1818 Relating to Barbour County; to amend Section
1919 45-3-84.40, Code of Alabama 1975, to further provide for the
2020 compensation of the judge of probate.
2121 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
2222 Section 1. Section 45-3-84.40, Code of Alabama 1975, is
2323 amended to read as follows:
2424 "§45-3-84.40
2525 (a) Commencing with the next term of office Beginning
2626 October 1, 2025, in lieu of any other fees, compensation, or
2727 expense allowances, the Judge of Probate of Barbour County
2828 shall receive the an annual salary determined by the Barbour
2929 County Commission, but in no event in an amount not less than
3030 the minimum salary provided by general law for judges of
3131 probateequal to 70 percent of the salary paid to a state
3232 district court judge with equivalent years of service,
3333 including any increases in salary due to years of service or
3434 cost-of-living adjustments . The salary shall be paid in equal
3535 monthly installments in the same manner as county employees
3636 are paid.
3737 (b) Commencing October 1, 1997, after ratification of

6767 (b) Commencing October 1, 1997, after ratification of
6868 the proposed constitutional amendment relating to Barbour
6969 County and the compensation of the judge or probate in the
7070 current session of the Legislature, the judge or probate shall
7171 receive a salary in the amount equal to the payment of all
7272 fees, expenses, and compensation currently paid to the Judge
7373 of Probate of Barbour County, not to exceed seventy-five
7474 thousand dollars ($75,000) per year. The annual salary shall
7575 be paid in equal monthly installments in the same manner as
7676 county employees are paid and shall be in lieu of any fees or
7777 expense allowances. The salary of the judge of probate shall be
7878 increased any time and in the same manner as the salary of a
7979 state district court judge having the same number of
8080 cumulative years of service.
8181 (c) Commencing October 1, 1997, all fees, charges, and
8282 compensation currently payable to the judge of probate shall
8383 be paid into the county general fund and all expenses and
8484 costs for the operation of the Office of the Judge of Probate
8585 of Barbour County shall be paid by the county commission from
8686 county fundsThe salary provided by this section shall be in
8787 lieu of any and all other prior compensation or salary
8888 provided by law to the judge of probate, and shall be paid in
8989 equal periodic installments from the county general fund .
9090 (d) In order to receive the compensation provided in
9191 this section, the judge of probate shall waive any
9292 compensation provided under Section 17-3-60, relating to
9393 reports from the state voter registration list.
9494 (e) The judge of probate shall be entitled to
9595 reimbursement of expenses related to travel in the same manner
