1717 SYNOPSIS:
1818 Under existing law, a critical infrastructure is
1919 a system or asset so vital to the United States that
2020 its incapacity or destruction would have a debilitating
2121 impact on the nation's security, economy, public
2222 health, or public safety. Various facilities are
2323 enumerated as critical infrastructure facilities and
2424 are protected by law.
2525 This bill would further provide for the term
2626 "critical infrastructure facility" to include
2727 communications service infrastructure or facilities.
2828 This bill would also further provide for the
2929 crimes of unauthorized entry of a critical
3030 infrastructure facility and criminal tampering in the
3131 first and second degrees to further provide requisite
3232 criminal intent.

3636 Relating to crimes and offenses; to amend Section
3737 13A-7-4.3, Code of Alabama 1975, as last amended by Act

7070 definition of "critical infrastructure facility;" to further
7171 provide for the crime of unauthorized entry of a critical
7272 infrastructure facility; and to further provide for the crimes
7373 of criminal tampering in the first and second degrees.
7474 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7575 Section 1. Section 13A-7-4.3, Code of Alabama 1975, as
7676 last amended by Act 2024-395, 2024 Regular Session, and
7777 Sections 13A-7-25 and 13A-7-26, Code of Alabama 1975, are
7878 amended to read as follows:
7979 "§13A-7-4.3
8080 (a) For the purposes of this section, the following
8181 wordsterms have the following meanings:
8282 (1) CRITICAL INFRASTRUCTURE. A system or asset, whether
8383 physical or virtual, so vital to the United States that the
8484 incapacity or destruction of the system or asset would have a
8585 debilitating impact on security, national economic security,
8686 national public health, or national public safety.
8787 (2) CRITICAL INFRASTRUCTURE FACILITY. The term
8888 includes, but is not limited to, any of the following,
8989 including any critical infrastructure located on or in any of
9090 the following types of facilities:
9191 a. A chemical, polymer, or rubber manufacturing
9292 facility.
9393 b. A pipeline.
9494 c. A refinery.
9595 d. An electrical power generating facility.
9696 e. The area surrounding an electrical power generating

128128 f. An electrical transmission tower.
129129 g. An electrical substation or distribution substation.
130130 h. An electric utility control center.
131131 i. Electrical communication equipment.
132132 j. An electrical switching station.
133133 k. Electric power lines, power storage equipment, or
134134 other utility equipment.
135135 l. Any portion of a public water system or public
136136 wastewater treatment system.
137137 m. A natural gas transmission compressor station.
138138 n. A liquefied natural gas (LNG) terminal or storage
139139 facility.
140140 o. A natural gas distribution facility, including, but
141141 not limited to, a pipeline interconnection, a city gate or
142142 town border station, a metering station, aboveground piping, a
143143 regular station, or a natural gas or hydrocarbon storage or
144144 production facility.
145145 p. A mining operation.
146146 q. Beneficiation infrastructure or mining
147147 infrastructure.
148148 r. A transportation facility such as a port, airport,
149149 railroad operating facility, or trucking terminal.
150150 s. Wireline or wireless communications
151151 infrastructureCommunications service infrastructure or
152152 facilities, as defined under Section 37-17-1 .
153153 t. A gas processing plant, including a plant used in
154154 the processing, treatment, or fractionation of natural gas or

184184 the processing, treatment, or fractionation of natural gas or
185185 natural gas liquids.
186186 u. A steelmaking facility that uses an electric arc
187187 furnace.
188188 v. A dam that is regulated by the state or federal
189189 government.
190190 w. A crude oil or refined products storage or
191191 distribution facility, including, but not limited to, a valve
192192 site, a pipeline interconnection, a pump station, a metering
193193 station, below ground piping, above ground piping, or a truck
194194 loading or offloading facility.
195195 (3) FRAUDULENT DOCUMENTS FOR IDENTIFICATION PURPOSES. A
196196 document that is presented as being a bona fide document that
197197 provides personal identification information but which, in
198198 fact, is false, forged, altered, or counterfeit.
199199 (4) PERSON. An individual, trust, estate, corporation,
200200 partnership, limited partnership, limited liability
201201 partnership, limited liability company, or unincorporated
202202 nonprofit association having a separate legal existence under
203203 state law.
204204 (5) UNMANNED AIRCRAFT SYSTEM. A powered, aerial vehicle
205205 that does not carry a human operator, uses aerodynamic forces
206206 to provide vehicle lift, may fly autonomously through an
207207 onboard computer or be piloted remotely, and may be expendable
208208 or recoverable. The term does not include a satellite orbiting
209209 the Earth or a spacecraft beyond Earth's atmosphere and may
210210 not be construed to implicate the provider of a
211211 telecommunications link between an owner or operator of an
212212 unmanned aircraft system and the unmanned aircraft system.

