BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. Section 45-3-84.40, Code of Alabama 1975, is amended to read as follows: "§45-3-84.40 (a) Commencing with the next term of office Beginning October 1, 2025, in lieu of any other fees, compensation, or expense allowances, the Judge of Probate of Barbour County shall receive the an annual salary determined by the Barbour County Commission, but in no event in an amount not less than the minimum salary provided by general law for judges of probateequal to 70 percent of the salary paid to a state district court judge with equivalent years of service, including any increases in salary due to years of service or cost-of-living adjustments . The salary shall be paid in equal monthly installments in the same manner as county employees are paid. (b) Commencing October 1, 1997, after ratification of 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SB331 INTRODUCED Page 2 (b) Commencing October 1, 1997, after ratification of the proposed constitutional amendment relating to Barbour County and the compensation of the judge or probate in the current session of the Legislature, the judge or probate shall receive a salary in the amount equal to the payment of all fees, expenses, and compensation currently paid to the Judge of Probate of Barbour County, not to exceed seventy-five thousand dollars ($75,000) per year. The annual salary shall be paid in equal monthly installments in the same manner as county employees are paid and shall be in lieu of any fees or expense allowances. The salary of the judge of probate shall be increased any time and in the same manner as the salary of a state district court judge having the same number of cumulative years of service. (c) Commencing October 1, 1997, all fees, charges, and compensation currently payable to the judge of probate shall be paid into the county general fund and all expenses and costs for the operation of the Office of the Judge of Probate of Barbour County shall be paid by the county commission from county fundsThe salary provided by this section shall be in lieu of any and all other prior compensation or salary provided by law to the judge of probate, and shall be paid in equal periodic installments from the county general fund . (d) In order to receive the compensation provided in this section, the judge of probate shall waive any compensation provided under Section 17-3-60, relating to reports from the state voter registration list.
