2221 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 18

2423 SECTION 1. Arkansas Code § 16 -17-108 is amended to read as follows: 20
2524 16-17-108. Salaries of personnel and other requirements of various 21
2625 district courts. 22
2726 (a) Unless otherwise provided by law, the salarie s of the judges and 23
2827 other personnel of the various district courts shall be established as 24
2928 follows: 25
3029 (1)(A) The Arkansas County District Court — Northern District 26
3130 Judge shall receive an annual salary of not less than thirty -five thousand 27
3231 dollars ($35,000) nor more than fifty thousand dollars ($50,000) seventy 28
3332 thousand dollars ($70,000) , the district court clerk shall receive an annual 29
3433 salary of not less than thirteen thousand eight hundred thirty -four dollars 30
3534 and ninety-two cents ($13,834.92) thirty thousand dollars ($30,000) nor more 31
3635 than forty-four thousand dollars ($44,000) sixty thousand dollars ($60,000) , 32
3736 and the deputy court clerk shall receive an annual salary of not less than 33
3837 eleven thousand four hundred seventy -five dollars ($11,475) twenty-five 34
3938 thousand dollars ($25,000) nor more than thirty-one thousand dollars 35

4544 (B) The salaries shall be as determined by the governing 1
4645 body of the City of Stuttgart and the Arkansas County Quorum Court and paid 2
4746 one-half (½) by the city and one -half (½) by the county; 3
4847 (2) The Arkansas County District Court — Southern District Judge 4
4948 shall receive an annual salary of not less than twenty -five thousand dollars 5
5049 ($25,000), the district court clerk shall receive an ann ual salary of not 6
5150 less than twenty thousand dollars ($20,000), and the deputy clerk shall 7
5251 receive an annual salary of not less than twenty -three thousand dollars 8

6362 (4)(A) The Ashley County District Court — Hamburg Department 19
6463 Clerk shall receive an annual salary of not less than fifteen thousand 20
6564 dollars ($15,000) thirty thousand dollars ($30,000) nor more than thirty-five 21
6665 thousand dollars ($35,000) fifty thousand dollars ($50,000) . 22
6766 (B) The salary shall be in an amount within the range 23
6867 prescribed in this subdivision (a)(4), as agreed upon by the Ashley County 24
6968 Quorum Court and the governing body of the City of Hamburg; 25
7069 (5) The Baxter County District Court Clerk shall receive 26
7170 compensation in an amount as may be provided by the City of Mountain Home and 27
7271 the Baxter County Quorum Court. The salary shall be paid one -half (½) by the 28
7372 City of Mountain Home and one -half (½) by Baxter County; 29
7473 (6)(A) The Calhoun County District Court Clerk shall receive an 30
7574 annual salary of not less than twelve thousand dollars ($12,000). 31
7675 (B) The salary shall be determined by the Hampton City 32
7776 Council and the Calhoun County Quorum C ourt and shall be paid by the City of 33
7877 Hampton and Calhoun County in equal monthly installments; 34
7978 (7)(A)(i) The Chicot County District Court — Dermott Department 35

