1515 SYNOPSIS:
1616 Under existing law, the Alabama Medical Cannabis
1717 Commission is responsible for the regulation,
1818 licensure, and enforcement of all aspects of the
1919 processing and dispensing of medical cannabis, while
2020 the Alabama Department of Agriculture and Industries
2121 shares responsibility with the commission for the
2222 regulation and enforcement of the cultivation of
2323 cannabis to be used for medical cannabis products.
2424 This bill would provide that the regulation,
2525 licensure, and enforcement functions relating to the
2626 cultivation of cannabis are duties of the Alabama
2727 Medical Cannabis Commission and would require the
2828 Alabama Department of Agriculture and Industries to
2929 cooperate with the commission in carrying out these
3030 functions.
3131 Under existing law, the Alabama Medical Cannabis
3232 Commission may issue five integrated facility licenses,
3333 which allows for cultivation, processing, and
3434 dispensing of medical cannabis.
3535 This bill would specify a three-step process for
3636 the awarding of integrated facility licences. The first
3737 step would require a panel appointed by the Alabama
3838 Securities Commission to determine if license
3939 applicants meet certain basic eligibility requirements

6969 applicants meet certain basic eligibility requirements
7070 for licensure. The second step would require the review
7171 panel to determine the readiness of the cultivation and
7272 dispensing operations if a license was to be awarded.
7373 The third step would require the Alabama Medical
7474 Cannabis Commission members to score the pool of
7575 remaining eligible applicants on a number of criteria
7676 to ultimately determine the awarding of the licenses.
7777 This bill would also provide greater specificity
7878 to the eligibility requirements for integrated license
7979 facility licensure.
8080 Under existing law, a medical cannabis license
8181 may be transferred in certain circumstances.
8282 This bill would prohibit the transfer of an
8383 integrated facility license.

8787 Relating to medical cannabis; to amend Sections

9090 provide that the Alabama Medical Cannabis Commission is

125125 Code of Alabama 1975, to provide for a three-step process in
126126 the awarding of integrated facility licenses and provide
127127 greater specificity in the procedure and in the eligibility
128128 requirements for licensure.
129129 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
130130 Section 1. It is the intent of this act to:
131131 (1) Ensure that the process for selecting integrated
132132 facility licenses adheres to the original intent of Act
133133 2021-450, now codified as Chapter 2A of Title 20, Code of
134134 Alabama 1975;
135135 (2) Account for every individual and entity who may
136136 benefit financially from an integrated facility license; and
137137 (3) Provide full transparency to the integrated
138138 facility license selection process.
139139 Section 2. Sections 20-2A-3, 20-2A-50, 20-2A-51,
140140 20-2A-52, 20-2A-53, 20-2A-57, 20-2A-58, 20-2A-59, 20-2A-62,
141141 20-2A-63, and 20-2A-67, Code of Alabama 1975, are amended to
142142 read as follows:

144144 As used in this chapter, the following terms have the
145145 following meanings:
146146 (1) APPLICANT. The entity or individual seeking a
147147 license under Article 4.
148148 (2) BOARD. The State Board of Medical Examiners.
149149 (3) CANNABIS. a. Except as provided in paragraph b.,
150150 all parts of any plant of the genus cannabis, whether growing
151151 or not, including the seeds, extractions of any kind from any
152152 part of the plant, and every compound, derivative, mixture,

184184 b. The term does not include industrial hemp or hemp
185185 regulated under Article 11 of Chapter 8 of Title 2.
186186 (4) COMMISSION. The Alabama Medical Cannabis Commission
187187 created pursuant to Section 20-2A-20.
188188 (5) CULTIVATOR. An entity licensed by the Department of
189189 Agriculture and Industries commission under Section 20-2A-62
190190 authorized to grow cannabis pursuant to Article 4.
191191 (6) DAILY DOSAGE. The total amount of one or more
192192 cannabis derivatives, including, but not limited to,
193193 cannabidiol and tetrahydrocannabinol, which may be present in
194194 a medical cannabis product that may be ingested by a
195195 registered qualified patient during a 24-hour period, as
196196 determined by a registered certifying physician.
197197 (7) DEPARTMENT. The Department of Agriculture and
198198 Industries.
199199 (8) DISPENSARY. An entity licensed by the commission
200200 under Section 20-2A-64 authorized to dispense and sell medical
201201 cannabis at dispensing sites to registered qualified patients
202202 and registered caregivers pursuant to Article 4.
203203 (9) DISPENSING SITE. A site operated by a dispensary
204204 licensee or an integrated facility licensee pursuant to
205205 Article 4.
206206 (10) ECONOMIC INTEREST. The rights to either the
207207 capital or profit interests of an applicant or licensee or, if
208208 the applicant or licensee is a corporation, the rights to some
209209 portion of all classes of outstanding stock in the
210210 corporation.

