17	17	SYNOPSIS:
18	18	Under existing law, persons are prohibited from
19	19	possessing certain firearms.
20	20	This bill would prohibit a person from
21	21	knowingly possessing a machine gun, including the
22	22	frame or receiver of any such weapon, any part
23	23	intended to convert a firearm into a machine gun, and
24	24	parts from which a machine gun may be assembled.
25	25	This bill would provide a criminal penalty for
26	26	violating this prohibition.

28	28	TO BE ENTITLED
29	29	AN ACT
30	30	Relating to firearms; to prohibit the knowing
31	31	possession of a machine gun, the frame or receiver of such a
32	32	weapon, a part or parts intended to convert a firearm into a
33	33	machine gun, and parts from which a machine gun may be
34	34	assembled; and to provide a criminal penalty for violations.
35	35	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
36	36	Section 1. (a) For the purposes of this section, the
37	37	term "machine gun" means any weapon that shoots, is designed

67	67	term "machine gun" means any weapon that shoots, is designed
68	68	to shoot, or can be readily restored to shoot, automatically
69	69	more than one shot, without manual reloading, by a single
70	70	function of the trigger. The term includes the frame or
71	71	receiver of any such weapon, any part or combination of parts
72	72	designed and intended for use in converting a weapon into a
73	73	machine gun, and any combination of parts from which a machine
74	74	gun may be assembled if the parts are in the possession or
75	75	under the control of a person.
76	76	(b) No person shall knowingly have in his or her
77	77	possession, control, care, or custody a machine gun.
78	78	(c) A violation of subsection (b) is a Class C felony.
79	79	(d) This section does not apply to either of the
80	80	following:
81	81	(1) A state or local law enforcement officer while
82	82	acting in an official capacity.
83	83	(2) Any machine gun lawfully owned or possessed
84	84	pursuant to federal law.
85	85	Section 2. This act shall become effective on October
86	86	1, 2025.
