1717 SYNOPSIS:
1818 Under existing law, a civil action for an injury
1919 to an individual that involves certain sex offenses
2020 must be brought within six years.
2121 This bill would expand the statute of
2222 limitations for certain sex offenses.

2525 AN ACT
2626 Relating to commencement of actions; to amend Section
2727 6-2-8, Code of Alabama 1975; to further provide for the
2828 statute of limitations for civil actions involving certain sex
2929 offenses.
3030 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3131 Section 1. Section 6-2-8, Code of Alabama 1975, is
3232 amended to read as follows:
3333 "ยง6-2-8
3434 (a) If anyone entitled to commence any of the actions
3535 enumerated in this chapter, to make an entry on land , or to
3636 enter a defense founded on the title to real property is, at
3737 the time the right accrues , is below the age of 19 years of
3838 age, or insane, he or she shall have three years, or the

6868 age, or insane, he or she shall have three years, or the
6969 period allowed by law for the commencement of an action if it
7070 be less than three years, after the termination of the
7171 disability to commence an the action, make entry, or defend.
7272 No disability shall extend the period of limitations so as to
7373 allow an action to be commenced, entry made, or defense made
7474 after the lapse of 20 years from the time the claim or right
7575 accrued. Nothing in this section shall be interpreted as
7676 denying any imprisoned person the right to commence an action
7777 enumerated in this chapter and to make any proper appearances
7878 on his or her behalf in such actions.
7979 (b)(1) If anyone entitled to commence any of the
8080 actions enumerated in this chapter is, at the time the right
8181 accrues, is below the age of 19 years, of age or insane, and
8282 the injury upon which the action is based arises from a sex
8383 offense as described in Section 15-20A-5, he or she shall have
8484 six 36 years after the termination of the disability to
8585 commence the action.
8686 (c) When both disabilities coexist at the time the
8787 claim accrued, the limitation does not attach until both are
8888 removed.
8989 (d) A disability which that did not exist when a claim
9090 accrued does not suspend the operation of the limitation
9191 unless the contrary is expressly provided."
9292 Section 2. This act shall become effective on October
9393 1, 2025.
