SYNOPSIS:
Under existing law, when asked by a law
enforcement officer a person has a duty to inform the
officer whether he or she is in possession of a
concealed pistol or firearm. There is no penalty
associated with a violation of this law.
This bill would provide a criminal penalty for a
violation.
A BILL
TO BE ENTITLED
AN ACT
Relating to firearms; to amend Section 13A-11-95 of the
Code of Alabama 1975; to establish a criminal penalty for
failure to inform a law enforcement officer of one's
possession of a concealed pistol or firearm under certain
circumstances.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: 
Section 1. Section 13A-11-95 of the Code of Alabama
1975, is amended to read as follows:
       "ยง13A-11-95
(a) Any person who knowingly possesses a pistol or
firearm concealed on or about his or her person or in a

firearm concealed on or about his or her person or in a
vehicle occupied by the person, and who is asked by a law
enforcement officer operating in the line or scope of his or
her official duties whether he or she is armed with a
concealed pistol or firearm, shall immediately inform the law
enforcement officer that the person is in possession of a
pistol or firearm.
(b) A violation of subsection (a) is a Class A
misdemeanor."
Section 2. This act shall become effective on October
1, 2025.
