BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 20

 SECTION 1. REGULAR SALARIES - OPERATIONS.  There is hereby established 22 
for the Henderson State University for the 2023-2024 fiscal year, the 23

 SECTION 2. EXTRA HELP - OPERATIONS.  There is hereby authorized, for 29 
the Henderson State University for the 2023 -2024 fiscal year, the following 30 
maximum number of part-time or temporary employees, to be known as "Extra 31 
Help", payable from funds appropriated herein for such purposes:  five 32 
hundred (500) temporary or part -time employees, when needed, at rates of pay 33 
not to exceed those provided in the Uniform Cla ssification and Compensation 34 
Act, or its successor, or this act for the appropriate classification. 35

 SECTION 5. SPECIAL LANGUAGE — CODE AMENDMENT. Arkansas Code Title 6, 10 
Chapter 65, Subchapter 2, is amended to add an additional section to codify 11 
special language in appropriation acts to read as follows: 12 
 6-65-227.  Henderson State University — Community Education Center 13 
funding. 14 
 Funds allocated by the Board of Trustees of the Arkansas State 15 
University System for the Community Education Center at Henderson State 16 
University shall be used exclusively for: 17 
 (1)  The operation and maintenance of the Community Education 18 
Center; and 19 
 (2)  To teach technical and indu strial subjects to citizens and 20 
employers. 21 
 22 
 SECTION 6.  DO NOT CODIFY.  NOT TO BE INCORPORATED INTO THE ARKANSAS 23 
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.  	FISCAL 24 
YEAR 2020 BUDGET STABILIZATION LOAN REPAYMENT.  25 
 (a)  It is the intent of this section to provide for the repayment by 26 
Henderson State University of a loan received from the Budget Stabilization 27 
Trust Fund in fiscal year 2020.  28 
 (b)  As repayment for the outstanding loan received from the Budget 29 
Stabilization Trust Fund in fiscal year 2020, Henderson State University 30 
shall make payments of nine hundred fifty -eight thousand three hundred 31 
thirty-three dollars and thirty -three cents ($958,333.33) from any legal fund 32 
of Henderson State University to the Budg et Stabilization Trust Fund on the 33 
following dates unless modifications are made under subsection (d) of this 34 
section:   35

 (2)  December 1, 2025; 1 
 (3)  December 1, 2026; 2 
 (4)  December 1, 2027; 3 
 (5)  December 1, 2028; and 4 
 (6)  December 1, 2029.  5 
 (c)  Henderson State University shall provide a report to the 6 
Legislative Council or, if the General Assembly is in regular, fiscal, or 7 
extraordinary session, the Joint Budget Committee, no later than June 30 of 8 
each year regarding the status of the loan received from the Budget 9 
Stabilization Trust Fund.  10 
 (d)(1)  Loan payments under subsection (b) of this section may be 11 
modified by the Legislative Council or, if the General Assembly is in 12 
regular, fiscal, or extraordinary sessio n, the Joint Budget Committee, based 13 
upon its review of the status of the loan received from the Budget 14 
Stabilization Trust Fund. 15 
 (2)  A modification to a loan payment under subdivision (2)(A) of 16 
this section may include without limitation:  17 
 (A)  The amount of one (1) or more loan payments; and 18 
 (B)  The timing of one (1) or more loan payments.   19 
 (e)  This section shall expire upon the final payment by Henderson 20 
State University to the Budget Stabilization Trust Fund under subsection (b) 21 
of this section. 22 
 23 
 SECTION 7. COMPLIANCE WITH OTHER LAWS.  Disbursement of funds 24 
authorized by this act shall be limited to the appropriation for such agency 25 
and funds made available by law for the support of such appropriations; and 26 
the restrictions of the State Procurement Law, the General Accounting and 27 
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 28 
Procedures and Restrictions Act, the Higher Education Expenditure Restriction 29 
Act, or their successors, and other fiscal control laws o f this State, where 30 
applicable, and regulations promulgated by the Department of Finance and 31 
Administration, as authorized by law, shall be strictly complied with in 32 
disbursement of said funds. 33

 SECTION 8. LEGISLATIVE INTENT.  It is the intent of the General 35 
Assembly that any funds disbursed under the authority of the appropriations 36  As Engrossed:  H3/7/23 	HB1270

contained in this act shall be in compliance with the stated reasons for 1 
which this act was adopted, as evidenced by the Agen cy Requests, Executive 2 
Recommendations and Legislative Recommendations contained in the budget 3 
manuals prepared by the Department of Finance and Administration, letters, or 4 
summarized oral testimony in the official minutes of the Arkansas Legislative 5 
Council or Joint Budget Committee which relate to its passage and adoption. 6 
 7 
 SECTION 9. EMERGENCY CLAUSE.  It is found and determined by the General 8 
Assembly, that the Constitution of the State of Arkansas prohibits the 9 
appropriation of funds for more than a o ne (1) year period; that the 10 
effectiveness of this Act on July 1, 2023 is essential to the operation of 11 
the agency for which the appropriations in this Act are provided, and that in 12 
the event of an extension of the legislative session, the delay in the 13 
effective date of this Act beyond July 1, 2023 could work irreparable harm 14 
upon the proper administration and provision of essential governmental 15 
programs. Therefore, an emergency is hereby declared to exist and this Act 16 
being necessary for the immediate pres ervation of the public peace, health 17 
and safety shall be in full force and effect from and after July 1, 2023. 18
