546518 should be made, the Chief Fiscal Officer of the State shall then initiate the 22
547519 necessary transfer documents to reflect the transfers upon the fiscal records 23
548520 of the State Treasurer, the State Auditor, the Chief Fiscal Officer of the 24
549521 State, and the Department of Corrections Divisions of Correction and 25
550522 Community Correction. Provided, however, that the Board Department Secretary 26
551523 shall be limited to submitting no more than two requests, encompassing a 27
552524 single purpose listed in this section, during any fiscal year per division. 28

554526 of the total General Revenue and Special Revenue appropriation, funding, and 30

852808 SERVICES. (a)(1) The Chief Fiscal Officer of the State may create a Shared 8

854810 of State and the Auditor of State for the payment of personal services and 10
855811 operating expenses in the Shared Services Paying Account Appropriation by the 11
856812 Department of Corrections. 12
857813 (2) The Chief Fiscal Officer of the State shall direct the transfer 13
858814 of funds and appropriations to the Shared Services Paying Account 14
859815 appropriation section of this act on the books of the Treasurer of State, the 15
860816 Auditor of State, and the Chief Fiscal Officer of the State. 16
861817 (3) The transfer authority provided to the department in 17
862818 subdivision (a)(2) of this section may be used to make transfers only within 18
863819 the department's appropriation act or between other appropriation acts 19
864820 authorized for the department. 20
865821 (4) The provisions of this section shall be in effect from the 21
866822 date of passage through June 30, 2025 2026. 22

868824 SECTION 29. SPECIAL LANGUAGE. NOT TO BE INCORPORATED INTO THE ARKANSAS 24
869825 CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY 25
870826 FORWARD - GENERAL REVENUE YEAR END FUND BALANCE. (a) The Chief Fiscal 26
871827 Officer of the State shall cause to be transferred on his or her books and 27
872828 those of the State Treasurer and Auditor of State the balance of General 28
873829 Revenue funds remaining in the Division of Correction Fund Account on June 29
874830 30, 2026 into a sub-fund created within the Division of Correction Fund 30
875831 Account to be used for County Jail Reimbursement or maintenance needs within 31
876832 the Department of Corrections - Division of Correction. The balance of 32
877833 General Revenue in the sub -fund of the Division of Correction Fund Account at 33
878834 the beginning of any fiscal year shall not exceed five million dollars 34
879835 ($5,000,000). For this reason, any general revenue which would cause the 35

888842 (b) Any carry forward of the unexpended balance of funding as authorized 4
889843 herein, may be carried forward under the following conditions: 5
890844 (1) The Office of Budget of the Department of Finance and Administration 6
891845 shall report to the Legislative Council all amounts carried forward by the 7
892846 September meeting of the Legislative Council or the Joint Budget Committee 8
893847 meeting which report shall include the name of the agency, board, commission, 9
894848 or institution and the amount of funding carried forward, the program name or 10
895849 line item and the funding source; and 11
896850 (2) The Department of Corrections - Division of Correction shall provide a 12
897851 written report to the Legislative Council or Joint Budget Committee 13
898852 containing all information set forth in subdivision (b)(1) of this section no 14
899853 later than thirty (30) days prior to the time the Department presents its 15
900854 budget request to the Legislative Council or Joint Budget Committee, or both; 16
901855 and 17
902856 (3) Thereupon, the Department of Finance and Administration shall include all 18
903857 information obtained in subdivision (b)(2) of this section in the budget 19
904858 manuals. 20
905859 The provisions of this section shall be in effect only from July 1, 21
906860 2025 through June 30, 2026. 22

908862 SECTION 30. COMPLIANCE WITH OTHER LAWS. Disbursement of funds 24
909863 authorized by this act shall be limited to the appropriation for such agency 25
910864 and funds made available by law for the support of such appropriations; and 26
911865 the restrictions of the State Procurement Law, the General Accounting and 27
912866 Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 28
913867 Procedures and Restrictions Act, or their successors, and other fiscal 29
914868 control laws of this State, where applicable, and regulations promulgated by 30
915869 the Department of Finance and Administration, as authorized by law, shall be 31
916870 strictly complied with in disbursement of said funds. 32

918872 SECTION 31. LEGISLATIVE INTENT. It is the intent of the General 34
919873 Assembly that any funds disbursed under the authority of the appropriations 35

931883 SECTION 32. EMERGENCY CLAUSE. It is found and determined by the 7
932884 General Assembly, that the Constitution of the State of Arkansas prohibits 8
933885 the appropriation of funds for more than a one (1) year period; that the 9
934886 effectiveness of this Act on July 1, 2025 is essential to the operation of 10
935887 the agency for which the appropriations in this Act are provided, and that in 11
936888 the event of an extension of the legislative session, the delay in the 12
937889 effective date of this Act beyond July 1, 2025 could work irreparable harm 13
938890 upon the proper administration and provision of essential governmental 14
939891 programs. Therefore, an emergency is hereby declared to exist and this Act 15
940892 being necessary for the immediate preservation of the public peace, health 16
941893 and safety shall be in full force and effect from and after July 1, 2025. 17