8685 (ii) However, the district court clerk's position may 2

8887 (B) The salary shall be in an amount within the range 4
8988 prescribed in subdivision (a)(7)(A)(i) of this sect ion as agreed upon by the 5
9089 Chicot County Quorum Court and the governing body of the City of Dermott. 6
9190 (C) The salary of the district court clerk shall be paid 7
9291 as follows: 8
9392 (i) Fifty percent (50%) to be paid by the City of 9
9493 Dermott; and 10
9594 (ii) Fifty percent (50%) to be paid by Chicot County; 11
9695 (8)(A) The Chicot County District Court — Eudora Department 12
9796 Clerk shall receive an annual salary of not less than fourteen thousand 13
9897 dollars ($14,000) nor more than thirty -five thousand dollars ($35,000). 14
9998 (B) The salary shall be in an amount within the range 15
10099 prescribed in subdivision (a)(8)(A) of this section as agreed upon by the 16
101100 Chicot County Quorum Court and the governing body of the City of Eudora. 17
102101 (C) The salary of the district court clerk shall be paid 18
103102 as follows: 19
104103 (i) Fifty percent (50%) to be paid by the City of 20
105104 Eudora; and 21
106105 (ii) Fifty percent (50%) to be paid by Chicot County; 22
107106 (9)(A)(i) The Chicot County District Court — Lake Village 23
108107 Department Clerk shall receive an annual salary of no t less than fourteen 24
109108 thousand dollars ($14,000) nor more than thirty -five thousand dollars 25
110109 ($35,000). 26
111110 (ii) If authorized by the governing body of the City 27
112111 of Lake Village and the Chicot County Quorum Court, the district court judge 28
113112 shall be authorized to employ a full-time or part-time deputy district court 29
114113 clerk at an annual salary of not less than five thousand dollars ($5,000) nor 30
115114 more than twenty-three thousand dollars ($23,000). 31
116115 (iii) The salaries shall be in an amount within the 32
117116 range prescribed in this subdivision (a)(9)(A), as agreed upon by the Chicot 33
118117 County Quorum Court and the governing body of the City of Lake Village. 34
119118 (B) The salary of the district court clerk shall be paid 35

125124 (i) Fifty percent (50%) to be paid by the City of 1

128127 (10) The Clark County District Court Clerk shall receive an 4
129128 annual salary of not less than thirty-eight thousand dollars ($38,000) forty 5
130129 thousand dollars ($40,000) nor more than forty-five thousand dollars 6
131130 ($45,000), to be established annually by the Clark County Quorum Court. Upon 7
132131 approval by the Clark County Quorum Court, the Clark County District Court 8
133132 Judge may appoint one (1) deputy district court clerk to receive a salary as 9
134133 established by the Clark County Quorum Court; 10
135134 (11)(A) The clerks of the district courts in Clay County shall 11
136135 receive an annual salary of not less than four thousand five hundred dollars 12
137136 ($4,500) nor more than eighteen thousand dollars ($18,00 0), to be paid, as 13
138137 well as other current benefits, in equal monthly installments by Clay County. 14
139138 (B) Fifty percent (50%) of the amount in each respective 15
140139 department shall be reimbursed by the City of Corning, the City of Piggott, 16
141140 and the City of Rector at eighteen and five -tenths percent (18.5%), eighteen 17
142141 and five-tenths percent (18.5%), and thirteen percent (13%), respectively, to 18
143142 the county treasury The salaries and operations of the Clay County District 19
144143 Courts shall be funded through a written interl ocal agreement between Clay 20
145144 County, Greene County, and the respective cities operating a department 21
146145 within Clay County and Greene County ; 22
147146 (12)(A) The Cleveland County District Court Clerk shall receive 23
148147 an annual salary of not less than twelve thousand d ollars ($12,000). 24
149148 (B) The salary shall be determined by the Rison City 25
150149 Council and the Cleveland County Quorum Court; 26
151150 (13) Necessary expenses appropriated for the Craighead County 27
152151 District Court shall be apportioned among and paid to the county from the 28
153152 respective cities of the first class and cities of the second class, 29
154153 incorporated towns, and the government of Craighead County as a prorated 30
155154 amount based on the number of cases filed from each of the towns and cities 31
156155 and the county during the precedi ng calendar year; 32
157156 (14) The Cross County District Court employees' salaries shall 33
158157 be as determined by the governing body of the City of Wynne, the City of 34
159158 Cherry Valley, and the City of Parkin, for the cities' respective 35

