1717 SYNOPSIS:
1818 This bill would reopen the Teachers' Retirement
1919 System to allow an active, vested, and contributing
2020 member to purchase credit in the system for prior
2121 service rendered to the St. Clair County DAY Program,
2222 Incorporated.

2626 To reopen the Teachers' Retirement System to permit
2727 purchase of credit in the system for prior service rendered to
2828 the St. Clair County DAY Program, Incorporated.
2929 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3030 Section 1. (a) The governing body of the St. Clair
3131 County DAY Program, Incorporated, by resolution legally
3232 adopted to conform to the rules prescribed by the Board of
3333 Control of the Teachers' Retirement System, may elect to have
3434 its executive officers and full-time employees, from whatever
3535 source and in whatever manner paid, become eligible to
3636 participate in the Teachers' Retirement System of Alabama,
3737 subject to all rules, regulations, and conditions thereof.

6868 (b) After the governing body of the St. Clair County
6969 DAY Program, Incorporated, has made an election through a
7070 resolution as provided in subsection (a), its employees and
7171 executive officers may participate in and be entitled to all
7272 benefits of the Teachers' Retirement System of Alabama;
7373 provided, that where contributions are made from salaries paid
7474 by the St. Clair County DAY Program, Incorporated, the St.
7575 Clair County DAY Program, Incorporated, shall pay the employer
7676 cost, calculated as a percentage of the salaries of those
7777 employees, to be contributed as employer contributions in
7878 accordance with Section 16-25-21, Code of Alabama 1975. The
7979 amount shall be paid monthly and at the same time as the
8080 members' contributions are made to the Teachers' Retirement
8181 System.
8282 (c) The governing body of the St. Clair County DAY
8383 Program, Incorporated, may provide in its resolution to the
8484 Teachers' Retirement System's Board of Control that all
8585 service rendered by an eligible employee or executive officer
8686 to the program, previous to the effective date of the
8787 program's election to come under the Teachers' Retirement
8888 System, shall be creditable service to the employee or
8989 executive officer; provided, that any provision shall apply
9090 only to those employees and officers who were in the active
9191 service of the program on the effective date of the program's
9292 election to be covered under the Teachers' Retirement System;
9393 and provided further, that the resolution also states that the
9494 St. Clair County DAY Program, Incorporated, shall assume and
9595 pay, as required, all costs necessary to fund the crediting of
9696 the previous service, the costs to be determined by the

126126 the previous service, the costs to be determined by the
127127 actuary employed by the Teachers' Retirement System Board of
128128 Control. All benefits that accrue and are payable to any
129129 beneficiary pursuant to this section shall be limited to, and
130130 shall not exceed, the amount paid in by the beneficiary and
131131 the employer plus his or her portion of the interest earned
132132 and the enhancement of his or her monies by investing them,
133133 less cost of administration, at no cost to the State of
134134 Alabama.
135135 Section 2. This act shall become effective on October
136136 1, 2025.
