1515 SYNOPSIS:
1616 Under existing law, unlawful distribution of a
1717 controlled substance is a nonviolent offense and is
1818 subject to the presumptive sentencing guidelines.
1919 Under existing law, unlawful distribution of a
2020 controlled substance includes selling, furnishing,
2121 giving away, delivering, or otherwise distributing a
2222 controlled substance in an unauthorized manner.
2323 This bill would differentiate between: (i) the
2424 unlawful selling of a controlled substance (ii) the
2525 unlawful furnishing, giving away, or delivering of a
2626 controlled substance.
2727 This bill would establish that the unlawful sale
2828 of a controlled substance is a violent offense and
2929 therefore not subject to the presumptive sentencing
3030 guidelines.
3131 Under existing law, unlawful distribution of a
3232 controlled substance includes the distribution of any
3333 controlled substance enumerated in Schedules I through
3434 V.
3535 This bill would exclude marijuana from the
3636 unlawful distribution of a controlled substance
3737 statute.
3838 This bill would create the crime of unlawful
3939 distribution of marijuana and would provide for

6969 distribution of marijuana and would provide for
7070 penalties for a violation.
7171 Under existing law, if a person is convicted of
7272 unlawful distribution of a controlled substance that
7373 occurred on or near a school campus or within a
7474 three-mile radius of a public housing project, the
7575 sentencing judge shall impose an additional penalty of
7676 five years to be run consecutive with the sentence for
7777 the underlying conviction.
7878 This bill would provide that a judge may impose
7979 an additional five-year penalty if the distribution of
8080 the controlled substance occurred on or near a school
8181 campus or within a three-mile radius of a public
8282 housing project.
8383 This bill would also make nonsubstantive,
8484 technical revisions to update the existing code
8585 language to current style.

133133 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
134134 Section 1. Sections 12-25-32 and 13A-12-211, Code of
135135 Alabama 1975, are amended to read as follows:
136136 "§12-25-32
137137 For the purposes of this article, the following terms
138138 have the following meanings:
139139 (1) COMMISSION. The Alabama Sentencing Commission,
140140 established as a state agency under the Supreme Court by this
141141 chapter.
142142 (2) CONTINUUM OF PUNISHMENTS. An array of punishment
143143 options, from probation to incarceration, graduated in
144144 restrictiveness according to the degree of supervision of the
145145 offender including, but not limited to, all of the following:
146146 a. Active Incarceration. A sentence, other than an
147147 intermediate punishment or unsupervised probation, that
148148 requires an offender to serve a sentence of imprisonment. The
149149 term includes time served in a work release program operated
150150 as a custody option by the Alabama Department of Corrections
151151 or in the Supervised Intensive Restitution program of the
152152 Department of Corrections pursuant to Article 7 , commencing

184184 b. Intermediate Punishment. A sentence that may include
185185 assignment to any community based punishment program or may

187187 with a period of confinement. Intermediate punishments
188188 include, but are not limited to, all of the following options:
189189 1. A split sentence pursuant to Section 15-18-8.
190190 2. Assignment to a community punishment and corrections
191191 program pursuant to the Alabama Community Punishment and
192192 Corrections Act, Article 9 of Chapter 18 of Title 15 or local
193193 acts.
194194 3. Assignment to a community based manual labor work
195195 program pursuant to Sections 14-5-30 to 14-5-37,
196196 inclusiveArticle 2 of Chapter 5 of Title 14 .
197197 4. Intensive probation supervision pursuant to Section
198198 15-22-56.
199199 5. Cognitive and behavioral training.

254254 (i) Victim impact panels.
255255 (ii) Voluntary victim offender conferencing.
256256 (iii) Voluntary victim offender mediation.
257257 24. Self-help groups.
258258 25. Sobrietor or breath alcohol remote monitoring.
259259 26. Substance abuse education and treatment.
260260 27. Treatment alternatives to street crime (TASC).
261261 28. Voice recognition, curfew restriction, or
262262 employment monitoring.
263263 29. Work release, other than those work release
264264 programs operated by the Alabama Department of Corrections, as
265265 a custody option.
266266 c. Unsupervised Probation. A sentence in a criminal
267267 case that includes a period of probation but does not include
268268 supervision, active incarceration, or an intermediate

300300 d. Post-release Supervision. A mandatory period of
301301 supervision following sentences of active incarceration as
302302 defined in paragraph a. that may include one or more
303303 intermediate punishment options.
304304 (3) COURT. Unless otherwise stated, a district or
305305 circuit court exercising jurisdiction to sentence felony
306306 offenders.
307307 (4) EVIDENCE-BASED PRACTICES. Policies, procedures,
308308 programs, and practices proven by widely accepted and
309309 published research to reliably produce reductions in
310310 recidivism.
311311 (5) FELONY OFFENSE. A noncapital felony offense.
312312 (6) INITIAL VOLUNTARY STANDARDS. The voluntary
313313 sentencing standards effective on October 1, 2006. These
314314 standards were based on statewide historic sentences imposed
315315 with normative adjustments designed to reflect current
316316 sentencing policies.
317317 (7) NONVIOLENT OFFENSE. All offenses which are not
318318 violent offenses.
319319 (8) NONVIOLENT OFFENDER. Any offender who does not
320320 qualify as a violent offender pursuant to subdivision (14).
321321 (9) OFFENDER. A person convicted of a noncapital felony
322322 offense.
323323 (10) RELEASE AUTHORITY. Any public official, agency, or
324324 other entity authorized by law to release a sentenced offender
325325 from incarceration or other conditions of a sentence.
326326 (11) VALIDATED RISK AND NEEDS ASSESSMENT. An actuarial

