2525 AN ACT
2626 Relating to public preK-12 education; to require the
2727 posting of classroom curricula on the website of the school;
2828 to permit parents or guardians of enrolled students, upon
2929 request, to request information on instructional and
3030 supplemental materials used in the classroom; to provide a
3131 complaint process; and to provide for the reporting of the
3232 number of complaints to the State Superintendent of Education
3333 and the Legislature.
3434 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3535 Section 1. (a) At the beginning of each school year,
3636 and no later than 30 calendar days after a new or revised
3737 curriculum is adopted, the local superintendent of education
3838 and local board of education shall verify that each school
3939 under the jurisdiction of the board has posted current adopted
4040 curricula for each class on the website of the school. Access
4141 to the online curricula shall be made available to students,
4242 parents, or guardians of enrolled students through the school
4343 website. If a school has no accessible website, the curricula
4444 shall be posted on the website of the local board of education
4545 or the State Department of Education.

7676 (b) Each classroom teacher shall comply with the
77-request of any parent or guardian by providing a detailed
78-summary, by email, telephone, or other electronic means, of
79-instructional materials adopted by the local board of
80-education, supplementary instructional materials in the

8484 (1) Only the parent or guardian of a child enrolled in
8585 the class may make a request pursuant to this subsection.
8686 (2) If a parent or guardian would like further
8787 information regarding how the instructional materials relate
8888 to the content standards adopted by the State Board of
8989 Education or to physically examine any instructional materials
9090 used in the classroom, the parent or guardian may request that
9191 the local board of educational allow that examination at the
9292 next work session of the board. The board shall notify the
9393 parent or guardian and the teacher of the issues involved and
9494 the date and time of the next work session.
9595 (c) For any class in which reading books is required,
9696 the classroom teacher shall include the titles of the books on
9797 a class syllabus. Upon the request of the parent or guardian
9898 of a child enrolled in the class, the classroom teacher shall
9999 make the syllabus available to the parent or guardian.
100100 (d) If a classroom teacher fails to comply with this
101101 section, the parent or guardian may file a complaint with the
102102 local superintendent of education on a form developed and
103103 provided by the local superintendent of education. If the

133133 provided by the local superintendent of education. If the
134134 complaint is not resolved by the local superintendent of
135135 education within 10 school days, the parent or guardian may
136136 file a complaint with the State Superintendent of Education,
137137 or his or her designee. The State Superintendent of Education
138138 shall make a form available for parents or guardians to file a
139139 complaint pursuant to this subsection.
140140 (e)(1) On or before September 1 annually, each local
141141 superintendent of education shall report the number of
142142 complaints filed with him or her during the previous school
143143 year to the State Superintendent of Education. On or before
144144 October 1 annually, the State Superintendent of Education
145145 shall report the total number of complaints filed during the
146146 previous school year, statewide and by county, to the Chairs
147147 of the Senate Education Policy Committee and the House of
148148 Representatives Education Policy Committee.
149149 (2) Any complaint filed by a parent or guardian
150-pursuant to this section is an educational record of the
151-student on whose behalf the complaint was filed and shall not
152-be released or viewed, except as provided in this section and
153-where the release or viewing is otherwise consistent with the
154-federal Family Educational Rights and Privacy Act of 1974
155-(FERPA) and state law.
