29 | 29 | | Section 1. Sections 17-5-2 and 17-5-15.1, Code of |
---|
30 | 30 | | Alabama 1975, are amended to read as follows: |

31 | 31 | | "§17-5-2 |
---|
32 | 32 | | (a) For purposes of this chapter, the following terms |
---|
33 | 33 | | shall have the following meanings: |
---|
34 | 34 | | (1) CANDIDATE. An individual who has done any of the |
---|

---|

---|
68 | 68 | | election to any state office or local office or in the case of |
---|
69 | 69 | | an independent seeking ballot access, on the date when he or |
---|
70 | 70 | | she files a petition with the judge of probate in the case of |
---|
71 | 71 | | county offices, with the appropriate qualifying municipal |
---|
72 | 72 | | official in the case of municipal offices, or the Secretary of |
---|
73 | 73 | | State in all other cases. |
---|
74 | 74 | | b. Received contributions or made expenditures in |
---|
75 | 75 | | excess of one thousand dollars ($1,000), or given his or her |
---|
76 | 76 | | consent for any other person or persons to receive |
---|
77 | 77 | | contributions or make expenditures in excess of one thousand |
---|
78 | 78 | | dollars ($1,000), with a view to bringing about his or her |
---|
79 | 79 | | nomination or election to any state office or local office. |
---|
80 | 80 | | (2) COMMISSION. The State Ethics Commission created |
---|
81 | 81 | | pursuant to Section 36-25-3. |
---|
82 | 82 | | (3) CONTRIBUTION. |
---|
83 | 83 | | a. Any of the following shall be considered a |
---|
84 | 84 | | contribution: |
---|
85 | 85 | | 1. A gift, subscription, loan, advance, deposit of |
---|
86 | 86 | | money or anything of value, a payment, a forgiveness of a |
---|
87 | 87 | | loan, or payment of a third party, made for the purpose of |
---|
88 | 88 | | influencing the result of an election. |
---|
89 | 89 | | 2. A contract or agreement to make a gift, |
---|
90 | 90 | | subscription, loan, advance, or deposit of money or anything |
---|
91 | 91 | | of value for the purpose of influencing the result of an |
---|
92 | 92 | | election. |
---|
93 | 93 | | 3. Any transfer of anything of value received by a |
---|
94 | 94 | | political committee from another political committee, |
---|

129 | 129 | | candidate, political committee, or political party without |
---|
130 | 130 | | payment of full and adequate compensation by the candidate, |
---|
131 | 131 | | political committee, or political party ;. Provided provided, |
---|
132 | 132 | | however, that the payment of compensation by a corporation for |
---|
133 | 133 | | the purpose of establishing, administering, or soliciting |
---|
134 | 134 | | voluntary contributions to a separate, segregated fund as |
---|
135 | 135 | | permitted in this chapter, shall not constitute a |
---|
136 | 136 | | contribution. |
---|
137 | 137 | | b. The term "contribution" does not include: |
---|
138 | 138 | | 1. The value of services provided without compensation |
---|
139 | 139 | | by individuals who volunteer a portion or all of their time on |
---|
140 | 140 | | behalf of a candidate or political committee. |
---|
141 | 141 | | 2. The use of real or personal property and the cost of |
---|
142 | 142 | | invitations, food, or beverages, voluntarily provided by an |
---|
143 | 143 | | individual to a candidate or political committee in rendering |
---|
144 | 144 | | voluntary personal services on the individual's residential or |
---|
145 | 145 | | business premises for election-related activities. |
---|
146 | 146 | | 3. The sale of any food or beverage by a vendor for use |
---|
147 | 147 | | in an election campaign at a charge to a candidate or |
---|
148 | 148 | | political committee less than the normal comparable charge, if |
---|
149 | 149 | | the charge to the political committee for use in an election |
---|
150 | 150 | | campaign is at least equal to the cost of the food or beverage |
---|
151 | 151 | | to the vendor. |
---|
152 | 152 | | 4. Any unreimbursed payment for travel expenses made by |
---|

