1717 SYNOPSIS:
1818 Under existing law, persons are prohibited from
1919 possessing certain firearms.
2020 This bill would prohibit a person from
2121 knowingly possessing a machine gun, including the
2222 frame or receiver of any such weapon, any part
2323 intended to convert a firearm into a machine gun, and
2424 parts from which a machine gun may be assembled.
2525 This bill would provide a criminal penalty for
2626 violating this prohibition.

2929 AN ACT
3030 Relating to firearms; to prohibit the knowing
3131 possession of a machine gun, the frame or receiver of such a
3232 weapon, a part or parts intended to convert a firearm into a
3333 machine gun, and parts from which a machine gun may be
3434 assembled; and to provide a criminal penalty for violations.
3535 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
3636 Section 1. (a) For the purposes of this section, the
3737 term "machine gun" means any weapon that shoots, is designed

6767 term "machine gun" means any weapon that shoots, is designed
6868 to shoot, or can be readily restored to shoot, automatically
6969 more than one shot, without manual reloading, by a single
7070 function of the trigger. The term includes the frame or
7171 receiver of any such weapon, any part or combination of parts
7272 designed and intended for use in converting a weapon into a
7373 machine gun, and any combination of parts from which a machine
7474 gun may be assembled if the parts are in the possession or
7575 under the control of a person.
7676 (b) No person shall knowingly have in his or her
7777 possession, control, care, or custody a machine gun.
7878 (c) A violation of subsection (b) is a Class C felony.
7979 (d) This section does not apply to either of the
8080 following:
8181 (1) A state or local law enforcement officer while
8282 acting in an official capacity.
8383 (2) Any machine gun lawfully owned or possessed
8484 pursuant to federal law.
8585 Section 2. This act shall become effective on October
8686 1, 2025.
