This bill would propose an amendment to the Constitution of Alabama of 2022, to provide that the Legislature, by general law, may authorize, license, tax, and provide for the operation of traditional paper raffles and traditional paper bingo when conducted for noncommercial charitable purposes only. A BILL TO BE ENTITLED AN ACT Relating to gaming; to propose an amendment to Section 65 of the Constitution of Alabama of 2022, and to add Section 65.1 to the Constitution of Alabama 2022, to provide that the Legislature, by general law, may authorize, license, tax, and provide for the operation of traditional paper raffles and paper bingo conducted for noncommercial charitable purposes. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. The following amendment to the Constitution of Alabama of 2022, is proposed: PROPOSED AMENDMENT Part 1. Section 65 of the Constitution of Alabama of 2022, is amended to read as follows: Section 65 (a) The legislature Except as otherwise provided in this constitution, the Legislature shall have no power to authorize lotteries or gift enterprises for any purposes, and shall pass laws to prohibit such activitiesthe sale in this state of lottery or gift enterprise tickets, or tickets in any scheme in the nature of a lottery; and all acts, or parts of acts heretofore passed by the legislature of this state, authorizing a lottery or lotteries, and all acts amendatory thereof, or supplemental thereto, are hereby avoided . (b) Any law enacted by the Legislature in violation of this section shall be void. Part 2. The following Section 65.1 is added to the Constitution of Alabama of 2022, to read as follows: Section 65.1 (a) Notwithstanding Section 65, the Legislature, by general law, may authorize, license, tax, and provide for the operation of the following activities: (1) Traditional raffles, using only cardboard, paper, plastic, or some functionally similar material. (2) Traditional bingo, using only cardboard, paper, plastic, or some functionally similar material. (b) Any activity conducted pursuant to the authority of this section shall be conducted only for noncommercial 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 HB47 INTRODUCED Page 3 this section shall be conducted only for noncommercial charitable fundraising purposes. Upon ratification of this constitutional amendment, the Code Commissioner shall number and place this amendment as appropriate in the constitution omitting this instructional paragraph and may make the following nonsubstantive revisions: change capitalization, hierarchy, spelling, and punctuation for purposes of style and uniformity; correct manifest grammatical, clerical, and typographical errors; revise internal or external citations and cross-references; harmonize language; and translate effective dates. END OF PROPOSED AMENDMENT Section 2. An election upon the proposed amendment shall be held in accordance with Sections 284 and 285 of the Constitution of Alabama of 2022, and the election laws of this state. The appropriate election official shall assign a ballot number for the proposed constitutional amendment on the election ballot and shall set forth the following description of the substance or subject matter of the proposed constitutional amendment: "Proposing an amendment to the Constitution of Alabama of 2022, to provide that the Legislature, by general law, may authorize, license, tax, and provide for the operation of traditional paper raffles and traditional paper bingo when conducted for noncommercial charitable purposes only . Proposed by Act ____.