241241 (11) FACILITY or MEDICAL CANNABIS FACILITY. Any
242242 facility, or land associated with a facility, of a licensee.
243243 (12) INTEGRATED FACILITY. An entity licensed under
244244 Section 20-2A-67 authorized to perform the functions of a
245245 cultivator, processor, secure transporter, and dispensary
246246 pursuant to Article 4.
247247 (13) LICENSEE. A cultivator, processor, secure
248248 transporter, state testing laboratory, dispensary, or
249249 integrated facility licensed by the commission under Article
250250 4.
251251 (14) MEDICAL CANNABIS. a. A medical grade product in
252252 the form of any of the following, as determined by rule by the
253253 commission, that contains a derivative of cannabis for medical
254254 use by a registered qualified patient pursuant to this
255255 chapter:
256256 1. Oral tablet, capsule, or tincture.
257257 2. Non-sugarcoated gelatinous cube, gelatinous
258258 rectangular cuboid, or lozenge in a cube or rectangular cuboid
259259 shape.
260260 3. Gel, oil, cream, or other topical preparation.
261261 4. Suppository.
262262 5. Transdermal patch.
263263 6. Nebulizer.
264264 7. Liquid or oil for administration using an inhaler.
265265 b. The term does not include any of the following:
266266 1. Raw plant material.
267267 2. Any product administered by smoking, combustion, or
268268 vaping.

299299 3. A food product that has medical cannabis baked,
300300 mixed, or otherwise infused into the product, such as cookies
301301 or candies.
302302 (15) MEDICAL CANNABIS CARD. A valid card issued
303303 pursuant to Section 20-2A-36.
304304 (16) MEDICAL USE or USE OF MEDICAL CANNABIS or USE
305305 MEDICAL CANNABIS. The acquisition, possession, use, delivery,
306306 transfer, or administration of medical cannabis authorized by
307307 this chapter. The term does not include possession, use, or
308308 administration of cannabis that was not purchased or acquired
309309 from a licensed dispensary.
310310 (17) PACKAGE. Any container that a processor may use
311311 for enclosing and containing medical cannabis. The term does
312312 not include any carry-out bag or other similar container.
313313 (18) PATIENT REGISTRY. The Alabama Medical Cannabis
314314 Patient Registry System that is an electronic integrated
315315 system that tracks physician certifications, patient
316316 registrations, medical cannabis cards, the daily dosage and
317317 type of medical cannabis recommended to qualified patients by
318318 registered certifying physicians, and the dates of sale,
319319 amounts, and types of medical cannabis that were purchased by
320320 registered qualified patients at licensed dispensaries.
321321 (19) PHYSICIAN CERTIFICATION. A registered certifying
322322 physician's authorization for a registered qualified patient
323323 to use medical cannabis.
324324 (20) PROCESSOR. An entity licensed by the commission
325325 under Section 20-2A-63 authorized to purchase cannabis from a
326326 cultivator and extract derivatives from the cannabis to

356356 cultivator and extract derivatives from the cannabis to
357357 produce a medical cannabis product or products for sale and
358358 transfer in packaged and labeled form to a dispensing site
359359 pursuant to Article 4.
360360 (21) QUALIFYING MEDICAL CONDITION. Any of the following
361361 conditions or symptoms of conditions, but only after
362362 documentation indicates that conventional medical treatment or
363363 therapy has failed unless current medical treatment indicates
364364 that use of medical cannabis is the standard of care:
365365 a. Autism Spectrum Disorder (ASD).
366366 b. Cancer-related cachexia, nausea or vomiting, weight
367367 loss, or chronic pain.
368368 c. Crohn's Disease.
369369 d. Depression.
370370 e. Epilepsy or a condition causing seizures.
371371 f. HIV/AIDS-related nausea or weight loss.
372372 g. Panic disorder.
373373 h. Parkinson's disease.
374374 i. Persistent nausea that is not significantly
375375 responsive to traditional treatment, except for nausea related
376376 to pregnancy, cannabis-induced cyclical vomiting syndrome, or
377377 cannabinoid hyperemesis syndrome.
378378 j. Post Traumatic Stress Disorder (PTSD).
379379 k. Sickle Cell Anemia.
380380 l. Spasticity associated with a motor neuron disease,
381381 including Amyotrophic Lateral Sclerosis.
382382 m. Spasticity associated with Multiple Sclerosis or a
383383 spinal cord injury.
384384 n. A terminal illness.

415415 o. Tourette's Syndrome.
416416 p. A condition causing chronic or intractable pain in
417417 which conventional therapeutic intervention and opiate therapy
418418 is contraindicated or has proved ineffective.
419419 (22) REGISTERED CAREGIVER. An individual who meets the
420420 requirements described in subsection (c) of Section 20-2A-30
421421 and is authorized to acquire and possess medical cannabis and
422422 to assist one or more registered qualified patients with the
423423 use of medical cannabis pursuant to this chapter.
424424 (23) REGISTERED CERTIFYING PHYSICIAN. A physician
425425 authorized by the State Board of Medical Examiners to certify
426426 patients for the use of medical cannabis under this chapter.
427427 (24) REGISTERED QUALIFIED PATIENT. Either of the
428428 following:
429429 a. An adult who meets the requirements described in
430430 subsection (a) of Section 20-2A-30 and is authorized to
431431 acquire, possess, and use medical cannabis pursuant to this
432432 chapter.
433433 b. A minor who meets the requirements described in
434434 subsection (b) of Section 20-2A-30 and is authorized to use
435435 medical cannabis pursuant to this chapter with the assistance
436436 of a registered caregiver.
437437 (25) SECURE TRANSPORTER. An entity licensed by the
438438 commission under Section 20-2A-65 authorized to transport
439439 cannabis or medical cannabis from one licensed facility or
440440 site to another licensed facility or site.
441441 (26) STATE TESTING LABORATORY. An entity licensed under
442442 Section 20-2A-66 authorized to test cannabis and medical

475475 (27) STATEWIDE SEED-TO-SALE TRACKING SYSTEM. The
476476 tracking system established pursuant to Section 20-2A-54 that
477477 tracks all cannabis and medical cannabis in the state.
478478 (28) UNIVERSAL STATE SYMBOL. The image established by
479479 the commission pursuant to Section 20-2A-53 made available to
480480 processors which indicates the package contains medical
481481 cannabis."

483483 (a) The state hereby preemptively regulates medical
484484 cannabis from seed to sale seed-to-sale and shall reasonably
485485 regulate and control all aspects of the medical cannabis
486486 industry to meet the intent of this chapter. All functions and
487487 activities relating to the production of medical cannabis in
488488 the state shall be licensed, and licenses shall be granted to
489489 integrated facilities, as well as to independent entities in
490490 the following categories: Cultivator, processor, dispensary,
491491 secure transporter, and testing laboratory.
492492 (b) The commission shall license ,and regulate, and
493493 enforce all aspects of medical cannabis under this article ,
494494 excluding cultivation . The Department of Agriculture and
495495 Industries shall license and regulate the cultivation of
496496 cannabis. For integrated facility licenses, the commission and
497497 the department shall enter into a memorandum of understanding
498498 relating to the sharing of regulatory and licensing and
499499 enforcement authority over licensees with regard to the
500500 cultivation function The commission may seek and shall receive

531531 the cooperation of the Department of Agriculture and
532532 Industries in the regulation and enforcement of this article.
533533 The department may recover from the commission the
534534 department's costs of cooperation ."

536536 (a) Where the commission is authorized under this
537537 article to determine the number of licenses of a specific
538538 license category the commission will grant, or increase the
539539 number of licenses of a specific license category to grant,
540540 the commission shall consider the population of the state, the
541541 number of active registered qualified patients, market demand,
542542 the unemployment rate, the need for agricultural and other
543543 business opportunities in communities, access to health care,
544544 infrastructure, and other factors the commission deems
545545 relevant in providing the greatest benefits to the residents
546546 of this state and taking into account the racial and economic
547547 makeup of the state.
548548 (b) The commission , and where applicable the
549549 department, shall ensure that at least one-fourth of all
550550 licenses, or in the case of Section 20-2A-67, one-fifth of all
551551 licenses, to the extent there is an applicant or applicants
552552 that are qualified under Section 20-2A-67, are awarded to
553553 business entities at least 51 percent of which are owned by
554554 members of a minority group or, in the case of a corporation,
555555 at least 51 percent of the shares of the corporation are owned
556556 by members of a minority group, and are managed and controlled
557557 by members of a minority group in its daily operations. For
558558 purposes of this subsection, "minority group" means