165164 (15)(A) The Dallas County District Court Clerks shall 1
166165 receive an annual salary of not less than fifteen thousand dollars ($15,000). 2
167166 (B) The salaries shall be determined by the Fordyce City 3
168167 Council and the Dallas County Quorum Court, and the salaries shall be paid by 4
169168 the City of Fordyce and Dallas County in equal monthly installments; 5
170169 (16)(A) The Desha County District Court — Dumas Department 6
171170 Clerk shall receive an annual salary of not less than eighteen thousand 7
172171 dollars ($18,000) nor more than thirty -five thousand dollars ($35,000), and 8
173172 the deputy district clerk shall receive an annual salary of not less than 9
174173 fourteen thousand five hundred dollars ($14,500) nor more than thirty -five 10
175174 thousand dollars ($35,000). 11
176175 (B) The salary shall be paid one -half (½) by the Desha 12
177176 County Quorum Court and one -half (½) by the City of Dumas and shall be 13
178177 determined by the Desha County Quorum Court and the governing body of the 14
179178 City of Dumas; 15
180179 (17) The Desha County District Court — McGehee Department Clerk 16
181180 shall be employed and paid by the City of McGehee at such a salary as the 17
182181 governing body of the City of McGehee shall determine; 18
183182 (18) The Washington County District Court — Elkins Department 19
184183 Clerk shall receive an annual salary of not less than ten thousand dollars 20
185184 ($10,000) forty thousand dollars ($40,000) nor more than fifty thousand 21
186185 dollars ($50,000) sixty thousand dollars ($60,000) ; 22
187186 (19)(A)(i) The Fulton County District Court Judge shall receive 23
188187 an annual salary of not less than twenty -two thousand dollars ($22,000) nor 24
189188 more than forty-five thousand dollars ($45,000). 25
190189 (ii) The annual salary of the Fulton County District 26
191190 Court Clerk shall be not less than seventeen thousand seven hundred forty -27
192191 eight dollars ($17,748) nor more than thirty -five thousand dollars ($35,000). 28
193192 (B)(i) The expense of salaries, along with all other 29
194193 necessary and customary expenses of the court, shall be shared by Fulton 30
195194 County, the City of Salem, and the City of Mammoth Spring, based on a 31
196195 percentage of the actual number of cases handled throug h the court for each 32
197196 governmental entity. 33
198197 (ii) The percentage shall be determined annually by 34
199198 dividing the total number of cases handled by the district court into the 35

206205 (iii) On January 1 of each year, each share shall be 2
207206 estimated based on the number of cases handled by the district court for each 3
208207 of the respective governmental entities for the preceding year. 4
209208 (iv) However, on December 31 of each year, each 5
210209 share shall be adjusted to reflect the actual percentage for each 6
211210 governmental entity for that year based on the actual case load. 7
212211 (C) The salaries and expenses shall be paid in equal 8
213212 monthly installments by Fulton County, and the City of Salem and the City of 9
214213 Mammoth Spring shall reimburse the county on a monthly basis for their 10
215214 respective shares of salaries and expenses; 11
216215 (20)(A) The Garland County District Court Clerk shall receive an 12
217216 annual salary of not less than twenty -six thousand dollars ($ 26,000) nor more 13
218217 than sixty-eight thousand four hundred dollars ($68,400). 14
219218 (B) The salary shall be determined by the governing body 15
220219 of the City of Hot Springs and the Garland County Quorum Court; 16
221220 (21)(A) The Grant County District Court Clerk shall r eceive an 17
222221 annual salary of not less than twenty -one thousand dollars ($21,000) nor more 18
223222 than thirty-six thousand dollars ($36,000), as approved determined by the 19
224223 Grant County Quorum Court. 20
225224 (B) The district court clerk's salary shall be paid as 21
226225 follows: 22
227226 (i) Twenty-seven percent (27%) to be paid by the 23
228227 City of Sheridan; and 24
229228 (ii) Seventy-three percent (73%) to be paid by Grant 25
230229 County; 26
231230 (22)(A) The Greene County District Court — Paragould District 27
232231 Clerk shall receive an annual salary of not less than nineteen thousand eight 28
233232 hundred fifty-six dollars ($19,856) nor more than fifty thousand dollars 29
234233 ($50,000), the chief deputy district court clerk shall receive an annual 30
235234 salary of not less than sixteen thousand six hundred twenty -four dollars 31
236235 ($16,624) nor more than forty thousand dollars ($40,000), and the deputy 32
237236 district court clerk shall receive an annual salary of not less than thirteen 33
238237 thousand three hundred fourteen dollars ($13,314) nor more than thirty -five 34

