254253 SECTION 5. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code Title 6, 10
255254 Chapter 65, Subchapter 2, is amended to add an additional section to codify 11
256255 special language in appropriation acts to read as follows: 12
257256 6-65-227. Henderson State University — Community Education Center 13
258257 funding. 14
259258 Funds allocated by the Board of Trustees of the Arkansas State 15
260259 University System for the Community Education Center at Henderson State 16
261260 University shall be used exclusively for: 17
262261 (1) The operation and maintenance of the Community Education 18
263262 Center; and 19
264263 (2) To teach technical and indu strial subjects to citizens and 20
265264 employers. 21

267266 SECTION 6. DO NOT CODIFY. NOT TO BE INCORPORATED INTO THE ARKANSAS 23
268267 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FISCAL 24
269268 YEAR 2020 BUDGET STABILIZATION LOAN REPAYMENT. 25
270269 (a) It is the intent of this section to provide for the repayment by 26
271270 Henderson State University of a loan received from the Budget Stabilization 27
272271 Trust Fund in fiscal year 2020. 28
273272 (b) As repayment for the outstanding loan received from the Budget 29
274273 Stabilization Trust Fund in fiscal year 2020, Henderson State University 30
275274 shall make payments of nine hundred fifty -eight thousand three hundred 31
276275 thirty-three dollars and thirty -three cents ($958,333.33) from any legal fund 32
277276 of Henderson State University to the Budg et Stabilization Trust Fund on the 33
278277 following dates unless modifications are made under subsection (d) of this 34
279278 section: 35

290289 (c) Henderson State University shall provide a report to the 6
291290 Legislative Council or, if the General Assembly is in regular, fiscal, or 7
292291 extraordinary session, the Joint Budget Committee, no later than June 30 of 8
293292 each year regarding the status of the loan received from the Budget 9
294293 Stabilization Trust Fund. 10
295294 (d)(1) Loan payments under subsection (b) of this section may be 11
296295 modified by the Legislative Council or, if the General Assembly is in 12
297296 regular, fiscal, or extraordinary sessio n, the Joint Budget Committee, based 13
298297 upon its review of the status of the loan received from the Budget 14
299298 Stabilization Trust Fund. 15
300299 (2) A modification to a loan payment under subdivision (2)(A) of 16
301300 this section may include without limitation: 17
302301 (A) The amount of one (1) or more loan payments; and 18
303302 (B) The timing of one (1) or more loan payments. 19
304303 (e) This section shall expire upon the final payment by Henderson 20
305304 State University to the Budget Stabilization Trust Fund under subsection (b) 21
306305 of this section. 22

308307 SECTION 7. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 24
309308 authorized by this act shall be limited to the appropriation for such agency 25
310309 and funds made available by law for the support of such appropriations; and 26
311310 the restrictions of the State Procurement Law, the General Accounting and 27
312311 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 28
313312 Procedures and Restrictions Act, the Higher Education Expenditure Restriction 29
314313 Act, or their successors, and other fiscal control laws o f this State, where 30
315314 applicable, and regulations promulgated by the Department of Finance and 31
316315 Administration, as authorized by law, shall be strictly complied with in 32
317316 disbursement of said funds. 33

319318 SECTION 8. LEGISLATIVE INTENT. It is the intent of the General 35

325324 contained in this act shall be in compliance with the stated reasons for 1
326325 which this act was adopted, as evidenced by the Agen cy Requests, Executive 2
327326 Recommendations and Legislative Recommendations contained in the budget 3
328327 manuals prepared by the Department of Finance and Administration, letters, or 4
329328 summarized oral testimony in the official minutes of the Arkansas Legislative 5
330329 Council or Joint Budget Committee which relate to its passage and adoption. 6

332331 SECTION 9. EMERGENCY CLAUSE. It is found and determined by the General 8
333332 Assembly, that the Constitution of the State of Arkansas prohibits the 9
334333 appropriation of funds for more than a o ne (1) year period; that the 10
335334 effectiveness of this Act on July 1, 2023 is essential to the operation of 11
336335 the agency for which the appropriations in this Act are provided, and that in 12
337336 the event of an extension of the legislative session, the delay in the 13
338337 effective date of this Act beyond July 1, 2023 could work irreparable harm 14
339338 upon the proper administration and provision of essential governmental 15
340339 programs. Therefore, an emergency is hereby declared to exist and this Act 16
341340 being necessary for the immediate pres ervation of the public peace, health 17
342341 and safety shall be in full force and effect from and after July 1, 2023. 18
