1717 SYNOPSIS:
1818 Under existing federal law, the AMBER Alert
1919 System sends an alert to assist in the recovery of a
2020 child under 17 years of age who a law enforcement
2121 agency believes has been abducted and is in imminent
2222 danger of serious bodily injury or death.
2323 Under existing state law, the Missing and
2424 Endangered Persons Alert Act sends an alert when the
2525 Alabama State Law Enforcement Agency believes an
2626 individual has been abducted and has a reasonable
2727 belief that the individual is at risk of bodily harm or
2828 death.
2929 This bill would create an Ebony Alert System to
3030 send an alert to assist in the recovery of a Black
3131 youth, including a young woman or girl, under certain
3232 circumstances.

6969 circumstances.
7070 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7171 Section 1. (a) For purposes of this section, "Ebony
7272 Alert" means a notification system, activated pursuant to
7373 subsection (b), designed to issue and coordinate alerts for
7474 Black youth, including young women and girls, who are reported
7575 missing under unexplained or suspicious circumstances.
7676 (b)(1) If a person is reported missing to a law
7777 enforcement agency and that agency determines that the
7878 requirements of subsection (c) are met, the law enforcement
7979 agency may request the Alabama State Law Enforcement Agency to
8080 activate an Ebony Alert.
8181 (2) If the Alabama State Law Enforcement Agency concurs
8282 that the requirements of subsection (c) have been met, it
8383 shall activate an Ebony Alert within the appropriate
8484 geographical area requested by the investigating law
8585 enforcement agency.
8686 (3) Radio, television, cable, satellite, and social
8787 media systems are encouraged to cooperate with disseminating
8888 the information contained in an Ebony Alert.
8989 (4) Upon activation of an Ebony Alert, the Alabama
9090 State Law Enforcement Agency shall assist the investigating
9191 law enforcement agency by issuing a be-on-the-lookout alert,
9292 an electronic flyer, or changeable message signs in compliance
9393 with subdivision (5).
9494 (5) Upon activation of an Ebony Alert, the Alabama
9595 State Law Enforcement Agency may use a changeable message sign
9696 if both of the following conditions are met:

126126 if both of the following conditions are met:
127127 a. A law enforcement agency determines that a vehicle
128128 may be involved in the missing person incident.
129129 b. Specific identifying information about the vehicle
130130 is available for public dissemination.
131131 (c) A law enforcement agency may request that an Ebony
132132 Alert be activated if that agency determines that an Ebony
133133 Alert would be an effective tool in the investigation of
134134 missing Black youth, including a young woman or girl, after
135135 considering the following factors:
136136 (1) The missing person is between 12 to 25 years of
137137 age.
138138 (2) The missing person suffers from a mental or
139139 physical disability.
140140 (3) The person is missing under circumstances that
141141 indicate any of the following:
142142 a. The missing person's physical safety may be
143143 endangered.
144144 b. The disappearance of the missing person may not have
145145 been voluntary, including an abduction or kidnapping.
146146 c. The missing person may be subject to trafficking.
147147 (4) The law enforcement agency determines that the
148148 person has gone missing under unexplained or suspicious
149149 circumstances.
150150 (5) The law enforcement agency believes any of the
151151 following:
152152 a. The person is in danger because of age, health,
153153 mental or physical disability, or environmental or weather
154154 related conditions.

185185 b. The person is in the company of a potentially
186186 dangerous person.
187187 c. There are other factors indicating that the person
188188 may be in peril.
189189 (6) The investigating law enforcement agency has
190190 utilized available local resources.
191191 (7) There is information available that, if
192192 disseminated to the public, could assist in the safe recovery
193193 of the missing person.
194194 Section 2. This act shall become effective on the first
195195 day of the third month following its passage and approval by
196196 the Governor, or its otherwise becoming law.
