1515 SYNOPSIS:
1616 Existing law provides that a tall structure may
1717 not have an adverse impact on the operations of a
1818 military installation.
1919 Existing law also requires a local government,
2020 before approving a tall structure near a military
2121 installation, to notify the Federal Aviation
2222 Administration; however, the governing body of counties
2323 do not have a uniform process in place requiring
2424 approval of constructing these tall structures.
2525 This bill would require a person seeking to
2626 construct a tall structure within a minimum distance of
2727 a military installation to receive approval from the
2828 local government before construction may begin.
2929 This bill would authorize a local government to
3030 seek enjoinment of the construction of a tall structure
3131 if prior approval was not granted.
3232 This bill would also make conforming changes.

6666 Relating to military installations; to amend Sections
6767 11-106-4 and 11-106-6, Code of Alabama 1975, to require
6868 persons to obtain the approval of a local government before
6969 constructing a tall structure within a certain distance of a
7070 military installation; to authorize local governments to seek
7171 enjoinment of the construction of a tall structure in certain
7272 circumstances; and to make conforming changes.
7373 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7474 Section 1. Sections 11-106-4 and 11-106-6, Code of
7575 Alabama 1975, are amended to read as follows:
7676 "§11-106-4
7777 (a) Each local government whose territorial boundaries
7878 are within two miles of all or any portion of a military
7979 installation shall provide written notice to the military
8080 installation's commanding officer and the flying mission
8181 commanding officer if applicable, or their designees, of any
8282 local impact issue.
8383 (b) Prior to approving any proposed tall structure or
8484 wind energy facility, the local government shall follow the
8585 requirements of Section 11-106-6. The requirements of Section
8686 11-106-6 shall apply regardless of the distance of the tall
8787 structure or wind energy facility from any military
8888 installation and regardless of whether the local government’s
8989 territorial boundaries are within two miles of all or any
9090 portion of a military installation. "

9292 (a) The construction or operation of any tall structure
9393 or wind energy facility in this state shall not encroach upon
9494 or otherwise have an adverse impact on military operations and

124124 or otherwise have an adverse impact on military operations and
125125 readiness of any military installation or branch of military.
126126 (b) A person may not commence the construction of a
127127 tall structure within two miles of a military installation
128128 unless the person has obtained approval from the governing
129129 body of the local government in which the tall structure will
130130 be located as further provided in this section.
131131 (b)(c) A governing body of a local government , prior to
132132 approving an application for the construction of a tall
133133 structure shall may not approve an application to commence
134134 construction of a tall structure within two miles of a
135135 military installation unless require the applicant to file has
136136 filed an application with the Federal Aviation Administration
137137 under 49 U.S.C. § 44718, and provide provided the governing
138138 body of the local government either of the following:
139139 (1) A written "Determination of No Hazard to Air
140140 Navigation" issued by the Federal Aviation Administration
141141 pursuant to 14 C.F.R. Part 77, Subpart D.
142142 (2) In coordination with any affected military
143143 installation and the state Military Department, a written
144144 determination resolving any adverse impact to military
145145 operations identified during the aeronautics study conducted
146146 pursuant to 14 C.F.R. Part 77, Subpart D.
147147 (3) The tall structure shall be in compliance with
148148 subsection (a) even if the local government either does not
149149 require an application prior to the construction of a tall
150150 structure or does not require the application outlined in this
151151 subsection if the applicant has otherwise complied with the
152152 requirements of subdivision (1) or (2).

182182 requirements of subdivision (1) or (2).
183183 (d) A local government may bring an action for
184184 injunctive relief against any person that commences the
185185 construction of a tall structure without obtaining prior
186186 approval as required pursuant to this section.
187187 (c)(e) A local government considering an application
188188 for the construction of a wind energy facility shall require
189189 the applicant to provide the following at least 270 days prior
190190 to planned construction:
191191 (1) Documentation that the owner or applicant has
192192 transmitted notice relating to the construction of the wind
193193 energy facility to the Department of Defense Siting
194194 Clearinghouse, the state Military Department, and the state
195195 Department of Transportation.
196196 (2) A map showing the specific location and tower hub
197197 height with rotor diameter for each proposed wind turbine.
198198 (3) Documentation that the facility owner has either
199199 initiated an informal review with the Department of Defense
200200 Siting Clearinghouse under 32 C.F.R. § 211.7 or filed for a
201201 formal review with the Secretary of Transportation and the
202202 Federal Aviation Administration pursuant to 49 U.S.C. § 44718.
203203 (d)(f) A local government may not approve an
204204 application for the construction of a wind energy facility
205205 prior to receiving documentation of one of the following:
206206 (1) A completed Department of Defense Siting
207207 Clearinghouse informal review resulting in a determination of
208208 no presumed risk.
209209 (2) A mitigation agreement between the owner or
210210 applicant and the Department of Defense Siting Clearinghouse

242242 (3) A written "Determination of No Hazard to Air
243243 Navigation" issued by the Federal Aviation Administration
244244 pursuant to 14 C.F.R. Part 77, Subpart D.
245245 (e)(g) Notwithstanding subsection (d) (f), a local
246246 government may approve an application for the construction of
247247 a wind energy facility conditioned upon the applicant
248248 providing documentation of one of the requirements set out in
249249 subsection (d) (f).
250250 (f)(h) If any dispute arises between a local government
251251 and an applicant or military installation relating to the
252252 approval of any tall structure or wind energy facility, the
253253 local government shall provide notice to the Governor or the
254254 Governor’s Governor's designee to facilitate resolution of the
255255 dispute.
256256 (g)(i) A local government may not require any other
257257 formal written approval from a military installation to
258258 approve an application for the construction of a tall
259259 structure or wind energy facility."
260260 Section 2. This act shall become effective on October
261261 1, 2025.
