Stubblefield 6 7 For An Act To Be Entitled 8 AN ACT CONCERNING TH E SALARIES OF VARIOU S DISTRICT 9 COURT PERSONNEL; AND FOR OTHER PURPOSES. 10 11 12 Subtitle 13 CONCERNING THE SALARIES OF VARIOUS 14 DISTRICT COURT PERSONNEL. 15 16 17 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 18 19 SECTION 1. Arkansas Code § 16 -17-108 is amended to read as follows: 20 16-17-108. Salaries of personnel and other requirements of various 21 district courts. 22 (a) Unless otherwise provided by law, the salaries of the judges and 23 other personnel of the various district courts shall be established as 24 follows: 25 (1)(A) The Arkansas County District Court — Northern District 26 Judge shall receive an annual salary of not less than thirty -five thousand 27 dollars ($35,000) nor more than fifty thousand dollars ($50,000) seventy 28 thousand dollars ($70,000) , the district court clerk shall receive an annual 29 salary of not less than thirteen thousand eight hundred thirty -four dollars 30 and ninety-two cents ($13,834.92) thirty thousand dollars ($30,000) nor more 31 than forty-four thousand dollars ($44,000) sixty thousand dollars ($60,000) , 32 and the deputy court clerk shall receive an annual salary of not less than 33 eleven thousand four hundred seventy -five dollars ($11,475) twenty-five 34 thousand dollars ($25,000) nor more than thirty-one thousand dollars 35 ($31,000) forty-five thousand dollars ($45,000) . 36 As Engrossed: H3/2/23 S3/28/23 HB1522 2 03-28-2023 14:19:14 MBM083 (B) The salaries shall be as determined by the governing 1 body of the City of Stuttgart and the Arkansas County Quorum Court and paid 2 one-half (½) by the city and one -half (½) by the county; 3 (2) The Arkansas County District Court — Southern District Judge 4 shall receive an annual salary of not less than twenty -five thousand dollars 5 ($25,000), the district court clerk shall receive an annua l salary of not 6 less than twenty thousand dollars ($20,000), and the deputy clerk shall 7 receive an annual salary of not less than twenty -three thousand dollars 8 ($23,000). The salaries shall be determined by the governing body of the City 9 of DeWitt and the Arkansas County Quorum Court and paid one -half (½) by the 10 city and one-half (½) by the county; 11 (3)(A) The Ashley County District Court — Crossett Department 12 Clerk shall receive an annual salary of not less than fifteen thousand 13 dollars ($15,000) thirty thousand dollars ($30,000) nor more than thirty-five 14 thousand dollars ($35,000) fifty thousand dollars ($50,000) . 15 (B) The salary shall be in an amount within the range 16 prescribed in this subdivision (a)(3), as agreed upon by the Ashley County 17 Quorum Court and the governing body of the City of Crossett; 18 (4)(A) The Ashley County District Court — Hamburg Department 19 Clerk shall receive an annual salary of not less than fifteen thousand 20 dollars ($15,000) thirty thousand dollars ($30,000) nor more than thirty-five 21 thousand dollars ($35,000) fifty thousand dollars ($50,000) . 22 (B) The salary shall be in an amount within the range 23 prescribed in this subdivision (a)(4), as agreed upon by the Ashley County 24 Quorum Court and the governing body of the City of Hamburg; 25 (5) The Baxter County District Court Clerk shall receive 26 compensation in an amount as may be provided by the City of Mountain Home and 27 the Baxter County Quorum Court. The salary shall be paid one -half (½) by the 28 City of Mountain Home and one -half (½) by Baxter County; 29 (6)(A) The Calhoun County District Court Clerk shall receive an 30 annual salary of not less than twelve thousand dollars ($12,000). 31 (B) The salary shall be determined by the Hampton City 32 Council and the Calhoun County Quorum C ourt and shall be paid by the City of 33 Hampton and Calhoun County in equal monthly installments; 34 (7)(A)(i) The Chicot County District Court — Dermott Department 35 Clerk shall receive an annual salary of not less than fourteen thousand 36 As Engrossed: H3/2/23 S3/28/23 HB1522 3 03-28-2023 14:19:14 MBM083 dollars ($14,000) nor more than thirty-five thousand dollars ($35,000). 1 (ii) However, the district court clerk's position may 2 be a full-time or part-time position. 3 (B) The salary shall be in an amount within the range 4 prescribed in subdivision (a)(7)(A)(i) of this sect ion as agreed upon by the 5 Chicot County Quorum Court and the governing body of the City of Dermott. 6 (C) The salary of the district court clerk shall be paid 7 as follows: 8 (i) Fifty percent (50%) to be paid by the City of 9 Dermott; and 10 (ii) Fifty percent (50%) to be paid by Chicot County; 11 (8)(A) The Chicot County District Court — Eudora Department 12 Clerk shall receive an annual salary of not less than fourteen thousand 13 dollars ($14,000) nor more than thirty -five thousand dollars ($35,000). 14 (B) The salary shall be in an amount within the range 15 prescribed in subdivision (a)(8)(A) of this section as agreed upon by the 16 Chicot County Quorum Court and the governing body of the City of Eudora. 17 (C) The salary of the district court clerk shall be paid 18 as follows: 19 (i) Fifty percent (50%) to be paid by the City of 20 Eudora; and 21 (ii) Fifty percent (50%) to be paid by Chicot County; 22 (9)(A)(i) The Chicot County District Court — Lake Village 23 Department Clerk shall receive an annual salary of no t less than fourteen 24 thousand dollars ($14,000) nor more than thirty -five thousand dollars 25 ($35,000). 26 (ii) If authorized by the governing body of the City 27 of Lake Village and the Chicot County Quorum Court, the district court judge 28 shall be authorized to employ a full-time or part-time deputy district court 29 clerk at an annual salary of not less than five thousand dollars ($5,000) nor 30 more than twenty-three thousand dollars ($23,000). 31 (iii) The salaries shall be in an amount within the 32 range prescribed in this subdivision (a)(9)(A), as agreed upon by the Chicot 33 County Quorum Court and the governing body of the City of Lake Village. 34 (B) The salary of the district court clerk shall be paid 35 as follows: 36 As Engrossed: H3/2/23 S3/28/23 HB1522 4 03-28-2023 14:19:14 MBM083 (i) Fifty percent (50%) to be paid by the City of 1 Lake Village; and 2 (ii) Fifty percent (50%) to be paid by Chicot County; 3 (10) The Clark County District Court Clerk shall receive an 4 annual salary of not less than thirty-eight thousand dollars ($38,000) forty 5 thousand dollars ($40,000) nor more than forty-five thousand dollars 6 ($45,000), to be established annually by the Clark County Quorum Court. Upon 7 approval by the Clark County Quorum Court, the Clark County District Court 8 Judge may appoint one (1) deputy district court clerk to receive a salary as 9 established by the Clark County Quorum Court; 10 (11)(A) The clerks of the district courts in Clay County shall 11 receive an annual salary of not less than four thousand five hundred dollars 12 ($4,500) nor more than eighteen thousand dollars ($18,00 0), to be paid, as 13 well as other current benefits, in equal monthly installments by Clay County. 14 (B) Fifty percent (50%) of the amount in each respective 15 department shall be reimbursed by the City of Corning, the City of Piggott, 16 and the City of Rector at eighteen and five -tenths percent (18.5%), eighteen 17 and five-tenths percent (18.5%), and thirteen percent (13%), respectively, to 18 the county treasury The salaries and operations of the Clay County District 19 Courts shall be funded through a written interl ocal agreement between Clay 20 County, Greene County, and the respective cities operating a department 21 within Clay County and Greene County ; 22 (12)(A) The Cleveland County District Court Clerk shall receive 23 an annual salary of not less than twelve thousand d ollars ($12,000). 