall be paid to the county governing body to be

allocations shall be paid to the county governing body to be
distributed to the county and municipalities as provided by
law." 
Section 2. This act shall become effective on June 1,
2024.
