16 | 18 | Relating to Etowah County; to further provide for | |
17 | 19 | service of process; and to provide for the collection and | |
18 | 20 | dispensation of fees associated with service of process. | |
19 | 21 | BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: | |
20 | 22 | Section 1. (a) The Sheriff of Etowah County may | |
21 | 23 | contract with a private, public, or governmental entity for | |
22 | 24 | the purpose of service of process for any document other than | |
23 | 25 | a warrant for arrest. | |
24 | 26 | (b) In addition to all existing charges, fees, | |
25 | 27 | judgments, and costs of court, the clerk, sheriff, or other | |
26 | 28 | appropriate court official in district and circuit courts of | |
27 | 29 | Etowah County shall collect a service of process fee of thirty | |
28 | 30 | five dollars ($35) per case for each party requiring personal | |
29 | 31 | service of process by the sheriff which shall be paid into the | |
30 | 32 | Sheriff's Law Enforcement Fund. | |
31 | 33 | (c) The Sheriff of Etowah County may use the monies | |
32 | 34 | generated by this section at his or her discretion for any | |
33 | 35 | lawful purpose. | |
34 | 36 | (d) The monies generated by this section shall not | |
35 | 37 | diminish or take the place of any other source of income for | |
36 | - | the sheriff. | |
37 | - | (e) The district attorney and grand juries shall be | |
38 | - | exempt from payment of the fees provided in this section. | |
39 | - | Section 2. This act shall become effective December 1, | |
40 | - | 2024, contingent upon the ratification of the amendment to the | |
41 | - | Constitution of Alabama of 2022, authorizing the Legislature | |