24 (B) The salary shall be determined by the Rison City 25 Council and the Cleveland County Quorum Court; 26 (13) Necessary expenses appropriated for the Craighead County 27 District Court shall be apportioned among and paid to the county from the 28 respective cities of the first class and cities of the second class, 29 incorporated towns, and the government of Craighead County as a prorated 30 amount based on the number of cases filed from each of the towns and cities 31 and the county during the precedi ng calendar year; 32 (14) The Cross County District Court employees' salaries shall 33 be as determined by the governing body of the City of Wynne, the City of 34 Cherry Valley, and the City of Parkin, for the cities' respective 35 departments; 36 As Engrossed: H3/2/23 S3/28/23 HB1522 5 03-28-2023 14:19:14 MBM083 (15)(A) The Dallas County District Court Clerks shall 1 receive an annual salary of not less than fifteen thousand dollars ($15,000). 2 (B) The salaries shall be determined by the Fordyce City 3 Council and the Dallas County Quorum Court, and the salaries shall be paid by 4 the City of Fordyce and Dallas County in equal monthly installments; 5 (16)(A) The Desha County District Court — Dumas Department 6 Clerk shall receive an annual salary of not less than eighteen thousand 7 dollars ($18,000) nor more than thirty -five thousand dollars ($35,000), and 8 the deputy district clerk shall receive an annual salary of not less than 9 fourteen thousand five hundred dollars ($14,500) nor more than thirty -five 10 thousand dollars ($35,000). 11 (B) The salary shall be paid one -half (½) by the Desha 12 County Quorum Court and one -half (½) by the City of Dumas and shall be 13 determined by the Desha County Quorum Court and the governing body of the 14 City of Dumas; 15 (17) The Desha County District Court — McGehee Department Clerk 16 shall be employed and paid by the City of McGehee at such a salary as the 17 governing body of the City of McGehee shall determine; 18 (18) The Washington County District Court — Elkins Department 19 Clerk shall receive an annual salary of not less than ten thousand dollars 20 ($10,000) forty thousand dollars ($40,000) nor more than fifty thousand 21 dollars ($50,000) sixty thousand dollars ($60,000) ; 22 (19)(A)(i) The Fulton County District Court Judge shall receive 23 an annual salary of not less than twenty -two thousand dollars ($22,000) nor 24 more than forty-five thousand dollars ($45,000). 25 (ii) The annual salary of the Fulton County District 26 Court Clerk shall be not less than seventeen thousand seven hundred forty -27 eight dollars ($17,748) nor more than thirty -five thousand dollars ($35,00 0). 28 (B)(i) The expense of salaries, along with all other 29 necessary and customary expenses of the court, shall be shared by Fulton 30 County, the City of Salem, and the City of Mammoth Spring, based on a 31 percentage of the actual number of cases handled thr ough the court for each 32 governmental entity. 33 (ii) The percentage shall be determined annually by 34 dividing the total number of cases handled by the district court into the 35 number of cases handled annually for each of the aforementioned governmental 36 As Engrossed: H3/2/23 S3/28/23 HB1522 6 03-28-2023 14:19:14 MBM083 entities. 1 (iii) On January 1 of each year, each share shall be 2 estimated based on the number of cases handled by the district court for each 3 of the respective governmental entities for the preceding year. 4 (iv) However, on December 31 of each year, e ach 5 share shall be adjusted to reflect the actual percentage for each 6 governmental entity for that year based on the actual case load. 7 (C) The salaries and expenses shall be paid in equal 8 monthly installments by Fulton County, and the City of Salem and the City of 9 Mammoth Spring shall reimburse the county on a monthly basis for their 10 respective shares of salaries and expenses; 11 (20)(A) The Garland County District Court Clerk shall receive an 12 annual salary of not less than twenty -six thousand dollars ( $26,000) nor more 13 than sixty-eight thousand four hundred dollars ($68,400). 14 (B) The salary shall be determined by the governing body 15 of the City of Hot Springs and the Garland County Quorum Court; 16 (21)(A) The Grant County District Court Clerk shall receive an 17 annual salary of not less than twenty -one thousand dollars ($21,000) nor more 18 than thirty-six thousand dollars ($36,000), as approved determined by the 19 Grant County Quorum Court. 