588588 purposes of this subsection, "minority group" means
589589 individuals of African American, Native American, Asian, or
590590 Hispanic descent.
591591 (c)(1) Notwithstanding any other provision of this
592592 chapter to the contrary, the commission shall not permit a
593593 dispensary to operate a dispensing site in any municipality or
594594 unincorporated area of a county unless the municipality or
595595 county has authorized the operation of dispensing sites within
596596 its boundaries, as provided in subdivision (2).
597597 (2) Any county commission, by resolution, may authorize
598598 the operation of dispensing sites in the unincorporated areas
599599 of the county, and the governing body of any municipality, by
600600 ordinance, may authorize the operation of dispensing sites
601601 within the corporate limits of the municipality. The county
602602 commission or municipal governing body shall notify the
603603 commission not more than seven calendar days after adopting
604604 the resolution or ordinance.
605605 (3) This subsection does not prohibit a municipality
606606 from adopting zoning ordinances restricting the operation of
607607 dispensing sites within its corporate limits."

609609 (a) The commission , and the department with regard to
610610 cultivation facilities, shall have all powers necessary and
611611 proper to fully and effectively oversee the operation of
612612 medical cannabis facilities licensed pursuant to this article,
613613 including the authority to do all of the following:
614614 (1) Investigate applicants for licenses, determine the
615615 eligibility for licenses, and grant licenses to applicants in
616616 accordance with this article and the rules.

646646 accordance with this article and the rules.
647647 (2) Investigate all individuals employed by licensees.
648648 (3) At any time, through its investigators, agents, or
649649 auditors, without a warrant and without notice to the
650650 licensee, enter the premises, offices, facilities, or other
651651 places of business of a licensee, if evidence of compliance or
652652 noncompliance with this article or rules is likely to be found
653653 and consistent with constitutional limitations, for the
654654 following purposes:
655655 a. To inspect and examine all premises of licensees.
656656 b. To inspect and examine relevant records of the
657657 licensee and, if the licensee fails to cooperate with an
658658 investigation, impound, seize, assume physical control of, or
659659 summarily remove from the premises all books, ledgers,
660660 documents, writings, photocopies, correspondence, records, and
661661 videotapes, including electronically stored records, money
662662 receptacles, or equipment in which the records are stored.
663663 c. To inspect the person , and inspect or examine
664664 personal effects of an individual who holds a license, while
665665 that individual is present in a medical cannabis facility of
666666 the licensee.
667667 d. To investigate alleged violations of this article.
668668 (4) Investigate alleged violations of this article or
669669 rules and take appropriate disciplinary action against a
670670 licensee.
671671 (5) Require all relevant records of licensees,
672672 including financial or other statements, to be kept on the
673673 premises authorized for operation of the licensee or in the
674674 manner prescribed by the commission.

705705 (6) Eject, or exclude or authorize the ejection or
706706 exclusion of, an individual from the premises of a licensee if
707707 the individual violates this article, rules, or final orders
708708 of the commission; provided, however, the propriety of the
709709 ejection or exclusion is subject to a subsequent hearing by
710710 the commission.
711711 (7) Conduct periodic audits of licensees.
712712 (8) Take disciplinary action as the commission
713713 considers appropriate to prevent practices that violate this
714714 article and rules.
715715 (9) Take any other reasonable or appropriate action to
716716 enforce this article and rules.
717717 (b) The commission and department shall adopt rules
718718 addressing the frequency of conducting periodic inspections
719719 and audits of respective licensees.
720720 (c) The commission may enter into one or more memoranda
721721 of understanding with law enforcement agencies to assist with
722722 enforcement of this article.
723723 (d) The commission and department may seek and shall
724724 receive the cooperation and assistance of the Alabama State
725725 Law Enforcement Agency in conducting criminal background
726726 checks and in fulfilling its responsibilities under this
727727 article. The Alabama State Law Enforcement Agency may recover
728728 its costs of cooperation under this article.
729729 (e) The commission and department shall assist any
730730 prosecuting agency in the investigation or prosecution of a
731731 violation of a controlled substances law.
732732 (f) Nothing in this article shall affect the authority

762762 (f) Nothing in this article shall affect the authority
763763 of the Alabama Department of Environmental Management to
764764 administer and enforce any existing law over which the Alabama
765765 Department of Environmental Management has jurisdiction."

