17	17	SYNOPSIS:
18	18	Under existing law, a civil action for an injury
19	19	to an individual that involves certain sex offenses
20	20	must be brought within six years.
21	21	This bill would expand the statute of
22	22	limitations for certain sex offenses.
23	23	A BILL
24	24	TO BE ENTITLED
25	25	AN ACT
26	26	Relating to commencement of actions; to amend Section
27	27	6-2-8, Code of Alabama 1975; to further provide for the
28	28	statute of limitations for civil actions involving certain sex
29	29	offenses.
30	30	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
31	31	Section 1. Section 6-2-8, Code of Alabama 1975, is
32	32	amended to read as follows:
33	33	"§6-2-8
34	34	(a) If anyone entitled to commence any of the actions
35	35	enumerated in this chapter, to make an entry on land , or to
36	36	enter a defense founded on the title to real property is, at
37	37	the time the right accrues , is below the age of 19 years of
38	38	age, or insane, he or she shall have three years, or the

68	68	age, or insane, he or she shall have three years, or the
69	69	period allowed by law for the commencement of an action if it
70	70	be less than three years, after the termination of the
71	71	disability to commence an the action, make entry, or defend.
72	72	No disability shall extend the period of limitations so as to
73	73	allow an action to be commenced, entry made, or defense made
74	74	after the lapse of 20 years from the time the claim or right
75	75	accrued. Nothing in this section shall be interpreted as
76	76	denying any imprisoned person the right to commence an action
77	77	enumerated in this chapter and to make any proper appearances
78	78	on his or her behalf in such actions.
79	79	(b)(1) If anyone entitled to commence any of the
80	80	actions enumerated in this chapter is, at the time the right
81	81	accrues, is below the age of 19 years, of age or insane, and
82	82	the injury upon which the action is based arises from a sex
83	83	offense as described in Section 15-20A-5, he or she shall have
84	84	six 36 years after the termination of the disability to
85	85	commence the action.
86	86	(c) When both disabilities coexist at the time the
87	87	claim accrued, the limitation does not attach until both are
88	88	removed.
89	89	(d) A disability which that did not exist when a claim
90	90	accrued does not suspend the operation of the limitation
91	91	unless the contrary is expressly provided."
92	92	Section 2. This act shall become effective on October
93	93	1, 2025.