20 (B) The district court clerk's salary shall be paid as 21 follows: 22 (i) Twenty-seven percent (27%) to be paid by the 23 City of Sheridan; and 24 (ii) Seventy-three percent (73%) to be paid by Grant 25 County; 26 (22)(A) The Greene County District Court — Paragould District 27 Clerk shall receive an annual salary of not les s than nineteen thousand eight 28 hundred fifty-six dollars ($19,856) nor more than fifty thousand dollars 29 ($50,000), the chief deputy district court clerk shall receive an annual 30 salary of not less than sixteen thousand six hundred twenty -four dollars 31 ($16,624) nor more than forty thousand dollars ($40,000), and the deputy 32 district court clerk shall receive an annual salary of not less than thirteen 33 thousand three hundred fourteen dollars ($13,314) nor more than thirty -five 34 thousand dollars ($35,000). 35 (B) The salaries shall be determined by the Greene County 36 As Engrossed: H3/2/23 S3/28/23 HB1522 7 03-28-2023 14:19:14 MBM083 Quorum Court and the governing body of the City of Paragould and shall be 1 paid in twelve (12) equal monthly installments The salaries and operations of 2 the Greene County District Courts shall be funded through a written 3 interlocal agreement between Greene County, Clay County, and the respective 4 cities operating a department within Greene County and Clay County ; 5 (23)(A) The Hempstead County District Court Clerk shall receive 6 an annual salary of not le ss than thirty-six thousand dollars ($36,000) nor 7 more than forty-five thousand dollars ($45,000). 8 (B) The amount of the salary shall be determined by 9 agreement between the governing body of the City of Hope and the Hempstead 10 County Quorum Court; 11 (24) The Hot Spring County — Malvern Department District Court 12 Judge shall be entitled to an additional deputy district court clerk whose 13 salary shall be determined by the governing body of the City of Malvern and 14 the Hot Spring County Quorum Court, and the salary shall be paid by the city 15 and county in the same proportion as the city and county shared in the 16 revenues generated by the court in the previous year; 17 (25)(A)(i) The Howard County District Court Judge shall have an 18 annual salary of not less than twenty-one thousand dollars ($21,000). 19 (ii) The Howard County District Court Clerk shall 20 receive an annual salary of not less than twelve thousand dollars ($12,000) 21 nor more than forty thousand dollars ($40,000), unless provided for otherwise 22 by ordinance of the Howard County Quorum Court and the governing body of the 23 City of Nashville. 24 (B) The salaries are to be paid one -half (½) by the City 25 of Nashville and one -half (½) by Howard County; 26 (26)(A) The Izard County District Court Judge shall rece ive an 27 annual salary of not less than ten thousand two hundred dollars ($10,200) nor 28 more than forty-two thousand dollars ($42,000) forty-five thousand ($45,000) , 29 and the district court clerk shall receive an annual salary of not less than 30 seven thousand four hundred dollars ($7,400) nor more than thirty-three 31 thousand dollars ($33,000) thirty-six thousand dollars ($36,000) . 32 (B) However, the salaries shall be subject to the approval 33 of the Melbourne City Council and the Izard County Quorum Court; 34 (27) The Jacksonville District Court Clerk shall receive an 35 annual salary of not less than thirty -three thousand nine hundred thirty -36 As Engrossed: H3/2/23 S3/28/23 HB1522 8 03-28-2023 14:19:14 MBM083 seven dollars ($33,937) nor more than thirty -six thousand nine hundred 1 dollars ($36,900); 2 (28)(A) The Newton County Distric t Court — Jasper Department 3 District Court Clerk shall receive an annual salary of not less than twenty -4 eight thousand six hundred dollars ($28,600) nor more than thirty -five 5 thousand dollars ($35,000). 