257256 Judge shall be entitled to an additional deputy district court clerk whose 13
258257 salary shall be determined by the governing body of the City of Malvern and 14
259258 the Hot Spring County Quorum Court, and the s alary shall be paid by the city 15
260259 and county in the same proportion as the city and county shared in the 16
261260 revenues generated by the court in the previous year; 17
262261 (25)(A)(i) The Howard County District Court Judge shall have an 18
263262 annual salary of not less than t wenty-one thousand dollars ($21,000). 19
264263 (ii) The Howard County District Court Clerk shall 20
265264 receive an annual salary of not less than twelve thousand dollars ($12,000) 21
266265 nor more than forty thousand dollars ($40,000), unless provided for otherwise 22
267266 by ordinance of the Howard County Quorum Court and the governing body of the 23
268267 City of Nashville. 24
269268 (B) The salaries are to be paid one -half (½) by the City 25
270269 of Nashville and one -half (½) by Howard County; 26
271270 (26)(A) The Izard County District Court Judge shall recei ve an 27
272271 annual salary of not less than ten thousand two hundred dollars ($10,200) nor 28

274273 and the district court clerk shall receive an annual salary of not less than 30

293292 (29) The Jefferson County District Court clerks for Division 1 9

296295 ($54,000), as may be approved by the Jefferson County Quorum Court and the 12

298297 (30) The expenses related to the operation of the Johnson County 14
299298 District Court are to be divided among the county and all c ities within the 15
300299 county based on the percentage of the total fine money collected during the 16
301300 year by each participating entity shall be apportioned between Johnson County 17
302301 and any city in Johnson County operating a department by agreement between 18
303302 the governing bodies of the county and the respective cities ; 19
304303 (31)(A) The Lafayette County — Lewisville Department District 20
305304 Court Clerk shall receive an annual salary of not less than twenty -two 21
306305 thousand dollars ($22,000) nor more than thirty -five thousand dollar s 22
307306 ($35,000), and the City of Lewisville shall pay to the district court clerk 23
308307 at least eight thousand eight hundred dollars ($8,800) but not more than 24
309308 fourteen thousand dollars ($14,000) of the salary, and Lafayette County shall 25
310309 pay to the district court c lerk not less than thirteen thousand two hundred 26
311310 dollars ($13,200) but not more than twenty -one thousand dollars ($21,000) of 27
312311 the salary. 28
313312 (B) The amount and manner of payment of the salary of the 29
314313 district court clerk may be established within the range s specified in 30
315314 subdivision (a)(31)(A) of this section by mutual agreement of the Lafayette 31
316315 County Quorum Court and the Lewisville City Council, as well as the amount 32
317316 and manner of payment of all other expenses of operation of the Lafayette 33
318317 County — Lewisville Department District Court; 34
319318 (32)(A) The Little River County District Court Judge shall 35

328327 (B) The salary shall be paid sixty -two percent (62%) by 4
329328 Little River County and thirty -eight percent (38%) by the City of Ashdown, 5
330329 unless otherwise agreed by the Little River County Quorum Court and the 6
331330 governing body of the City of Ashdown; 7
332331 (33)(A) Necessary expenses appropriated by the City of Lonoke 8
333332 for the Lonoke County District Court shall be apportioned among and paid to 9
334333 the City of Lonoke by the cities of the first class, cities of the second 10
335334 class, incorporated towns, and the county as a prorated amount based on the 11
336335 number of cases filed from each of the cities of the first class, cities of 12
337336 the second class, incorporated towns, and the co unty during the preceding 13
338337 year. 14
339338 (B) An itemized bill shall be prepared by the City of 15
340339 Lonoke fixing the apportioned expenses, and payment shall be made no later 16
341340 than sixty (60) days following the submission by the City of Lonoke of the 17
342341 bills; 18
343342 (34)(A) The Maumelle District Court Clerk shall receive an 19
344343 annual salary of not less than seventeen thousand five hundred dollars 20
345344 ($17,500) nor more than fifty thousand dollars ($50,000). 21
346345 (B) The salary of the district court clerk shall be as 22
347346 determined by the City of Maumelle Board of Directors; 23
348347 (35)(A) The Miller County District Court shall have two (2) 24
349348 departments, the City of Texarkana Department and the Miller County 25
350349 Department. 26
351350 (B) The Miller County District Court — City of Texarkana 27
352351 Department shall hear all civil and criminal cases arising out of violations 28
353352 of city ordinances and those cases arising out of violations of state laws 29
354353 committed within the corporate limits of the City of Texarkana and all other 30
355354 cases in controversy arising within the corporate limits of the city within 31
356355 the jurisdiction of a district court as established by law. The Miller County 32
357356 District Court — City of Texarkana Department shall have a chief district 33
358357 court clerk whose salary shall be paid by the City of Texarkana in an amount 34
359358 to be determined by its governing body. 35

