17+AN ACT
1618 Relating to firearms; to prohibit persons from
1719 possessing a part or combination of parts designed or
1820 intended to convert a pistol into a machine gun; and to
1921 provide penalties for violations.
2022 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2123 Section 1. (a) For the purposes of this section, the
2224 term “machine gun” means any weapon which shoots, is
2325 designed to shoot, or can be readily restored to shoot,
2426 automatically more than one shot, without manual reloading,
2527 by a single function of the trigger. The term shall include
2628 the frame or receiver of any such weapon, any part designed
2729 and intended solely and exclusively, or combination of parts
2830 designed and intended, for use in converting a weapon into a
2931 machine gun, and any combination of parts from which a
3032 machine gun can be assembled if such parts are in the
3133 possession or under the control of a person.
3234 (b)A person who possesses, obtains, receives, sells,
33-or uses a part or combination of parts designed and intended
34-to convert a pistol into a machine gun is guilty of a Class
35-C felony.
36-(c)This section does not apply to any of the following:
37-(1)A state or local law enforcement officer while
38-acting in an official capacity.
39-(2)A person who owns or has in his or her possession,
40-control, care, or custody a firearm, part, or combination of
41-parts that are registered in the National Firearms
35+or uses a combination of parts designed or intended to
36+convert a pistol into a machine gun is guilty of a Class C
37+felony.

68+(c)This section does not apply to any of the following:
69+(1)A state or local law enforcement officer while
70+acting in an official capacity.
71+(2)A person who owns or has in his or her possession,
72+control, care, or custody a firearm, part, or combination of
7173 parts that are registered in the National Firearms
7274 Registration and Transfer Record maintained by the Bureau of
7375 Alcohol, Tobacco, Firearms, and Explosives or is otherwise
7476 not subject to that registration requirement.
7577 (3)Any part, combination of parts, or device designed
7678 or intended to increase a pistol’s rate of fire but that
7779 does not enable a semiautomatic pistol to fire more than two
7880 shots, without manual reloading, by a single function of the
7981 trigger.
8082 Section 2. Although this bill would have as its purpose
8183 or effect the requirement of a new or increased expenditure of
8284 local funds, the bill is excluded from further requirements
8385 and application under Section 111.05 of the Constitution of
8486 Alabama of 2022, because the bill defines a new crime or
8587 amends the definition of an existing crime.
86-Section 3. This act shall become effective immediately.
88+Section 3. This act shall become effective on October
89+1, 2025.
