17+AN ACT
1618 Relating to Etowah County; to further provide for
1719 service of process; and to provide for the collection and
1820 dispensation of fees associated with service of process.
1921 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2022 Section 1. (a) The Sheriff of Etowah County may
2123 contract with a private, public, or governmental entity for
2224 the purpose of service of process for any document other than
2325 a warrant for arrest.
2426 (b) In addition to all existing charges, fees,
2527 judgments, and costs of court, the clerk, sheriff, or other
2628 appropriate court official in district and circuit courts of
2729 Etowah County shall collect a service of process fee of thirty
2830 five dollars ($35) per case for each party requiring personal
2931 service of process by the sheriff which shall be paid into the
3032 Sheriff's Law Enforcement Fund.
3133 (c) The Sheriff of Etowah County may use the monies
3234 generated by this section at his or her discretion for any
3335 lawful purpose.
3436 (d) The monies generated by this section shall not
3537 diminish or take the place of any other source of income for
36-the sheriff.
37-(e) The district attorney and grand juries shall be
38-exempt from payment of the fees provided in this section.
39-Section 2. This act shall become effective December 1,
40-2024, contingent upon the ratification of the amendment to the
41-Constitution of Alabama of 2022, authorizing the Legislature

71+Section 2. This act shall become effective December 1,
72+2024, contingent upon the ratification of the amendment to the

7274 to fix and regulate court costs in Etowah County by general or
7375 local law, and ratifying all previously collected court costs
7476 in Etowah County, as proposed in SB____ of the 2024 Regular