242242 unmanned aircraft system and the unmanned aircraft system.
243243 (b) A person commits the crime of unauthorized entry of
244244 a critical infrastructure facility if the person does any of
245245 the following:
246246 (1) Intentionally enters without authority into any
247247 structure or onto any premises belonging to another that
248248 constitutes in whole or in part a critical infrastructure
249249 facility that is completely enclosed by any type of physical
250250 barrier or clearly marked with a sign or signs that are posted
251251 in a conspicuous manner and indicate that unauthorized entry
252252 is forbidden.
253253 (2) Uses or attempts to use a fraudulent document for
254254 identification for the purpose of entering a critical
255255 infrastructure facility.
256256 (3) Remains on the premises of a critical
257257 infrastructure facility after having been forbidden to do so,
258258 either orally or in writing, by any owner, lessee, or
259259 custodian of the property or by any other authorized person.
260260 (4) Intentionally enters into a restricted area of a
261261 critical infrastructure facility whichthat is marked as a
262262 restricted or limited access area ,or that is completely
263263 enclosed by any type of physical barrier , when the person is
264264 not authorized to enter the restricted or limited access area.
265265 (c) A person who commits the crime of unauthorized
266266 entry of a critical infrastructure facility is guilty of a
267267 Class A misdemeanor.
268268 (d) If, during the commission of the crime of
269269 unauthorized entry of a critical infrastructure facility, the
270270 a person intentionally, recklessly, or with criminal

300300 a person intentionally, recklessly, or with criminal
301301 negligence injures, removes, destroys, or breaks critical
302302 infrastructure property, or otherwise interrupts or interferes
303303 with the operations of a critical infrastructure asset, the
304304 person is guilty of a Class C felony.
305305 (e) A person who commits the crime of unauthorized
306306 entry of a critical infrastructure facility while possessing
307307 or operating an unmanned aircraft system with an attached
308308 weapon, firearm, explosive, destructive device, or ammunition
309309 is guilty of a Class C felony.
310310 (f) Nothing in this section shall be construed to
311311 prevent lawful assembly and peaceful and orderly petition for
312312 the redress of grievances, including, but not limited to, any
313313 labor dispute between any employer and its employee.
314314 (g) Nothing in this section shall be construed to
315315 prohibit the state, a county, or a municipality from taking
316316 any lawful action on their respective rights-of-way.
317317 (h) Nothing in subsection (b) or (d) shall apply to any
318318 act committed by a person within the scope of his or her
319319 employment. For purposes of this subsection, the scope of a
320320 person's employment shall include the performance of actions
321321 that are necessary for the performance of a lawful work
322322 assignment."

324324 (a) A person commits the crime of criminal tampering in
325325 the first degree if the person does any of the following:
326326 (1) Having no right to do so or any reasonable ground
327327 to believe that he or she has such a right, intentionally or
328328 recklessly causes substantial interruption or impairment of a

358358 recklessly causes substantial interruption or impairment of a
359359 service rendered to the public by a utility.
360360 (2) Threatens an individual with a deadly weapon or
361361 dangerous instrument with the intent to obstruct the operation
362362 of a utility. This subdivision only applies if the individual
363363 is working under the procedures and within the scope of his or
364364 her duties as an employee of the utility and has properly
365365 identified himself or herself when asked by stating his or her
366366 name, employer, and purpose of work.
367367 (b) Criminal tampering in the first degree is a Class C
368368 felony.
369369 (c) Nothing in this section shall be construed to
370370 prohibit the state, a county, or a municipality from taking
371371 any lawful action on its respective rights-of-way. "

373373 (a) A person commits the crime of criminal tampering in
374374 the second degree if, having no right to do so or any
375375 reasonable ground to believe that he or she has such a right,
376376 hethe person:
377377 (1) Intentionally or recklessly tampers with property
378378 of another for the purpose of causing substantial
379379 inconvenience to that person or to another; or
380380 (2) Intentionally or recklessly tampers or makes
381381 connection with property of a utility.
382382 (b) Criminal tampering in the second degree is a Class
383383 B misdemeanor.
384384 (c) Nothing in this section shall be construed to
385385 prohibit the state, a county, or a municipality from taking
386386 any lawful action on its respective rights-of-way. "