767767 (a) The commission , and the department with regard to
768768 cultivation, shall adopt rules as necessary to implement,
769769 administer, and enforce this article in a timely manner that
770770 allows persons to begin applying for a license by September 1,
771771 2022. Rules must ensure safety, security, and integrity of the
772772 operation of medical cannabis facilities , that do all of the
773773 following for each category of license:
774774 (1) Establish operating standards to ensure the health,
775775 safety, and security of the public and the integrity of
776776 medical cannabis facility operations.
777777 (2) Require a minimum of two million dollars
778778 ($2,000,000) of liability and casualty insurance and establish
779779 minimum levels of other financial guarantees, if appropriate,
780780 that licensees must maintain.
781781 (3) Establish qualifications and restrictions for
782782 individuals participating in or involved with operating
783783 medical cannabis facilities.

902902 charging, or prosecution of an individual for any other
903903 violation of this article and is not grounds to suppress
904904 evidence in any criminal prosecution that arises under this
905905 article or any other law of this state.

936936 (c) The commission shall comply with the hearing
937937 procedures of the Administrative Procedure Act when denying,
938938 revoking, suspending, or restricting a license or imposing a
939939 fine. The commission may suspend a license without notice or
940940 hearing upon a determination that the safety or health of
941941 registered qualified patients, registered caregivers, or
942942 employees is jeopardized by continuing a facility's operation.
943943 If the commission suspends a license under this subsection
944944 without notice or hearing, a prompt post-suspension hearing
945945 must be held to determine if the suspension should remain in
946946 effect. The suspension may remain in effect until the
947947 commission determines that the cause for suspension has been
948948 abated. The commission may revoke the license or approve a
949949 transfer or sale of the license upon a determination that the
950950 licensee has not made satisfactory progress toward abating the
951951 hazard.
952952 (d) Any party aggrieved by an action of the commission
953953 suspending, revoking, restricting, or refusing to renew a
954954 license, or imposing a fine, shall be given a hearing before
955955 the commission upon request. A request for a hearing must be
956956 made to the commission in writing within 21 days after service
957957 of notice of the action of the commission. Notice of the
958958 action of the commission must be served either by personal
959959 delivery or by certified mail, postage prepaid, to the
960960 aggrieved party. Notice served by certified mail is considered
961961 complete on the business day following the date of the
962962 mailing.
963963 (e) The commission may conduct investigative and
964964 contested case hearings; issue subpoenas for the attendance of

10681068 Notwithstanding any state law to the contrary, all records

10721072 (b) If the criminal background check of a prospective
10731073 officer, employee, or contractor indicates a pending charge or
10741074 conviction within the past five years for a controlled
10751075 substance-related felony or a controlled substance-related
10761076 misdemeanor, a licensee may not appoint, hire, or contract
10771077 with the prospective officer, employee, or contractor without
10781078 written permission of the commission; provided, however, a
10791079 licensee shall not consider any conviction overturned on

11841184 the past 10 years for a controlled substance-related felony or

11861186 conviction that was overturned on appeal or a charge that was

11881188 (4) Cultivatars Cultivars selected by a licensee must
11891189 be approved by the department commission prior to acquisition

12901290 (2) Any product bearing a reasonable resemblance to a
12911291 product available for consumption as a commercially available
12921292 candy.
12931293 (3) Any product whose design resembles, by any means,
12941294 another object commonly recognized as appealing to, or
12951295 intended for use by, children.
12961296 (4) Any product whose shape bears the likeness or
12971297 contains characteristics of a realistic or fictional human,

13001300 (e) All of the following shall apply to all packages

13021302 (1) Labels, packages, and containers shall not be
13031303 attractive to minors and may not contain any content that
13041304 reasonably appears to target children, including toys, cartoon
13051305 characters, and similar images. Packages shall be designed to
13061306 minimize appeal to children and must contain a label that