191 | 191 | | this subparagraph shall not apply in the case of costs |

192 | 192 | | incurred by the committee with respect to a display of the |

193 | 193 | | listing made on broadcasting stations, or in newspapers, |
---|
194 | 194 | | magazines, or other similar types of general public political |
---|
195 | 195 | | advertising. |
---|
196 | 196 | | 6. The value or cost of polling data and voter |
---|
197 | 197 | | preference data and information if provided to a candidate or |
---|
198 | 198 | | political committee, unless the information was compiled with |
---|
199 | 199 | | the advance knowledge of and approval of the candidate or the |
---|
200 | 200 | | political committee. |
---|
201 | 201 | | c. For purposes of reporting contributions as required |
---|
202 | 202 | | by this chapter, the date of receipt of a contribution shall |
---|
203 | 203 | | be the first date the recipient of the contribution is able to |
---|
204 | 204 | | make use of the contribution. In the case of a contribution in |
---|
205 | 205 | | the form of a check, the date of receipt is the earlier of |
---|
206 | 206 | | either of the following: |
---|
207 | 207 | | 1. Ten days from the date that the check came within |
---|
208 | 208 | | the recipient's control. |
---|
209 | 209 | | 2. The date that the check was deposited into the |
---|
210 | 210 | | recipient's account. |

244 | 244 | | of a candidate, his or her principal campaign committee, or a |
---|
245 | 245 | | political action committee. |
---|
246 | 246 | | (5) ELECTION. Unless otherwise specified, any general, |
---|
247 | 247 | | special, primary, or runoff election, or any convention or |
---|
248 | 248 | | caucus of a political party held to nominate a candidate, or |
---|
249 | 249 | | any election at which a constitutional amendment or other |
---|
250 | 250 | | proposition is submitted to the popular vote. |
---|
251 | 251 | | (6) ELECTIONEERING COMMUNICATION. Any communication |
---|
252 | 252 | | disseminated through any federally regulated broadcast media, |
---|
253 | 253 | | any mailing, or other distribution, electronic communication, |
---|
254 | 254 | | phone bank, or publication which (i) contains the name or |
---|
255 | 255 | | image of a candidate; (ii) is made within 120 days of an |
---|
256 | 256 | | election in which the candidate will appear on the ballot; |
---|
257 | 257 | | (iii) the only reasonable conclusion to be drawn from the |
---|
258 | 258 | | presentation and content of the communication is that it is |
---|
259 | 259 | | intended to influence the outcome of an election; and (iv) |
---|
260 | 260 | | entails an expenditure in excess of one thousand dollars |
---|
261 | 261 | | ($1,000). |
---|
262 | 262 | | (7) EXPENDITURE. |
---|
263 | 263 | | a. The following shall be considered expenditures: |

374 | 374 | | (8) FOREIGN NATIONAL. Any of the following: |
---|
375 | 375 | | a. An individual who is not a citizen or lawful |
---|
376 | 376 | | permanent resident of the United States. |
---|
377 | 377 | | b. A government or subdivision of a foreign country or |
---|
378 | 378 | | municipality thereof. |
---|
379 | 379 | | c. A foreign political party. |
---|
380 | 380 | | d. Any entity, such as a partnership, association, |
---|
381 | 381 | | corporation, organization, or other combination of persons, |
---|
382 | 382 | | that is organized under the laws of, or has its principal |
---|
383 | 383 | | place of business in a foreign country. |

422 | 422 | | (8)(9) IDENTIFICATION. The full name and complete |
---|
423 | 423 | | address. |
---|
424 | 424 | | (9)(10) LOAN. A transfer of money, property, or |
---|
425 | 425 | | anything of value in consideration of a promise or obligation, |
---|
426 | 426 | | conditional or not, to repay in whole or part. |
---|
427 | 427 | | (10)(11) LOCAL OFFICE. Any office under the |
---|
428 | 428 | | constitution and laws of the state, except circuit, district, |
---|
429 | 429 | | or legislative offices, filled by election of the registered |
---|
430 | 430 | | voters of a single county or municipality, or by the voters of |
---|
431 | 431 | | a division contained within a county or municipality. |
---|
432 | 432 | | (12) NON-CANDIDATE ELECTION. A question or proposition |
---|
433 | 433 | | to be placed before the voter in a state or local election, |
---|
434 | 434 | | other than the nomination or election of a candidate for |
