---|
18 | 18 | | Under existing law, a critical infrastructure is |

19 | 19 | | a system or asset so vital to the United States that |
---|
20 | 20 | | its incapacity or destruction would have a debilitating |
---|
21 | 21 | | impact on the nation's security, economy, public |
---|
22 | 22 | | health, or public safety. Various facilities are |
---|
23 | 23 | | enumerated as critical infrastructure facilities and |
---|
24 | 24 | | are protected by law. |
---|
25 | 25 | | This bill would further provide for the term |
---|
26 | 26 | | "critical infrastructure facility" to include |
---|
27 | 27 | | communications service infrastructure or facilities. |
---|
28 | 28 | | This bill would also further provide for the |

29 | 29 | | crimes of unauthorized entry of a critical |
---|

75 | 75 | | Section 1. Section 13A-7-4.3, Code of Alabama 1975, as |
---|
76 | 76 | | last amended by Act 2024-395, 2024 Regular Session, and |
---|
77 | 77 | | Sections 13A-7-25 and 13A-7-26, Code of Alabama 1975, are |
---|
78 | 78 | | amended to read as follows: |

79 | 79 | | "§13A-7-4.3 |
---|
80 | 80 | | (a) For the purposes of this section, the following |
---|
81 | 81 | | wordsterms have the following meanings: |
---|
82 | 82 | | (1) CRITICAL INFRASTRUCTURE. A system or asset, whether |
---|
83 | 83 | | physical or virtual, so vital to the United States that the |
---|
84 | 84 | | incapacity or destruction of the system or asset would have a |
---|
85 | 85 | | debilitating impact on security, national economic security, |
---|
86 | 86 | | national public health, or national public safety. |
---|
87 | 87 | | (2) CRITICAL INFRASTRUCTURE FACILITY. The term |
---|
88 | 88 | | includes, but is not limited to, any of the following, |
---|
89 | 89 | | including any critical infrastructure located on or in any of |
---|
90 | 90 | | the following types of facilities: |
---|
91 | 91 | | a. A chemical, polymer, or rubber manufacturing |
---|
92 | 92 | | facility. |
---|
93 | 93 | | b. A pipeline. |
---|
94 | 94 | | c. A refinery. |
---|
95 | 95 | | d. An electrical power generating facility. |
---|
96 | 96 | | e. The area surrounding an electrical power generating |
---|

195 | 195 | | (3) FRAUDULENT DOCUMENTS FOR IDENTIFICATION PURPOSES. A |
---|
196 | 196 | | document that is presented as being a bona fide document that |
---|
197 | 197 | | provides personal identification information but which, in |
---|
198 | 198 | | fact, is false, forged, altered, or counterfeit. |
---|
199 | 199 | | (4) PERSON. An individual, trust, estate, corporation, |
---|
200 | 200 | | partnership, limited partnership, limited liability |

201 | 201 | | partnership, limited liability company, or unincorporated |
---|
202 | 202 | | nonprofit association having a separate legal existence under |

204 | 204 | | (5) UNMANNED AIRCRAFT SYSTEM. A powered, aerial vehicle |
---|
205 | 205 | | that does not carry a human operator, uses aerodynamic forces |
---|
206 | 206 | | to provide vehicle lift, may fly autonomously through an |
---|
207 | 207 | | onboard computer or be piloted remotely, and may be expendable |
---|
208 | 208 | | or recoverable. The term does not include a satellite orbiting |
---|
209 | 209 | | the Earth or a spacecraft beyond Earth's atmosphere and may |
---|
210 | 210 | | not be construed to implicate the provider of a |
---|
211 | 211 | | telecommunications link between an owner or operator of an |
---|
212 | 212 | | unmanned aircraft system and the unmanned aircraft system. |

246 | 246 | | (1) Intentionally enters without authority into any |
---|
247 | 247 | | structure or onto any premises belonging to another that |
---|
248 | 248 | | constitutes in whole or in part a critical infrastructure |
---|
249 | 249 | | facility that is completely enclosed by any type of physical |
---|
250 | 250 | | barrier or clearly marked with a sign or signs that are posted |
---|
251 | 251 | | in a conspicuous manner and indicate that unauthorized entry |
---|
252 | 252 | | is forbidden. |
---|
253 | 253 | | (2) Uses or attempts to use a fraudulent document for |
---|
254 | 254 | | identification for the purpose of entering a critical |
---|
255 | 255 | | infrastructure facility. |
---|
256 | 256 | | (3) Remains on the premises of a critical |
---|
257 | 257 | | infrastructure facility after having been forbidden to do so, |
---|
258 | 258 | | either orally or in writing, by any owner, lessee, or |
---|
259 | 259 | | custodian of the property or by any other authorized person. |
---|
260 | 260 | | (4) Intentionally enters into a restricted area of a |
---|
261 | 261 | | critical infrastructure facility whichthat is marked as a |
---|
262 | 262 | | restricted or limited access area ,or that is completely |
---|
263 | 263 | | enclosed by any type of physical barrier , when the person is |
---|
264 | 264 | | not authorized to enter the restricted or limited access area. |
---|
265 | 265 | | (c) A person who commits the crime of unauthorized |
---|
266 | 266 | | entry of a critical infrastructure facility is guilty of a |
---|
267 | 267 | | Class A misdemeanor. |

268 | 268 | | (d) If, during the commission of the crime of |

269 | 269 | | unauthorized entry of a critical infrastructure facility, the |

307 | 307 | | or operating an unmanned aircraft system with an attached |

308 | 308 | | weapon, firearm, explosive, destructive device, or ammunition |
---|
309 | 309 | | is guilty of a Class C felony. |

310 | 310 | | (f) Nothing in this section shall be construed to |
---|
311 | 311 | | prevent lawful assembly and peaceful and orderly petition for |
---|
312 | 312 | | the redress of grievances, including, but not limited to, any |
---|
313 | 313 | | labor dispute between any employer and its employee. |
---|
314 | 314 | | (g) Nothing in this section shall be construed to |

315 | 315 | | prohibit the state, a county, or a municipality from taking |

316 | 316 | | any lawful action on their respective rights-of-way. |