6 (B) All salaries and all other expenses of the of fice 7 shall be paid one hundred percent (100%) by the county; 8 (29) The Jefferson County District Court clerks for Division 1 9 and Division 2 shall receive annual salaries of not less than thirty -one 10 thousand dollars ($31,000) nor more than fifty-four thousand dollars 11 ($54,000), as may be approved by the Jefferson County Quorum Court and the 12 governing body of the City of Pine Bluff; 13 (30) The expenses related to the operation of the Johnson County 14 District Court are to be divided among the county and all cities within the 15 county based on the percentage of the total fine money collected during the 16 year by each participating entity shall be apportioned between Johnson County 17 and any city in Johnson County operating a department by agreement between 18 the governing bodies of the county and the respective cities ; 19 (31)(A) The Lafayette County — Lewisville Department District 20 Court Clerk shall receive an annual salary of not less than twenty -two 21 thousand dollars ($22,000) nor more than thirty -five thousand dollars 22 ($35,000), and the City of Lewisville shall pay to the district court clerk 23 at least eight thousand eight hundred dollars ($8,800) but not more than 24 fourteen thousand dollars ($14,000) of the salary, and Lafayette County shall 25 pay to the district court clerk not less than thirteen thousand two hundred 26 dollars ($13,200) but not more than twenty -one thousand dollars ($21,000) of 27 the salary. 28 (B) The amount and manner of payment of the salary of the 29 district court clerk may be established within the rang es specified in 30 subdivision (a)(31)(A) of this section by mutual agreement of the Lafayette 31 County Quorum Court and the Lewisville City Council, as well as the amount 32 and manner of payment of all other expenses of operation of the Lafayette 33 County — Lewisville Department District Court; 34 (32)(A) The Little River County District Court Judge shall 35 receive an annual salary of not less than forty thousand dollars ($40,000) 36 As Engrossed: H3/2/23 S3/28/23 HB1522 9 03-28-2023 14:19:14 MBM083 nor more than seventy-five thousand dollars ($75,000) eighty-five thousand 1 dollars ($85,000), as determined by the governing body of the City of Ashdown 2 and the Little River County Quorum Court. 3 (B) The salary shall be paid sixty -two percent (62%) by 4 Little River County and thirty -eight percent (38%) by the City of Ashdown, 5 unless otherwise agreed by the Little River County Quorum Court and the 6 governing body of the City of Ashdown; 7 (33)(A) Necessary expenses appropriated by the City of Lonoke 8 for the Lonoke County District Court shall be apportioned among and paid to 9 the City of Lonoke by the cities of the first class, cities of the second 10 class, incorporated towns, and the county as a prorated amount based on the 11 number of cases filed from each of the cities of the first class, cities of 12 the second class, incorporated towns, and the c ounty during the preceding 13 year. 14 (B) An itemized bill shall be prepared by the City of 15 Lonoke fixing the apportioned expenses, and payment shall be made no later 16 than sixty (60) days following the submission by the City of Lonoke of the 17 bills; 18 (34)(A) The Maumelle District Court Clerk shall receive an 19 annual salary of not less than seventeen thousand five hundred dollars 20 ($17,500) nor more than fifty thousand dollars ($50,000). 21 (B) The salary of the district court clerk shall be as 22 determined by the City of Maumelle Board of Directors; 23 (35)(A) The Miller County District Court shall have two (2) 24 departments, the City of Texarkana Department and the Miller County 25 Department. 