16	16	This bill requires appropriations totaling
17	17	$475,470,075 from the Education Trust Fund to Tuskegee
18	18	University in Tuskegee, Alabama beginning with the
19	19	fiscal year ending September 30, 2025 and continuing
20	20	into the fiscal year ending September 30, 2035 to
21	21	compensate the university for the lack of match funding
22	22	needed for federal formula funding made available to
23	23	land-grant universities from 1987 through 2020.

26	26	AN ACT
27	27	To require appropriations from the Education Trust Fund
28	28	to Tuskegee University beginning in the fiscal year ending
29	29	September 30, 2025 and continuing into the fiscal year ending
30	30	September 30, 2035 to compensate the university for the lack
31	31	of match funding needed for federal formula funding made
32	32	available to land-grant universities from 1987 through 2020.
33	33	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
34	34	Section 1. Legislative Findings. (a) The United States
35	35	land-grant university system, comprising the 1862
36	36	Institutions, 1890 Institutions, and 1994 Institutions, is a

66	66	Institutions, 1890 Institutions, and 1994 Institutions, is a
67	67	federal-state partnership with a threefold mission of
68	68	teaching, research, and extensions.
69	69	(b) The Morrill Act of 1890, which led to the
70	70	establishment of the 1890 Institutions as land-grant
71	71	universities, required states choosing to open a second
72	72	land-grant institution to serve African American students to
73	73	provide an equitable distribution of funds between their 1862
74	74	and 1890 land-grant institutions.
75	75	(c) Tuskegee University, an 1890 land-grant university,
76	76	was established as the Tuskegee Institute by an act of the
77	77	Legislature in 1881 and separately incorporated by an act of
78	78	the legislature in 1892. The university has received
79	79	appropriations from the Legislature since 1881. While
80	80	producing extraordinary graduates that contribute greatly to
81	81	the state's economy, Tuskegee University has not been able to
82	82	advance in ways that are on par with Alabama's 1862 land-grant
83	83	university in large part due to unbalanced funding due to the
84	84	disparities that have existed in the state matching of federal
85	85	formula funding made available and longstanding and ongoing
86	86	under-investments in infrastructure, research and development,
87	87	and student supported services.
88	88	Section 2. (a) It is the intent of the Legislature that
89	89	Tuskegee University be made whole for the disparities that
90	90	have existed in the state matching of federal formula funding
91	91	made available to the university for 1890 land-grant
92	92	universities.
93	93	(b) There is hereby annually appropriated from the
94	94	Education Trust Fund to Tuskegee University the following

137	137	(c) The aggregate total of these appropriations
138	138	represent the amount that Tuskegee University would have
139	139	received, from 1987 to 2020, if the university's state funding
140	140	per student were equal to that of the 1862 land-grant
141	141	institution.
142	142	Section 3. This act shall become effective on October
143	143	1, 2024.
