256255 SECTION 5. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 11
257256 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FISCAL 12
258257 YEAR 2020 BUDGET STABILIZATION LOAN REPAYMENT. 13
259258 (a) It is the intent of this section to provide for the repayment by 14
260259 Henderson State University of a loan received from the Budget Stabilization 15
261260 Trust Fund in fiscal year 2020. 16
262261 (b) As repayment for the outstanding loan received from the Budget 17
263262 Stabilization Trust Fund in fiscal year 2020, Henderson State University 18
264263 shall make payments of nine hundred fifty -eight thousand three hundred 19
265264 thirty-three dollars and thirty -three cents ($958,333.33) from any legal fund 20
266265 of Henderson State University to the Budget Stabilization Trust Fund on the 21
267266 following dates unless modifica tions are made under subsection (d) of this 22
268267 section: 23
269268 (1) December 1, 2024; 24
270269 (2) December 1, 2025; 25
271270 (3) December 1, 2026; 26
272271 (4) December 1, 2027; 27
273272 (5) December 1, 2028; and 28
274273 (6) December 1, 2029. 29
275274 (c) Henderson State University shall provide a report to the 30
276275 Legislative Council or, if the General Assembly is in regular, fiscal, or 31
277276 extraordinary session, the Joint Budget Committee, no later than June 30 of 32
278277 each year regarding the s tatus of the loan received from the Budget 33
279278 Stabilization Trust Fund. 34
280279 (d)(1) Loan payments under subsection (b) of this section may be 35
281280 modified by the Legislative Council or, if the General Assembly is in 36 HB1056

286285 regular, fiscal, or extraordinary session, t he Joint Budget Committee, based 1
287286 upon its review of the status of the loan received from the Budget 2
288287 Stabilization Trust Fund. 3
289288 (2) A modification to a loan payment under subdivision (2)(A) of 4
290289 this section may include without limitation: 5
291290 (A) The amount of one (1) or more loan payments; and 6
292291 (B) The timing of one (1) or more loan payments. 7
293292 (e) This section shall expire upon the final payment by Henderson 8
294293 State University to the Budget Stabilization Trus t Fund under subsection (b) 9
295294 of this section. 10

297296 SECTION 6. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 12
298297 authorized by this act shall be limited to the appropriation for such agency 13
299298 and funds made available by law for the support of su ch appropriations; and 14
300299 the restrictions of the State Procurement Law, the General Accounting and 15
301300 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 16
302301 Procedures and Restrictions Act, the Higher Education Expenditure Restriction 17
303302 Act, or their successors, and other fiscal control laws of this State, where 18
304303 applicable, and regulations promulgated by the Department of Finance and 19
305304 Administration, as authorized by law, shall be strictly complied with in 20
306305 disbursement of said funds. 21

308307 SECTION 7. LEGISLATIVE INTENT. It is the intent of the General 23
309308 Assembly that any funds disbursed under the authority of the appropriations 24
310309 contained in this act shall be in compliance with the stated reasons for 25
311310 which this act was adopted, as evi denced by the Agency Requests, Executive 26
312311 Recommendations and Legislative Recommendations contained in the budget 27
313312 manuals prepared by the Department of Finance and Administration, letters, or 28
314313 summarized oral testimony in the official minutes of the Arkansas Legislative 29
315314 Council or Joint Budget Committee which relate to its passage and adoption. 30

317316 SECTION 8. EMERGENCY CLAUSE. It is found and determined by the General 32
318317 Assembly, that the Constitution of the State of Arkansas prohibits the 33
319318 appropriation of funds for more than a one (1) year period; that the 34
320319 effectiveness of this Act on July 1, 2024 is essential to the operation of 35
321320 the agency for which the appropriations in this Act are provided, and that in 36 HB1056

326325 the event of an extension of the legi slative session, the delay in the 1
327326 effective date of this Act beyond July 1, 2024 could work irreparable harm 2
328327 upon the proper administration and provision of essential governmental 3
329328 programs. Therefore, an emergency is hereby declared to exist and this Act 4
330329 being necessary for the immediate preservation of the public peace, health 5
331330 and safety shall be in full force and effect from and after July 1, 2024. 6