13641364 (i) The commission may require the implementation of a

14611461 participating applicant, as described in subdivision (1). The
14621462 commission shall only redact and keep confidential criminal
14631463 background check, Social Security numbers, financial account
14641464 numbers, and dates of birth, if applicable. The commission
14651465 shall immediately include any additional information requested
14661466 by the review panel in the respective application published on
14671467 the commission's website.
14681468 (3) No later than July 15, 2024, the Director of the
14691469 Alabama Securities Commission shall convene a review panel of
14701470 five individuals to make a determination of whether the
14711471 applicants meet the basic eligibility requirements described
14721472 in this subsection. The Alabama Medical Cannabis Commission
14731473 shall ensure the panel has sufficient resources to carry out
14741474 this duty. As expeditiously as possible, the review panel
14751475 shall determine, on an objective, pass or fail basis, if the
14761476 applicant has included all of the following information:
14771477 a. Residency requirements, as required under Section
14781478 20-2A-55(a)(10), it being the intent that the requirement set
14791479 forth in that section apply to the applicant's beneficial and
14801480 not legal ownership of the applicant.
14811481 b. Agriculture experience requirements, as required

15321532 for an integrated license. Details shall include the nature of
15331533 any business both within and outside the state, relating to
15341534 the cannabis industry, whether medical or recreational, and
15351535 investments in any business that aligns itself as a vendor,
15361536 service, or maker of a product used in the cannabis industry,
15371537 including companies that are financial or insurance related.
15381538 f. Proof that the applicant is in compliance with all
15391539 tax filings and other obligations required in each state where
15401540 the applicant does business.
15411541 g. Completion of a detailed business plan that includes
15421542 plans for employment and biographical information about the

15811581 (4) The applicant carries the burden to disclose the
15821582 information upon which the review panel will make its
15831583 determination and shall immediately provide any additional
15841584 information requested by the review panel. The review panel
15851585 shall maintain a record of all communications with an
15861586 applicant. Upon conclusion of making its determination, the
15871587 review panel shall present the results of the determination,
15881588 along with the record of all communications and its findings,
15891589 to the commission.
15901590 (5) Once the review panel makes a final determination
15911591 that an applicant meets the basic eligibility requirements in
15921592 subdivisions (3) and (4), the review panel shall determine if
15931593 each applicant can demonstrate that the applicant will be able
15941594 to meet all of the following criteria for readiness of the
15951595 cultivation and dispensing operations of an applicant:
15961596 a. Within 60 days after the awarding of a license, the
15971597 applicant's business has built and possesses an enclosed
15981598 cultivation facility that meets all of the following:
15991599 1. The structure must be built in accordance with the
16001600 plans for the structure submitted with the application.
16011601 2. All cannabis must be cultivated using artificial
16021602 light exclusively or as a supplement to natural sunlight.

16331633 3. The enclosed structure must meet security
16341634 requirements of this chapter and rules adopted thereunder.
16351635 4. The enclosed structure may be a greenhouse, pod, or
16361636 similar structure that protects plants from variable
16371637 temperature, precipitation, wind, and other elements.
16381638 5. Each cannabis plant or batch of cannabis plants must
16391639 be cultivated in an individual receptacle containing soil or
16401640 growing media, so as to foster portability, limit
16411641 cross-contamination, and facilitate proper monitoring of each
16421642 plant.
16431643 6. Containers may be for individual plants or for
16441644 batches of plants as long as each plant is clearly identified
16451645 and traceable.
16461646 7. No cultivation is allowed outdoors or directly in
16471647 the ground.
16481648 b. The applicant's business possesses a minimum of five
16491649 dispensing sites that can be opened to the public within six
16501650 months after the awarding of a license. The commission shall
16511651 inspect these sites to determine whether they meet all the
16521652 criteria under Section 20-2A-64 for dispensaries and are
16531653 capable of being built and operational within the six-month
16541654 period.
16551655 (c)(d) An integrated facility licensee shall have the
16561656 same authorizations granted to, and shall comply with all
16571657 requirements for, cultivators, processors, secure
16581658 transporters, and dispensaries, in addition to any other
16591659 authorizations or requirements under this section or as
16601660 established by rule by the commission.

