Enrolled, An Act,
Relating to the Alabama Firefighters' Personnel
Standards and Education Commission; to amend Section 36-32-2,
Code of Alabama 1975; to increase the membership of the
commission; to provide for the additional members'
appointments and qualifications; and to make nonsubstantive,
technical revisions to update the existing code language to
current style.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1. Section 36-32-2, Code of Alabama 1975, is
amended to read as follows:
"ยง36-32-2
(a) The Alabama Firefighters' Personnel Standards and
Education Commission shall consist of sevennine members, each
of whom shall be a qualified elector of the state who is over
the age of 18 years of age. The Professional Firefighters
Association of Alabama shall nominateappoint one certified
firefighter to serve for a term of four years; the Alabama
Firefighter's Association shall nominateappoint one certified
firefighter to serve for a term of four years; the Alabama
Association of Fire Chiefs shall nominateappoint one certified
firefighter to serve for a term of four years; the Alabama
Association of Volunteer Fire Departments shall
nominateappoint one certified volunteer firefighter to serve
for a term of four years; the Presiding Officer of the Senate
shall appoint one certified firefighter who is experienced in

shall appoint one certified firefighter who is experienced in
the mentorship and training of aspiring firefighters to serve
for a term of four years; the Presiding Officer of the Senate
shall appoint one certified volunteer firefighter who is
experienced in the mentorship and training of aspiring
volunteer firefighters to serve for a term of four years; 	the
Statestate Fire Marshal or his or her designee shall serve as
a member; the Lieutenant Governor shall nominateappoint one
member; and the Governor shall nominateappoint one member of
the commission. The members appointed by the Lieutenant
Governor and the Governor shall each serve for terms of four
years. 
(b) Should a vacancy occur during the term of a
commission member, the original nominating entity appointing
authority shall nominateappoint a replacement to serve for the
remainder of the term. Each nomineeappointee shall be
confirmed by the Senate before the nomineeappointee becomes a
member of the commission. Except for the state Fire Marshall,
Nono commissioner who is then serving on the commission or
whose term has just expired shall be required to be
reconfirmed for a new term , once nominated by the Professional
Firefighters Association of Alabama, the Alabama Firefighters
Association, the Alabama Association of Fire Chiefs, the
Alabama Association of Volunteer Fire Departments, the
Lieutenant Governor, or the Governor . Each member of the
commission shall serve until his or her successor is confirmed
by the Senate. If the Senate rejects the nomineeappointee, the
nominating entity appointing authority shall make a replacement
nominationappointment. The nominee of the Alabama Association

nominationappointment. The nominee of the Alabama Association
of Fire Chiefs shall be appointed in 2013 at the expiration of
the term of office of the designee of the Governor whose
appointment ends in 2013. The nominee of the Alabama
Association of Volunteer Fire Departments shall be appointed
in 2014 at the expiration of the term of office of the
designee of the Governor whose appointment ends in 2014. 	No
commissioner may serve more than two consecutive terms. 
(c) The members may adopt bylaws to govern the
organization of the commission, its meetings, and activities;
provided, that the bylaws shall not conflict with this
chapter.
(b)(d) The appointing authorities shall coordinate
their appointments to assure that the membership of the
commission shall beis inclusive and reflectreflects the
racial, gender, geographic, urban/ruralurban, rural, and
economic diversity of the state."
Section 2. This act shall become effective on October
1, 2024.
