1717 SYNOPSIS:
1818 Under the Constitution of Alabama of 2022, the
1919 Legislature has no power to enact laws providing for a
2020 lottery or gift enterprise and is instead required to
2121 pass laws prohibiting such activities.
2222 This bill would propose an amendment to the
2323 Constitution of Alabama of 2022, to provide that the
2424 Legislature, by general law, may authorize, license,
2525 tax, and provide for the operation of traditional paper
2626 raffles and traditional paper bingo when conducted for
2727 noncommercial charitable purposes only.

3030 AN ACT
3131 Relating to gaming; to propose an amendment to Section
3232 65 of the Constitution of Alabama of 2022, and to add Section
3333 65.1 to the Constitution of Alabama 2022, to provide that the
3434 Legislature, by general law, may authorize, license, tax, and
3535 provide for the operation of traditional paper raffles and
3636 paper bingo conducted for noncommercial charitable purposes.

6868 Section 1. The following amendment to the Constitution
6969 of Alabama of 2022, is proposed:

7171 Part 1. Section 65 of the Constitution of Alabama of
7272 2022, is amended to read as follows:
7373 Section 65
7474 (a) The legislature Except as otherwise provided in
7575 this constitution, the Legislature shall have no power to
7676 authorize lotteries or gift enterprises for any purposes, and
7777 shall pass laws to prohibit such activitiesthe sale in this
7878 state of lottery or gift enterprise tickets, or tickets in any
7979 scheme in the nature of a lottery; and all acts, or parts of
8080 acts heretofore passed by the legislature of this state,
8181 authorizing a lottery or lotteries, and all acts amendatory
8282 thereof, or supplemental thereto, are hereby avoided .
8383 (b) Any law enacted by the Legislature in violation of
8484 this section shall be void.
8585 Part 2. The following Section 65.1 is added to the
8686 Constitution of Alabama of 2022, to read as follows:
8787 Section 65.1
8888 (a) Notwithstanding Section 65, the Legislature, by
8989 general law, may authorize, license, tax, and provide for the
9090 operation of the following activities:
9191 (1) Traditional raffles, using only cardboard, paper,
9292 plastic, or some functionally similar material.
9393 (2) Traditional bingo, using only cardboard, paper,
9494 plastic, or some functionally similar material.
9595 (b) Any activity conducted pursuant to the authority of
9696 this section shall be conducted only for noncommercial

126126 this section shall be conducted only for noncommercial
127127 charitable fundraising purposes.
128128 Upon ratification of this constitutional amendment, the
129129 Code Commissioner shall number and place this amendment as
130130 appropriate in the constitution omitting this instructional
131131 paragraph and may make the following nonsubstantive revisions:
132132 change capitalization, hierarchy, spelling, and punctuation
133133 for purposes of style and uniformity; correct manifest
134134 grammatical, clerical, and typographical errors; revise
135135 internal or external citations and cross-references; harmonize
136136 language; and translate effective dates.
137137 END OF PROPOSED AMENDMENT
138138 Section 2. An election upon the proposed amendment
139139 shall be held in accordance with Sections 284 and 285 of the
140140 Constitution of Alabama of 2022, and the election laws of this
141141 state. The appropriate election official shall assign a ballot
142142 number for the proposed constitutional amendment on the
143143 election ballot and shall set forth the following description
144144 of the substance or subject matter of the proposed
145145 constitutional amendment:
146146 "Proposing an amendment to the Constitution of Alabama
147147 of 2022, to provide that the Legislature, by general law, may
148148 authorize, license, tax, and provide for the operation of
149149 traditional paper raffles and traditional paper bingo when
150150 conducted for noncommercial charitable purposes only .
151151 Proposed by Act ____. "
152152 This description shall be followed by the following
153153 language:
