17	17	SYNOPSIS:
18	18	Under the Constitution of Alabama of 2022, the
19	19	Legislature has no power to enact laws providing for a
20	20	lottery or gift enterprise and is instead required to
21	21	pass laws prohibiting such activities.
22	22	This bill would propose an amendment to the
23	23	Constitution of Alabama of 2022, to provide that the
24	24	Legislature, by general law, may authorize, license,
25	25	tax, and provide for the operation of traditional paper
26	26	raffles and traditional paper bingo when conducted for
27	27	noncommercial charitable purposes only.

29	29	TO BE ENTITLED
30	30	AN ACT
31	31	Relating to gaming; to propose an amendment to Section
32	32	65 of the Constitution of Alabama of 2022, and to add Section
33	33	65.1 to the Constitution of Alabama 2022, to provide that the
34	34	Legislature, by general law, may authorize, license, tax, and
35	35	provide for the operation of traditional paper raffles and
36	36	paper bingo conducted for noncommercial charitable purposes.
37	37	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

68	68	Section 1. The following amendment to the Constitution
69	69	of Alabama of 2022, is proposed:
70	70	PROPOSED AMENDMENT
71	71	Part 1. Section 65 of the Constitution of Alabama of
72	72	2022, is amended to read as follows:
73	73	Section 65
74	74	(a) The legislature Except as otherwise provided in
75	75	this constitution, the Legislature shall have no power to
76	76	authorize lotteries or gift enterprises for any purposes, and
77	77	shall pass laws to prohibit such activitiesthe sale in this
78	78	state of lottery or gift enterprise tickets, or tickets in any
79	79	scheme in the nature of a lottery; and all acts, or parts of
80	80	acts heretofore passed by the legislature of this state,
81	81	authorizing a lottery or lotteries, and all acts amendatory
82	82	thereof, or supplemental thereto, are hereby avoided .
83	83	(b) Any law enacted by the Legislature in violation of
84	84	this section shall be void.
85	85	Part 2. The following Section 65.1 is added to the
86	86	Constitution of Alabama of 2022, to read as follows:
87	87	Section 65.1
88	88	(a) Notwithstanding Section 65, the Legislature, by
89	89	general law, may authorize, license, tax, and provide for the
90	90	operation of the following activities:
91	91	(1) Traditional raffles, using only cardboard, paper,
92	92	plastic, or some functionally similar material.
93	93	(2) Traditional bingo, using only cardboard, paper,
94	94	plastic, or some functionally similar material.
95	95	(b) Any activity conducted pursuant to the authority of
96	96	this section shall be conducted only for noncommercial

126	126	this section shall be conducted only for noncommercial
127	127	charitable fundraising purposes.
128	128	Upon ratification of this constitutional amendment, the
129	129	Code Commissioner shall number and place this amendment as
130	130	appropriate in the constitution omitting this instructional
131	131	paragraph and may make the following nonsubstantive revisions:
132	132	change capitalization, hierarchy, spelling, and punctuation
133	133	for purposes of style and uniformity; correct manifest
134	134	grammatical, clerical, and typographical errors; revise
135	135	internal or external citations and cross-references; harmonize
136	136	language; and translate effective dates.
137	137	END OF PROPOSED AMENDMENT
138	138	Section 2. An election upon the proposed amendment
139	139	shall be held in accordance with Sections 284 and 285 of the
140	140	Constitution of Alabama of 2022, and the election laws of this
141	141	state. The appropriate election official shall assign a ballot
142	142	number for the proposed constitutional amendment on the
143	143	election ballot and shall set forth the following description
144	144	of the substance or subject matter of the proposed
145	145	constitutional amendment:
146	146	"Proposing an amendment to the Constitution of Alabama
147	147	of 2022, to provide that the Legislature, by general law, may
148	148	authorize, license, tax, and provide for the operation of
149	149	traditional paper raffles and traditional paper bingo when
150	150	conducted for noncommercial charitable purposes only .
151	151	Proposed by Act ____. "
152	152	This description shall be followed by the following
153	153	language:
