1515 SYNOPSIS:
1616 This bill requires appropriations totaling
1717 $475,470,075 from the Education Trust Fund to Tuskegee
1818 University in Tuskegee, Alabama beginning with the
1919 fiscal year ending September 30, 2025 and continuing
2020 into the fiscal year ending September 30, 2035 to
2121 compensate the university for the lack of match funding
2222 needed for federal formula funding made available to
2323 land-grant universities from 1987 through 2020.

3333 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3434 Section 1. Legislative Findings. (a) The United States
3535 land-grant university system, comprising the 1862
3636 Institutions, 1890 Institutions, and 1994 Institutions, is a

6666 Institutions, 1890 Institutions, and 1994 Institutions, is a
6767 federal-state partnership with a threefold mission of
6868 teaching, research, and extensions.
6969 (b) The Morrill Act of 1890, which led to the
7070 establishment of the 1890 Institutions as land-grant
7171 universities, required states choosing to open a second
7272 land-grant institution to serve African American students to
7373 provide an equitable distribution of funds between their 1862
7474 and 1890 land-grant institutions.
7575 (c) Tuskegee University, an 1890 land-grant university,
7676 was established as the Tuskegee Institute by an act of the
7777 Legislature in 1881 and separately incorporated by an act of
7878 the legislature in 1892. The university has received
7979 appropriations from the Legislature since 1881. While
8080 producing extraordinary graduates that contribute greatly to
8181 the state's economy, Tuskegee University has not been able to
8282 advance in ways that are on par with Alabama's 1862 land-grant
8383 university in large part due to unbalanced funding due to the
8484 disparities that have existed in the state matching of federal
8585 formula funding made available and longstanding and ongoing
8686 under-investments in infrastructure, research and development,
8787 and student supported services.
8888 Section 2. (a) It is the intent of the Legislature that
8989 Tuskegee University be made whole for the disparities that
9090 have existed in the state matching of federal formula funding
9191 made available to the university for 1890 land-grant
9292 universities.
9393 (b) There is hereby annually appropriated from the
9494 Education Trust Fund to Tuskegee University the following

128128 (3) For the fiscal year ending 2027 -- $47,547,008;
129129 (4) For the fiscal year ending 2028 -- $47,547,008;
130130 (5) For the fiscal year ending 2029 -- $47,547,008;
131131 (6) For the fiscal year ending 2030 -- $47,547,008;
132132 (7) For the fiscal year ending 2031 -- $47,547,008;
133133 (8) For the fiscal year ending 2032 -- $47,547,008;

137137 (c) The aggregate total of these appropriations
138138 represent the amount that Tuskegee University would have
139139 received, from 1987 to 2020, if the university's state funding
140140 per student were equal to that of the 1862 land-grant

142142 Section 3. This act shall become effective on October
143143 1, 2024.
