16	18		Relating to the Alabama Firefighters' Personnel
17	19		Standards and Education Commission; to amend Section 36-32-2,
18	20		Code of Alabama 1975; to increase the membership of the
19	21		commission; to provide for the additional members'
20	22		appointments and qualifications; and to make nonsubstantive,
21	23		technical revisions to update the existing code language to
22	24		current style.
23	25		BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
24	26		Section 1. Section 36-32-2, Code of Alabama 1975, is
25	27		amended to read as follows:
26	28		"§36-32-2
27	29		(a) The Alabama Firefighters' Personnel Standards and
28	30		Education Commission shall consist of sevennine members, each
29	31		of whom shall be a qualified elector of the state who is over
30	32		the age of 18 years of age. The Professional Firefighters
31	33		Association of Alabama shall nominateappoint one certified
32	34		firefighter to serve for a term of four years; the Alabama
33	35		Firefighter's Association shall nominateappoint one certified
34	36		firefighter to serve for a term of four years; the Alabama
35	37		Association of Fire Chiefs shall nominateappoint one certified
36		-	firefighter to serve for a term of four years; the Alabama
37		-	Association of Volunteer Fire Departments shall
38		-	nominateappoint one certified volunteer firefighter to serve
39		-	for a term of four years; the Presiding Officer of the Senate

	67	+	Association of Fire Chiefs shall nominateappoint one certified
	68	+	firefighter to serve for a term of four years; the Alabama
	69	+	Association of Volunteer Fire Departments shall
	70	+	nominateappoint one certified volunteer firefighter to serve
	71	+	for a term of four years; the Presiding Officer of the Senate
70	72		shall appoint one certified firefighter who is experienced in
71	73		the mentorship and training of aspiring firefighters to serve
72	74		for a term of four years; the Presiding Officer of the Senate
73	75		shall appoint one certified volunteer firefighter who is
74	76		experienced in the mentorship and training of aspiring
75	77		volunteer firefighters to serve for a term of four years; the
76	78		Statestate Fire Marshal or his or her designee shall serve as
77	79		a member; the Lieutenant Governor shall nominateappoint one
78	80		member; and the Governor shall nominateappoint one member of
79	81		the commission. The members appointed by the Lieutenant
80	82		Governor and the Governor shall each serve for terms of four
81	83		years.
82	84		(b) Should a vacancy occur during the term of a
83	85		commission member, the original nominating entity appointing
84	86		authority shall nominateappoint a replacement to serve for the
85	87		remainder of the term. Each nomineeappointee shall be
86	88		confirmed by the Senate before the nomineeappointee becomes a
87	89		member of the commission. Except for the state Fire Marshall,
88	90		Nono commissioner who is then serving on the commission or
89	91		whose term has just expired shall be required to be
90	92		reconfirmed for a new term , once nominated by the Professional
91	93		Firefighters Association of Alabama, the Alabama Firefighters
92	94		Association, the Alabama Association of Fire Chiefs, the
93	95		Alabama Association of Volunteer Fire Departments, the
94		-	Lieutenant Governor, or the Governor . Each member of the
95		-	commission shall serve until his or her successor is confirmed

	126	+	Lieutenant Governor, or the Governor . Each member of the
	127	+	commission shall serve until his or her successor is confirmed
	128	+	by the Senate. If the Senate rejects the nomineeappointee, the

128	130		nominationappointment. The nominee of the Alabama Association
129	131		of Fire Chiefs shall be appointed in 2013 at the expiration of
130	132		the term of office of the designee of the Governor whose
131	133		appointment ends in 2013. The nominee of the Alabama
132	134		Association of Volunteer Fire Departments shall be appointed
133	135		in 2014 at the expiration of the term of office of the
134	136		designee of the Governor whose appointment ends in 2014. No
135	137		commissioner may serve more than two consecutive terms.
136	138		(c) The members may adopt bylaws to govern the
137	139		organization of the commission, its meetings, and activities;
138	140		provided, that the bylaws shall not conflict with this
139	141		chapter.
140	142		(b)(d) The appointing authorities shall coordinate
141	143		their appointments to assure that the membership of the
142	144		commission shall beis inclusive and reflectreflects the
143	145		racial, gender, geographic, urban/ruralurban, rural, and
144	146		economic diversity of the state."
145	147		Section 2. This act shall become effective on October
146	148		1, 2024.
