19	19	AN ACT
20	20	Relating to Marion County; to create the Service of
21	21	Process Fund; to provide for service of process; and to
22	22	provide for the collection and dispensation of fees associated
23	23	with service of process.
24	24	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
25	25	Section 1. (a) The Marion County Service of Process
26	26	Fund is created and referred to in this section as the fund.
27	27	The county commission shall keep an account of all
28	28	transactions associated with the fund for audit by the
29	29	Department of Examiners of Public Accounts at the same time as
30	30	the commission's other accounts are audited.
31	31	(b) The Sheriff of Marion County may contract with a
32	32	private, public, or governmental entity for the purpose of
33	33	service of process for any document other than a warrant for
34	34	arrest.
35	35	(c)(1) In addition to all existing charges, fees,
36	36	judgments, and costs of court, the clerk, sheriff, or other
37	37	appropriate court official in the criminal division of the
38	38	district and circuit courts of Marion County, shall collect a
39	39	service of process fee of thirty dollars ($30) per document

71	71	(2) In addition to all existing charges, fees,
72	72	judgments, and costs of court, the clerk, sheriff, or other
73	73	appropriate court official in the civil division of the
74	74	district and circuit courts of Marion County, shall collect a
75	75	service of process fee of thirty dollars ($30) per document
76	76	which shall be paid into the fund.
77	77	(d) The Marion County Commission may use the monies
78	78	generated by this section at its discretion for any lawful
79	79	purpose.
80	80	(e) The monies generated by this section shall not
81	81	diminish or take the place of any other source of income for
82	82	the county or any subdivision of the county.
83	83	Section 2. This act shall become effective on October
84	84	1, 2024.