26 (B) The Miller County District Court — City of Texarkana 27 Department shall hear all civil and criminal cases arising out of violations 28 of city ordinances and those cases arising out of violations of state laws 29 committed within the corporate limits of the City of Texarkana and all other 30 cases in controversy arising wit hin the corporate limits of the city within 31 the jurisdiction of a district court as established by law. The Miller County 32 District Court — City of Texarkana Department shall have a chief district 33 court clerk whose salary shall be paid by the City of Texark ana in an amount 34 to be determined by its governing body. 35 (C) The Miller County District Court — Miller County 36 As Engrossed: H3/2/23 S3/28/23 HB1522 10 03-28-2023 14:19:14 MBM083 Department shall hear all civil and criminal cases arising out of violations 1 of any of the laws of the state committed outside the corporate l imits of the 2 City of Texarkana and all other cases in controversy arising outside the 3 corporate limits of the city within the jurisdiction of a district court as 4 established by law. The Miller County District Court — Miller County 5 Department shall have a c hief district court clerk whose salary shall be paid 6 by Miller County in an amount to be determined by its quorum court; 7 (36) The Monroe County District Court — Brinkley Department 8 Judge shall receive an annual salary of not less than ten thousand two 9 hundred dollars ($10,200) nor more than forty thousand dollars ($40,000), and 10 the Monroe County District Court — Brinkley Department Court Clerk shall 11 receive an annual salary of not less than ten thousand four hundred eighty -12 eight dollars ($10,488) and not more than thirty-seven thousand five hundred 13 dollars ($37,500); 14 (37) The Monroe County District Court — Clarendon Department 15 Judge shall receive an annual salary of not less than four thousand eight 16 hundred dollars ($4,800) and the Monroe County Distri ct Court — Clarendon 17 Department Clerk shall receive an annual salary of not less than eight 18 thousand nine hundred eighty -eight dollars ($8,988); 19 (38)(A) The Montgomery County District Court clerk shall receive 20 an annual salary of not less than nineteen thousand dollars ($19,000) nor 21 more than twenty-seven thousand dollars ($27,000), and the district court 22 secretary shall receive an annual salary of not less than sixteen thousand 23 dollars ($16,000) nor more than twenty -two thousand dollars ($22,000). 24 (B) Montgomery County shall pay eighty percent (80%) of 25 the salaries, and the City of Mt. Ida shall pay twenty percent (20%) of the 26 salaries; 27 (39)(A) The Nevada County District Court Clerk salary shall be 28 not less than twenty -nine thousand dollars ($29,0 00) nor more than thirty -29 seven thousand dollars ($37,000). 30 (B) The salary for the district court clerk shall be 31 established within these ranges by the Nevada County Quorum Court and the 32 Prescott City Council, and the salary shall be paid sixty percent (60%) by 33 Nevada County and forty percent (40%) by the City of Prescott. The salary 34 shall be paid in equal monthly installments; 35 (40)(A) The North Little Rock District Court Judges, Divisions 1 36 As Engrossed: H3/2/23 S3/28/23 HB1522 11 03-28-2023 14:19:14 MBM083 and 2, are each authorized to employ a chief district court clerk, whose 1 salary shall be at least thirty -two thousand five hundred dollars ($32,500), 2 a deputy district court clerk, whose salary shall be at least thirty -two 3 thousand dollars ($32,000), and two (2) district court clerks, whose salaries 4 shall each be at least twenty thousand dollars ($20,000). 5 (B) The North Little Rock District Court Judges, Divisions 6 1 and 2, subject to the approval of the governing body of North Little Rock, 7 may each employ an additional district court clerk whose salary shall be at 8 least twenty thousand dollars ($20,000); 9 (41) The Pike County District Court Judge shall receive an 10 annual salary of not less than six thousand dollars ($6,000) nor more than 11 thirty thousand dollars ($30,000), and the district court clerk shall receive 12 an annual salary of not less than three thousand dollars ($3,000) nor more 13 than thirty-five thousand dollars ($35,000) in an amount set by the Pike 14 County Quorum Court. Seventy-five percent (75%) of the salaries shall be 15 paid by Pike County, and twenty -five percent (25%) shall be paid by the City 16 of Murfreesboro; 17 (42)(A) The salary of the Poinsett County District Court Clerk 18 of each department will be as determined by the Poinsett County Quorum Court 19 and the governing body of each municipality where the department is located. 