A BILL TO BE ENTITLED AN ACT To require appropriations from the Education Trust Fund to Tuskegee University beginning in the fiscal year ending September 30, 2025 and continuing into the fiscal year ending September 30, 2035 to compensate the university for the lack of match funding needed for federal formula funding made available to land-grant universities from 1987 through 2020. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. Legislative Findings. (a) The United States land-grant university system, comprising the 1862 Institutions, 1890 Institutions, and 1994 Institutions, is a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SB189 INTRODUCED Page 2 Institutions, 1890 Institutions, and 1994 Institutions, is a federal-state partnership with a threefold mission of teaching, research, and extensions. (b) The Morrill Act of 1890, which led to the establishment of the 1890 Institutions as land-grant universities, required states choosing to open a second land-grant institution to serve African American students to provide an equitable distribution of funds between their 1862 and 1890 land-grant institutions. (c) Tuskegee University, an 1890 land-grant university, was established as the Tuskegee Institute by an act of the Legislature in 1881 and separately incorporated by an act of the legislature in 1892. The university has received appropriations from the Legislature since 1881. While producing extraordinary graduates that contribute greatly to the state's economy, Tuskegee University has not been able to advance in ways that are on par with Alabama's 1862 land-grant university in large part due to unbalanced funding due to the disparities that have existed in the state matching of federal formula funding made available and longstanding and ongoing under-investments in infrastructure, research and development, and student supported services. Section 2. (a) It is the intent of the Legislature that Tuskegee University be made whole for the disparities that have existed in the state matching of federal formula funding made available to the university for 1890 land-grant universities. (b) There is hereby annually appropriated from the Education Trust Fund to Tuskegee University the following 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 SB189 INTRODUCED Page 3 Education Trust Fund to Tuskegee University the following amounts in the following fiscal years: (1) For the fiscal year ending 2025 -- $47,547,008; (2) For the fiscal year ending 2026 -- $47,547,008; (3) For the fiscal year ending 2027 -- $47,547,008; (4) For the fiscal year ending 2028 -- $47,547,008; (5) For the fiscal year ending 2029 -- $47,547,008; (6) For the fiscal year ending 2030 -- $47,547,008; (7) For the fiscal year ending 2031 -- $47,547,008; (8) For the fiscal year ending 2032 -- $47,547,008; (9) For the fiscal year ending 2033 -- $47,547,008; (10) For the fiscal year ending 2034 -- $47,547,008; (11) For the fiscal year ending 2035 -- $47,547,008; (c) The aggregate total of these appropriations represent the amount that Tuskegee University would have received, from 1987 to 2020, if the university's state funding per student were equal to that of the 1862 land-grant institution.
