1717 SYNOPSIS:
1818 Under existing law, when asked by a law
1919 enforcement officer a person has a duty to inform the
2020 officer whether he or she is in possession of a
2121 concealed pistol or firearm. There is no penalty
2222 associated with a violation of this law.
2323 This bill would provide a criminal penalty for a
2424 violation.

2727 AN ACT
2828 Relating to firearms; to amend Section 13A-11-95 of the
2929 Code of Alabama 1975; to establish a criminal penalty for
3030 failure to inform a law enforcement officer of one's
3131 possession of a concealed pistol or firearm under certain
3232 circumstances.
3333 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3434 Section 1. Section 13A-11-95 of the Code of Alabama
3535 1975, is amended to read as follows:
3636 "ยง13A-11-95
3737 (a) Any person who knowingly possesses a pistol or
3838 firearm concealed on or about his or her person or in a

6868 firearm concealed on or about his or her person or in a
6969 vehicle occupied by the person, and who is asked by a law
7070 enforcement officer operating in the line or scope of his or
7171 her official duties whether he or she is armed with a
7272 concealed pistol or firearm, shall immediately inform the law
7373 enforcement officer that the person is in possession of a
7474 pistol or firearm.
7575 (b) A violation of subsection (a) is a Class A
7676 misdemeanor."
7777 Section 2. This act shall become effective on October
7878 1, 2025.