16911691 (d)(e)(1) An applicant Once the Alabama Securities
16921692 Commission review panel determines an applicant has met all of
16931693 the preliminary requirements set forth in subsection (b), the
16941694 Alabama Medical Cannabis Commission shall score the remaining
16951695 pool of applicants for an integrated facility license shall
16961696 provide, as further provided in subdivision (3), based on all
16971697 of the following criteria provided by the eligible applicants :
16981698 a. A long-term plan for serving the residents of
16991699 Alabama by securely providing quality medical cannabis
17001700 products to registered qualified patients.
17011701 (1)b. A letter of commitment or other acknowledgement,
17021702 as determined by commission rule, of the applicant's ability
17031703 to secure a performance bond issued by a surety insurance
17041704 company payable to the State of Alabama approved by the
17051705 commission in the amount of two million dollars ($2,000,000)
17061706 or proof that such a bond will be obtainable once an applicant
17071707 is licensed.
17081708 (2)c. Proof of at least two hundred fifty thousand
17091709 dollars ($250,000) in liquid assets.
17101710 (3)d. Proof that the applicant has the financial
17111711 ability liquid funds necessary to maintain operations for not
17121712 less than two years following the date of application by the
17131713 presentation of a business plan showing the total estimate for
17141714 all expenses, including, but not limited to, expenses for
17151715 rent, mortgages, maintenance, security, and insurance;
17161716 operation expenses for cultivation and processing facilities;
17171717 operation expenses for dispensing sites; and expenses for
17181718 salaries, benefits, and taxes. Funds equal to or in excess of

17481748 salaries, benefits, and taxes. Funds equal to or in excess of
17491749 the total funds necessary for all of these expenses must be on
17501750 deposit in the accounts of the applicant's business. These
17511751 deposits must be verified by a sworn statement from an
17521752 accounting firm that has been allowed access to the business'
17531753 bank accounts to verify deposits and the balance in the
17541754 accounts. An applicant's business that has a sworn statement
17551755 from an accounting firm that verifies the business has a
17561756 minimum of four million dollars ($4,000,000) on deposit in its
17571757 bank accounts shall be deemed to have the liquid funds
17581758 necessary to maintain operations for not less than two years
17591759 without further proof regarding its expenses. The funds on
17601760 deposit in the applicant's bank accounts do not qualify as
17611761 liquid funds necessary to maintain operations for two years if
17621762 any of the funds were borrowed by any owner of the business or
17631763 from any third party, were pledged as security for any
17641764 obligation, or are subject to repayment to another person
17651765 under any obligation or understanding among the parties .
17661766 (2) The applicant shall be required to certify under
17671767 oath to the commission that the applicant's business: (i)
17681768 meets the requirements for the ownership and operation of an
17691769 integrated facility license under this act; (ii) meets the
17701770 requirements for a performance bond, minimum paid-in capital
17711771 or cash investment; (iii) has the funds necessary to sustain
17721772 operations for a minimum of two years; and (iv) is in
17731773 compliance with the rules of the commission.
17741774 (3) For each applicant, each commission member shall
17751775 assign a numeric score for each of the criteria enumerated in
17761776 subdivision (1) after review and inspection, as appropriate.

18071807 The commission shall drop the highest and lowest numeric score
18081808 assigned by each member and thereafter, the commission shall
18091809 add the numeric scores assigned by each commission member to
18101810 calculate a total score for the applicant. Licenses shall be
18111811 awarded to the five applicants that receive the highest
18121812 cumulative score.
18131813 (e)(f) At the time a license is issued under this
18141814 section, the commission shall ensure that the licensee has
18151815 secured a performance bond as provided in subdivision (1) of
18161816 subsection (d) paragraph (e)(1)b .
18171817 (f)(g) A licensee may open and operate up to five
18181818 dispensing sites within six months after the date a license is
18191819 issued., each of which Each of the dispensing sites must be
18201820 located in a different county from any other dispensing site
18211821 that the licensee operates; provided, however, the commission
18221822 may authorize a licensee to operate a greater number of
18231823 dispensing sites if, at least one year after the date when the
18241824 maximum number of total dispensing sites authorized under this
18251825 section and Section 20-2A-64 are operating, the commission
18261826 determines that the patient pool has reached a sufficient
18271827 level to justify an additional dispensing site in an
18281828 underserved or unserved area of the state. Notwithstanding the
18291829 foregoing, a licensee may not operate any dispensing site in
18301830 the unincorporated area of a county or in a municipality that
18311831 has not adopted a resolution or ordinance authorizing the
18321832 operation of dispensing sites under subsection (c) of Section
18331833 20-2A-51(c). This subsection shall not be construed to limit
