1618 Relating to the Alabama Firefighters' Personnel
1719 Standards and Education Commission; to amend Section 36-32-2,
1820 Code of Alabama 1975; to increase the membership of the
1921 commission; to provide for the additional members'
2022 appointments and qualifications; and to make nonsubstantive,
2123 technical revisions to update the existing code language to
2224 current style.
2325 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2426 Section 1. Section 36-32-2, Code of Alabama 1975, is
2527 amended to read as follows:
2628 "ยง36-32-2
2729 (a) The Alabama Firefighters' Personnel Standards and
2830 Education Commission shall consist of sevennine members, each
2931 of whom shall be a qualified elector of the state who is over
3032 the age of 18 years of age. The Professional Firefighters
3133 Association of Alabama shall nominateappoint one certified
3234 firefighter to serve for a term of four years; the Alabama
3335 Firefighter's Association shall nominateappoint one certified
3436 firefighter to serve for a term of four years; the Alabama
3537 Association of Fire Chiefs shall nominateappoint one certified
36-firefighter to serve for a term of four years; the Alabama
37-Association of Volunteer Fire Departments shall
38-nominateappoint one certified volunteer firefighter to serve
39-for a term of four years; the Presiding Officer of the Senate
40-shall appoint one certified firefighter who is experienced in

67+Association of Fire Chiefs shall nominateappoint one certified
68+firefighter to serve for a term of four years; the Alabama
69+Association of Volunteer Fire Departments shall
70+nominateappoint one certified volunteer firefighter to serve
71+for a term of four years; the Presiding Officer of the Senate
7072 shall appoint one certified firefighter who is experienced in
7173 the mentorship and training of aspiring firefighters to serve
7274 for a term of four years; the Presiding Officer of the Senate
7375 shall appoint one certified volunteer firefighter who is
7476 experienced in the mentorship and training of aspiring
7577 volunteer firefighters to serve for a term of four years; the
7678 Statestate Fire Marshal or his or her designee shall serve as
7779 a member; the Lieutenant Governor shall nominateappoint one
7880 member; and the Governor shall nominateappoint one member of
7981 the commission. The members appointed by the Lieutenant
8082 Governor and the Governor shall each serve for terms of four
8183 years.
8284 (b) Should a vacancy occur during the term of a
8385 commission member, the original nominating entity appointing
8486 authority shall nominateappoint a replacement to serve for the
8587 remainder of the term. Each nomineeappointee shall be
8688 confirmed by the Senate before the nomineeappointee becomes a
8789 member of the commission. Except for the state Fire Marshall,
8890 Nono commissioner who is then serving on the commission or
8991 whose term has just expired shall be required to be
9092 reconfirmed for a new term , once nominated by the Professional
9193 Firefighters Association of Alabama, the Alabama Firefighters
9294 Association, the Alabama Association of Fire Chiefs, the
9395 Alabama Association of Volunteer Fire Departments, the
94-Lieutenant Governor, or the Governor . Each member of the
95-commission shall serve until his or her successor is confirmed
96-by the Senate. If the Senate rejects the nomineeappointee, the
97-nominating entity appointing authority shall make a replacement
98-nominationappointment. The nominee of the Alabama Association

125+Alabama Association of Volunteer Fire Departments, the
126+Lieutenant Governor, or the Governor . Each member of the
127+commission shall serve until his or her successor is confirmed
128+by the Senate. If the Senate rejects the nomineeappointee, the
129+nominating entity appointing authority shall make a replacement
128130 nominationappointment. The nominee of the Alabama Association
129131 of Fire Chiefs shall be appointed in 2013 at the expiration of
130132 the term of office of the designee of the Governor whose
131133 appointment ends in 2013. The nominee of the Alabama
132134 Association of Volunteer Fire Departments shall be appointed
133135 in 2014 at the expiration of the term of office of the
134136 designee of the Governor whose appointment ends in 2014. No
135137 commissioner may serve more than two consecutive terms.
136138 (c) The members may adopt bylaws to govern the
137139 organization of the commission, its meetings, and activities;
138140 provided, that the bylaws shall not conflict with this
139141 chapter.
140142 (b)(d) The appointing authorities shall coordinate
141143 their appointments to assure that the membership of the
142144 commission shall beis inclusive and reflectreflects the
143145 racial, gender, geographic, urban/ruralurban, rural, and
144146 economic diversity of the state."
145147 Section 2. This act shall become effective on October
146148 1, 2024.
