1717 SYNOPSIS:
1818 Under existing law, a person commits the crime
1919 of sexual extortion if he or she knowingly causes or
2020 attempts to cause another person to engage in a sexual
2121 act or to produce any photograph, digital image, video,
2222 film, or other recording of any person, whether
2323 recognizable or not, engaged in any sexual conduct by
2424 communicating any threat to injure the body, property,
2525 or reputation of any person.
2626 This bill would further provide that a person
2727 commits the crime of sexual extortion if he or she
2828 knowingly threatens to release or transmit any
2929 photograph, digital image, video, film, or other
3030 recording of any individual, whether recognizable or
3131 not, engaged in any act of sexually explicit conduct in
3232 order to compel or attempt to compel the victim to do
3333 any act or refrain from doing any act against his or
3434 her will.

6868 Relating to crimes and offenses; to amend Section
6969 13A-6-241; to add additional activity that would constitute
7070 the crime of sexual extortion.
7171 BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
7272 Section 1. Section 13A-6-241, Code of Alabama 1975, is
7373 amended to read as follows:
7474 "ยง13A-6-241
7575 (a) A person commits the crime of sexual extortion if
7676 he or she does any of the following:
7777 (1) knowingly Knowingly causes or attempts to cause
7878 another person individual to engage in sexual intercourse,
7979 sodomy, sexual contact, or in a sexual act sexually explicit
8080 conduct by communicating any threat to injure the body,
8181 property, or reputation of any individual.
8282 (2) or Knowingly causes or attempts to cause another
8383 individual to produce any photograph, digital image, video,
8484 film, or other recording of any personindividual, whether
8585 recognizable or not, engaged in any act of sadomasochistic
8686 abuse, sexual intercourse, sodomy, sexual excitement,
8787 masturbation, breast nudity, genital nudity, or other sexual
8888 conduct sexually explicit conduct by communicating any threat
8989 to injure the body, property, or reputation of any
9090 personindividual.
9191 (3) Knowingly threatens to release or transmit any
9292 photograph, digital image, video, film, or other recording of
9393 any individual, whether recognizable or not, engaged in any
9494 act of sexually explicit conduct in order to compel or attempt
9595 to compel the victim to do any act or refrain from doing any
9696 act against his or her will.

127127 (b) Sexual extortion is a Class B felony .
128128 (c) For the purposes of this section, the term
129129 "sexually explicit conduct" has the same meaning as defined in
130130 Section 13A-12-190 ."
131131 Section 2. This act shall become effective on October
