SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 11 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. FISCAL 12 YEAR 2020 BUDGET STABILIZATION LOAN REPAYMENT. 13 (a) It is the intent of this section to provide for the repayment by 14 Henderson State University of a loan received from the Budget Stabilization 15 Trust Fund in fiscal year 2020. 16 (b) As repayment for the outstanding loan received from the Budget 17 Stabilization Trust Fund in fiscal year 2020, Henderson State University 18 shall make payments of nine hundred fifty -eight thousand three hundred 19 thirty-three dollars and thirty -three cents ($958,333.33) from any legal fund 20 of Henderson State University to the Budget Stabilization Trust Fund on the 21 following dates unless modifica tions are made under subsection (d) of this 22 section: 23 (1) December 1, 2024; 24 (2) December 1, 2025; 25 (3) December 1, 2026; 26 (4) December 1, 2027; 27 (5) December 1, 2028; and 28 (6) December 1, 2029. 29 (c) Henderson State University shall provide a report to the 30 Legislative Council or, if the General Assembly is in regular, fiscal, or 31 extraordinary session, the Joint Budget Committee, no later than June 30 of 32 each year regarding the s tatus of the loan received from the Budget 33 Stabilization Trust Fund. 34 (d)(1) Loan payments under subsection (b) of this section may be 35 modified by the Legislative Council or, if the General Assembly is in 36 HB1056 8 4/1/2024 3:47:15 PM HAR079 regular, fiscal, or extraordinary session, t he Joint Budget Committee, based 1 upon its review of the status of the loan received from the Budget 2 Stabilization Trust Fund. 3 (2) A modification to a loan payment under subdivision (2)(A) of 4 this section may include without limitation: 5 (A) The amount of one (1) or more loan payments; and 6 (B) The timing of one (1) or more loan payments. 7 (e) This section shall expire upon the final payment by Henderson 8 State University to the Budget Stabilization Trus t Fund under subsection (b) 9 of this section. 10 11 SECTION 6. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 12 authorized by this act shall be limited to the appropriation for such agency 13 and funds made available by law for the support of su ch appropriations; and 14 the restrictions of the State Procurement Law, the General Accounting and 15 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 16 Procedures and Restrictions Act, the Higher Education Expenditure Restriction 17 Act, or their successors, and other fiscal control laws of this State, where 18 applicable, and regulations promulgated by the Department of Finance and 19 Administration, as authorized by law, shall be strictly complied with in 20 disbursement of said funds. 21 22 SECTION 7. LEGISLATIVE INTENT. It is the intent of the General 23 Assembly that any funds disbursed under the authority of the appropriations 24 contained in this act shall be in compliance with the stated reasons for 25 which this act was adopted, as evi denced by the Agency Requests, Executive 26 Recommendations and Legislative Recommendations contained in the budget 27 manuals prepared by the Department of Finance and Administration, letters, or 28 summarized oral testimony in the official minutes of the Arkansas Legislative 29 Council or Joint Budget Committee which relate to its passage and adoption. 30 31 SECTION 8. EMERGENCY CLAUSE. It is found and determined by the General 32 Assembly, that the Constitution of the State of Arkansas prohibits the 33 appropriation of funds for more than a one (1) year period; that the 34 effectiveness of this Act on July 1, 2024 is essential to the operation of 35 the agency for which the appropriations in this Act are provided, and that in 36 HB1056 9 4/1/2024 3:47:15 PM HAR079 the event of an extension of the legislative session, the delay in the 1 effective date of this Act beyond July 1, 2024 could work irreparable harm 2 upon the proper administration and provision of essential governmental 3 programs.
