18	18	Relating to Barbour County; to amend Section
19	19	45-3-84.40, Code of Alabama 1975, to further provide for the
20	20	compensation of the judge of probate.
21	21	BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
22	22	Section 1. Section 45-3-84.40, Code of Alabama 1975, is
23	23	amended to read as follows:
24	24	"§45-3-84.40
25	25	(a) Commencing with the next term of office Beginning
26	26	October 1, 2025, in lieu of any other fees, compensation, or
27	27	expense allowances, the Judge of Probate of Barbour County
28	28	shall receive the an annual salary determined by the Barbour
29	29	County Commission, but in no event in an amount not less than
30	30	the minimum salary provided by general law for judges of
31	31	probateequal to 70 percent of the salary paid to a state
32	32	district court judge with equivalent years of service,
33	33	including any increases in salary due to years of service or
34	34	cost-of-living adjustments . The salary shall be paid in equal
35	35	monthly installments in the same manner as county employees
36	36	are paid.
37	37	(b) Commencing October 1, 1997, after ratification of

67	67	(b) Commencing October 1, 1997, after ratification of
68	68	the proposed constitutional amendment relating to Barbour
69	69	County and the compensation of the judge or probate in the
70	70	current session of the Legislature, the judge or probate shall
71	71	receive a salary in the amount equal to the payment of all
72	72	fees, expenses, and compensation currently paid to the Judge
73	73	of Probate of Barbour County, not to exceed seventy-five
74	74	thousand dollars ($75,000) per year. The annual salary shall
75	75	be paid in equal monthly installments in the same manner as
76	76	county employees are paid and shall be in lieu of any fees or
77	77	expense allowances. The salary of the judge of probate shall be
78	78	increased any time and in the same manner as the salary of a
79	79	state district court judge having the same number of
80	80	cumulative years of service.
81	81	(c) Commencing October 1, 1997, all fees, charges, and
82	82	compensation currently payable to the judge of probate shall
83	83	be paid into the county general fund and all expenses and
84	84	costs for the operation of the Office of the Judge of Probate
85	85	of Barbour County shall be paid by the county commission from
86	86	county fundsThe salary provided by this section shall be in
87	87	lieu of any and all other prior compensation or salary
88	88	provided by law to the judge of probate, and shall be paid in
89	89	equal periodic installments from the county general fund .
90	90	(d) In order to receive the compensation provided in
91	91	this section, the judge of probate shall waive any
92	92	compensation provided under Section 17-3-60, relating to
93	93	reports from the state voter registration list.
94	94	(e) The judge of probate shall be entitled to
95	95	reimbursement of expenses related to travel in the same manner