356356 (11) VALIDATED RISK AND NEEDS ASSESSMENT. An actuarial
357357 tool that has been validated and established by administrative
358358 rule in Alabamathis state to determine the likelihood of an
359359 offender engaging in future criminal behavior. The Board of
360360 Pardons and Paroles and the Department of Corrections shall
361361 adopt compatible tools to conduct a validated risk and needs
362362 assessment upon offenders within the jurisdiction of the
363363 state. A validated risk and needs assessment shall include,
364364 but not be limited to, an offender's prior criminal history,
365365 the nature and severity of the present offense, and potential
366366 for future violence.
367367 (12) TRUTH-IN-SENTENCING STANDARDS. Truth in sentencing
368368 is scheduled to become effective October 1, 2020.
369369 (13) UNDER SUPERVISION. All offendersOffenders under
370370 the supervision of any criminal justice agency or program
371371 including, but not limited to, any of the following entities:
372372 a. The Alabama Department of Corrections.
373373 b. State or county probation offices.
374374 c. Community corrections programs pursuant to Alabama
375375 Community Corrections Act.
376376 d. Jails.
377377 e. State or local law enforcement agencies.
378378 f. Any court.
379379 (14) VIOLENT OFFENDER. A violent offender is an An
380380 offender who has been convicted of a violent offense, or who
381381 is determined by the trial court judge or a release authority
382382 to have demonstrated a propensity for violence, aggression, or
383383 weapons related behavior based on the criminal history or
384384 behavior of the offender while under supervision of any

416416 (15) VIOLENT OFFENSE.
417417 a. For the purposes of this article, a violent offense
418418 includes each of the following offenses, or any substantially
419419 similar offense to those listed in this subdivision created
420420 after June 20, 2003:
421421 1. Capital murder pursuant to Sections 13A-6-2 and
422422 13A-5-40.
423423 2. Murder pursuant to Section 13A-6-2.
424424 3. Manslaughter pursuant to Section 13A-6-3.
425425 4. Criminally negligent homicide pursuant to Section
426426 13A-6-4.
427427 5. Assault Iin the first degree pursuant to Section
428428 13A-6-20.
429429 6. Assault IIin the second degree pursuant to Section
430430 13A-6-21.
431431 7. Compelling street gang membership pursuant to

651651 c. Any attempt, conspiracy, or solicitation to commit a
652652 violent offense shall be considered a violent offense for the
653653 purposes of this article.

657657 (a) A person commits the crime of unlawful distribution
658658 of controlled substances if, except as otherwise authorized,
659659 he or she sells, furnishes, gives away, delivers, or
660660 distributes does either of the following:
661661 (1) Sells a controlled substance enumerated in
662662 Schedules I through V, excluding marijuana. For the purpose of
663663 this subdivision, "sells" means to exchange a controlled
664664 substance enumerated in Schedules I through V, excluding
665665 marijuana, for money or its equivalent.
666666 (2) Furnishes, gives away, delivers, or otherwise
667667 distributes a controlled substance enumerated in Schedules I
668668 through V, excluding marijuana .
669669 (b) Unlawful distribution of controlled substances is a
670670 Class B felony.
671671 (c) A person commits the crime of unlawful possession
672672 with intent to distribute a controlled substance if, except as
673673 otherwise authorized by law, he or she knowingly possesses any
674674 of the following quantities of a controlled substance:

717717 (4) More than eight grams, but less than 28 grams, of
718718 5-methoxy-3, 4-methylenedioxy
719719 amphetamine5-methoxy-3,4-methylenedioxyamphetamine , or of any
720720 mixture containing 5-methoxy-3, 4-methylenedioxy
721721 amphetamine5-methoxy-3,4-methylenedioxyamphetamine .
722722 (5) More than eight grams, but less than 28 grams, of
723723 amphetamine or any mixture containing amphetamine, its salt,
724724 optical isomer, or salt of its optical isomer thereof.
725725 (6) More than eight grams, but less than 28 grams, of
726726 methamphetamine or any mixture containing methamphetamine, its
727727 salts, optical isomers, or salt of its optical isomers
728728 thereof.
729729 (7) More than one-half gram, but less than one gram, of
730730 Fentanyl or any synthetic controlled substance Fentanyl
731731 analogue, as a single component.
732732 (d) Unlawful possession with intent to distribute a

770770 corrections facility with no provision for probation if the
771771 situs of suchthe unlawful sale was on the campus or within a
772772 three-mile radius of the campus boundaries of any public or
773773 private school, college, university , or other educational