366365 of any of the laws of the state committed outside the corporate limits o f the 2
367366 City of Texarkana and all other cases in controversy arising outside the 3
368367 corporate limits of the city within the jurisdiction of a district court as 4
369368 established by law. The Miller County District Court — Miller County 5
370369 Department shall have a chief di strict court clerk whose salary shall be paid 6
371370 by Miller County in an amount to be determined by its quorum court; 7
372371 (36) The Monroe County District Court — Brinkley Department 8
373372 Judge shall receive an annual salary of not less than ten thousand two 9
374373 hundred dollars ($10,200) nor more than forty thousand dollars ($40,000), and 10
375374 the Monroe County District Court — Brinkley Department Court Clerk shall 11
376375 receive an annual salary of not less than ten thousand four hundred eighty -12
377376 eight dollars ($10,488) and not more t han thirty-seven thousand five hundred 13
378377 dollars ($37,500); 14
379378 (37) The Monroe County District Court — Clarendon Department 15
380379 Judge shall receive an annual salary of not less than four thousand eight 16
381380 hundred dollars ($4,800) and the Monroe County District Cour t — Clarendon 17
382381 Department Clerk shall receive an annual salary of not less than eight 18
383382 thousand nine hundred eighty -eight dollars ($8,988); 19
384383 (38)(A) The Montgomery County District Court clerk shall receive 20
385384 an annual salary of not less than nineteen thousan d dollars ($19,000) nor 21
386385 more than twenty-seven thousand dollars ($27,000), and the district court 22
387386 secretary shall receive an annual salary of not less than sixteen thousand 23
388387 dollars ($16,000) nor more than twenty -two thousand dollars ($22,000). 24
389388 (B) Montgomery County shall pay eighty percent (80%) of 25
390389 the salaries, and the City of Mt. Ida shall pay twenty percent (20%) of the 26
391390 salaries; 27
392391 (39)(A) The Nevada County District Court Clerk salary shall be 28
393392 not less than twenty -nine thousand dollars ($29,000) nor more than thirty-29
394393 seven thousand dollars ($37,000). 30
395394 (B) The salary for the district court clerk shall be 31
396395 established within these ranges by the Nevada County Quorum Court and the 32
397396 Prescott City Council, and the salary shall be paid sixty percent (60%) b y 33
398397 Nevada County and forty percent (40%) by the City of Prescott. The salary 34

501500 (50)(A) The Sebastian County District Court — Greenwood District 17

503502 shall be set by the Sebastian County Quorum Court. 19
504503 (B) The salaries shall be paid ninety percent (90%) by 20
505504 Sebastian County and ten percent (10%) by the City of Greenwood. 21
506505 (C) In order to defray the expenses of operating the 22
507506 Sebastian County District Court — Greenwood District, ninety percent (90%) of 23

509508 net fines, and fifteen percent (15%) of all other cities' net fines processed 25

511510 deposited into a bank accoun t entitled the “Greenwood District Court 27
512511 Operating Fund” to be administered by the Sebastian County District Court — 28
513512 Greenwood District Judge under a budget approved as follows: 29
514513 (i) The district court judge shall submit a proposed 30
515514 annual budget to a c ommittee composed of the members of the quorum court that 31
516515 represent the Greenwood District of Sebastian County; 32
517516 (ii) The committee shall approve the district court 33
518517 judge's budget or formulate a reasonable budget that shall be approved by the 34
519518 Sebastian County Quorum Court, unless found by a majority of the quorum court 35
