Enrolled, An Act,
Relating to Etowah County; to further provide for
service of process; and to provide for the collection and
dispensation of fees associated with service of process.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. (a) The Sheriff of Etowah County may
contract with a private, public, or governmental entity for
the purpose of service of process for any document other than
a warrant for arrest.
(b) In addition to all existing charges, fees,
judgments, and costs of court, the clerk, sheriff, or other
appropriate court official in district and circuit courts of
Etowah County shall collect a service of process fee of thirty
five dollars ($35) per case for each party requiring personal
service of process by the sheriff which shall be paid into the
Sheriff's Law Enforcement Fund.
(c) The Sheriff of Etowah County may use the monies
generated by this section at his or her discretion for any
lawful purpose.
(d) The monies generated by this section shall not
diminish or take the place of any other source of income for
the sheriff.
(e) The district attorney and grand juries shall be
exempt from payment of the fees provided in this section.
Section 2. This act shall become effective December 1,
2024, contingent upon the ratification of the amendment to the
Constitution of Alabama of 2022, authorizing the Legislature

Constitution of Alabama of 2022, authorizing the Legislature
to fix and regulate court costs in Etowah County by general or
local law, and ratifying all previously collected court costs
in Etowah County, as proposed in SB____ of the 2024 Regular
Session.
