1919 AN ACT
2020 Relating to Marion County; to create the Service of
2121 Process Fund; to provide for service of process; and to
2222 provide for the collection and dispensation of fees associated
2323 with service of process.
2424 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2525 Section 1. (a) The Marion County Service of Process
2626 Fund is created and referred to in this section as the fund.
2727 The county commission shall keep an account of all
2828 transactions associated with the fund for audit by the
2929 Department of Examiners of Public Accounts at the same time as
3030 the commission's other accounts are audited.
3131 (b) The Sheriff of Marion County may contract with a
3232 private, public, or governmental entity for the purpose of
3333 service of process for any document other than a warrant for
3434 arrest.
3535 (c)(1) In addition to all existing charges, fees,
3636 judgments, and costs of court, the clerk, sheriff, or other
3737 appropriate court official in the criminal division of the
3838 district and circuit courts of Marion County, shall collect a
3939 service of process fee of thirty dollars ($30) per document

7070 which shall be paid into the fund.
7171 (2) In addition to all existing charges, fees,
7272 judgments, and costs of court, the clerk, sheriff, or other
7373 appropriate court official in the civil division of the
7474 district and circuit courts of Marion County, shall collect a
7575 service of process fee of thirty dollars ($30) per document
7676 which shall be paid into the fund.
7777 (d) The Marion County Commission may use the monies
7878 generated by this section at its discretion for any lawful
7979 purpose.
8080 (e) The monies generated by this section shall not
8181 diminish or take the place of any other source of income for
8282 the county or any subdivision of the county.
8383 Section 2. This act shall become effective on October
8484 1, 2024.
