This bill would prohibit a person from knowingly possessing a machine gun, including the frame or receiver of any such weapon, any part intended to convert a firearm into a machine gun, and parts from which a machine gun may be assembled. This bill would provide a criminal penalty for violating this prohibition. A BILL TO BE ENTITLED AN ACT Relating to firearms; to prohibit the knowing possession of a machine gun, the frame or receiver of such a weapon, a part or parts intended to convert a firearm into a machine gun, and parts from which a machine gun may be assembled; and to provide a criminal penalty for violations. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. (a) For the purposes of this section, the term "machine gun" means any weapon that shoots, is designed 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SB31 INTRODUCED Page 2 term "machine gun" means any weapon that shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot, without manual reloading, by a single function of the trigger. The term includes the frame or receiver of any such weapon, any part or combination of parts designed and intended for use in converting a weapon into a machine gun, and any combination of parts from which a machine gun may be assembled if the parts are in the possession or under the control of a person. (b) No person shall knowingly have in his or her possession, control, care, or custody a machine gun. (c) A violation of subsection (b) is a Class C felony. (d) This section does not apply to either of the following: (1) A state or local law enforcement officer while acting in an official capacity.