20 (B) The salary of each district court clerk shall be 21 payable one-half (½) by Poinsett County and one -half (½) by the municipality. 22 (C) Each municipality shall receive from the coun ty each 23 month the county's share of the district court clerk's salaries; 24 (43) The Pope County District Court Clerk shall receive an 25 annual salary of not less than twenty-three thousand dollars ($23,000) 26 thirty-three thousand dollars ($33,000) nor more than fifty thousand dollars 27 ($50,000) sixty thousand dollars ($60,000) , the chief deputy district court 28 clerk of the court shall receive an annual salary of not less than eighteen 29 thousand five hundred dollars ($18,500) twenty-seven thousand five hundred 30 dollars ($27,500) nor more than forty-one thousand dollars ($41,000) fifty 31 thousand dollars ($50,000) , and the deputy district court clerk of the court 32 shall receive an annual salary of not less than sixteen thousand five hundred 33 dollars ($16,500) twenty-two thousand five hundred dollars ($22,500) nor more 34 than thirty-four thousand dollars ($34,000) forty-five thousand dollars 35 ($45,000); 4 (45) The Pulaski County District Court Clerk shall receive an 5 annual salary of not less than fifty -two thousand eight hundred sixty -eight 6 dollars ($52,868) nor more than seventy -eight thousand nine hundred thirty -7 eight dollars ($78,938), and the district court bailiff shall receive an 8 annual salary of not less than thirty -two thousand dollars ($32,000) nor more 9 than fifty-five thousand three hundred fift y-five dollars ($55,355) fifty-10 eight thousand five hundred forty -seven dollars ($58,547) ; 11 (46)(A) The Saline County District Court — Benton Department 12 Clerk shall receive an annual salary of not less than thirty thousand dollars 13 ($30,000) nor more than fifty-six thousand dollars ($56,000) seventy thousand 14 dollars ($70,000). 15 (B) The salary shall be as determined by the governing 16 body of the City of Benton and the Saline County Quorum Court; 17 (47)(A) The Scott County District Court clerk shall receiv e an 18 annual salary of not less than nineteen thousand dollars ($19,000) nor more 19 than thirty-two thousand dollars ($32,000). 20 (B) The salary shall be subject to the approval of the 21 Waldron City Council and the Scott County Quorum Court and shall be paid in 22 equal monthly installments, one -half (½) to be paid by the City of Waldron 23 and one-half (½) to be paid by Scott County; 24 (48)(A) The Searcy County District Court — Marshall Department 25 clerks clerk shall receive an annual salary of not less than twenty -four 26 thousand seven hundred twenty dollars ($24,720) nor more than thirty thousand 27 dollars ($30,000), as determined by the Searcy County Quorum Court and the 28 governing body of the City of Marshall by ordinances or resolutions adopted 29 by the respective bodies. 30 (B) The salaries salary of the district court clerks clerk 31 shall be paid fifty percent (50%) by Searcy County and fifty percent (50%) by 32 the City of Marshall. 33 (C) The salaries salary shall be paid in equal monthly 34 installments; 35 (49)(A) The Sebastian County District Court — Fort Smith 36 As Engrossed: H3/2/23 S3/28/23 HB1522 13 03-28-2023 14:19:14 MBM083 District Judges, Departments 1, 2, and 3, shall jointly appoint a qualified 1 elector of the state to serve as district court clerk. 2 (B)(i) The district court clerk shall have at least five 3 (5) years' previous experience as a court clerk or deputy court clerk or 4 equivalent education, training, and experience as determined by the Director 5 of Human Resources for the City of Fort Smith. 6 (ii) Appointment and removal of the district court 7 clerk shall be in conformance with the City of Fort Smith's current personnel 8 policies in place at the time of appointment and removal of the district 9 court clerk. 10 (C) The salaries of the district court clerk, deputy 11 district court clerks, court personnel, and any special district court judges 12 authorized by this subdivision (a)(49) and the operating expenses of the 13 Sebastian County District Court — Fort Smith District shall be paid seventy 14 percent (70%) by the City of F ort Smith and thirty percent (30%) by Sebastian 15 County; 16 (50)(A) The Sebastian County District Court — Greenwood District 17 salaries of the district court clerk and the district court clerk's deputies 18 shall be set by the Sebastian County Quorum Court. 19 (B) The salaries shall be paid ninety percent (90%) by 20 Sebastian County and ten percent (10%) by the City of Greenwood. 21 (C) In order to defray the expenses of operating the 22 Sebastian County District Court — Greenwood District, ninety percent (90%) of 23 the Sebastian County net fines, ten percent (10%) of the City of Greenwood 24 net fines, and fifteen percent (15%) of all other cities' net fines processed 25 by the Sebastian County District Court — Greenwood District may or shall be 26 deposited into a bank accoun t entitled the “Greenwood District Court 27 Operating Fund” to be administered by the Sebastian County District Court — 28 Greenwood District Judge under a budget approved as follows: 29 (i) The district court judge shall submit a proposed 30 annual budget to a c ommittee composed of the members of the quorum court that 31 represent the Greenwood District of Sebastian County; 32 (ii) The committee shall approve the district court 33 judge's budget or formulate a reasonable budget that shall be approved by the 34 Sebastian County Quorum Court, unless found by a majority of the quorum court 35 to be clearly excessive; and 36 As Engrossed: H3/2/23 S3/28/23 HB1522 14 03-28-2023 14:19:14 MBM083 (iii) If funds provided from the fines as set out in 1 this subdivision (a)(50) become insufficient or excessive, the committee 2 shall adjust the percentage of fines on a pro rata basis to increase or 3 decrease the funds necessary to operate the district court pursuant to the 4 budget established in this subdivision (a)(50). 5 (D) The Sebastian County District Court Judge — Greenwood 6 District shall be bonded i n accordance with §§ 19 -1-401 — 19-1-403; 7 (51)(A) The Sevier County District Court Judge shall receive an 8 annual salary of not less than thirty -five thousand dollars ($35,000) nor 9 more than eighty percent (80%) of the annual salary established by law fo r 10 circuit court judges. 11 (B) The Sevier County District Court Clerk shall have an 12 annual salary of not less than fourteen thousand dollars ($14,000). 13 (C) The salaries, expenses, and operating costs of the 14 Sevier County District Court shall be paid e qually by the City of DeQueen and 15 Sevier County; 16 (52)(A) The Sherwood District Court Clerk shall receive an 17 annual salary of not less than fifty thousand dollars ($50,000) nor more than 18 seventy-five thousand dollars ($75,000). 19 (B) The salary shall b e determined by the governing body 20 of the City of Sherwood; 21 (53)(A) The Stone County District Court Judge shall receive an 22 annual salary of not less than eight thousand dollars ($8,000) fifteen 23 thousand dollars ($15,000) nor more than thirty thousand dollars ($30,000) 24 thirty-five thousand dollars ($35,000) , and the district court clerk shall 25 receive an annual salary of not less than six thousand dollars ($6,000) ten 26 thousand dollars ($10,000) nor more than twenty-three thousand dollars 27 ($23,000) thirty-two thousand dollars ($32,000) . 28 (B) The salaries shall be subject to the approval of the 29 Mountain View City Council and the Stone County Quorum Court; 30 (54) The Van Buren County District Court — Clinton Department 31 Clerk and any district court clerk deputy salaries shall be apportioned 32 between the county and any city in the county by agreement between the 33 respective governing bodies; and 2 (56) The White County District Court — Beebe Department Clerk 3 shall receive an annual salary of not less than twenty-five thousand two 4 hundred ten dollars ($25,210) fifty thousand dollars ($50,000) nor more than 5 forty thousand nine hundred ninety dollars ($40,990) seventy thousand dollars 6 ($70,000);
