"Extra Help", payable from funds appropriated herein for such purposes: one 15 
hundred seventy (170) temporary or part -time employees, when needed, at rates 16 
of pay not to exceed those provided in the Uniform Classification and 17 
Compensation Act, or its successor, or this act for the appropriate 18

Therefore, it is both necessary and appropriate that the General Assembly 35

 SECTION 17. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 9

REALLOCATION OF RESOURCES.  Upon determination by the Board of Corrections	, 11 
at the request of the Secretary of Corrections, that a reallocation of 12 
resources within the Division of Community Correction and Division of 13 
Correction is necessary for the efficient and effective operation of the 14 
divisions department, the Board, with approval of the Governor and approval 15 
by the Arkansas Legislative Council or Joint Budget Committee, shall have the 16 
authority to instruct the division directors Department Secretary , to request 17 
from the Chief Fiscal Officer of the State, a transfer of positions, 18 
programs, funds, appropriations, and line -item appropriations within or 19 
between existing and newly created divisions, offices, sections, or units of 20 
the divisions department.  If it is determined that the requested transfer 21 
should be made, the Chief Fiscal Officer of the State shall then initiate the 22 
necessary transfer documents to reflect the transfers upon the fiscal records 23 
of the State Treasurer, the State Auditor, the Chief Fiscal Officer of the 24 
State, and the Department of Corrections Divisions of Correction and 25 
Community Correction.  Provided, however, that the Board Department Secretary 26 
shall be limited to submitting no more than two requests, encompassing a 27 
single purpose listed in this section, during any fiscal year per division.  28 
Transfer authority shall further be limited to no more than five percent (5%) 29 
of the total General Revenue and Special Revenue appropriation, funding, and 30 
positions specific to each agency division, office, section, or unit from 31 
which funds are transferred .  However, there shall be no fund transfers to or 32 
from the County Jail Reimbursement Fund.  A Reallocation of Resources 33 
Transfer shall be limited to the following specific purposes: 34 
a) Costs to open and operate temporary beds; 35

(2)  The Department of Finance and Administration Office of Budget shall 10 
report to the Arkansas Legislative Council all amounts carried forward from 11 
the first fiscal year to the second fiscal year by the September Arkansas 12 
Legislative Council or Joint Budget Committee meeting which report shall 13 
include the name of the Agency, Board, Commission or Institution and the 14 
amount of the funding carried forward from the first fiscal year to the 15 
second fiscal year, the program name or line item, the funding source of that 16 
appropriation and a copy of the written request set forth in (1) above; 17 
(3)  Each Agency, Board, Commission or Institution shall provide a written 18 
report to the Arkansas Legislative Council or Joint Budget Committee 19 
containing all information set forth in item (2) above, along with a written 20 
statement as to the current status of the project, contract, purpose etc. for 21 
which the carry forward was originally requested no later than thirty (30) 22 
days prior to the time the Agency, Board, Commission or Institution presents 23 
its budget request to the Arkansas Legislative Council/Joint Budget 24 
Committee; and 25 
(4)  Thereupon, the Department of Finance and Administration shall include 26 
all information obtained in item (3) above in the budget manuals and/or a 27 
statement of non-compliance by the Agency, Board, Commission or Institution. 28

prior approval of the Legislative Council or Joint Budget Committee as 19 
provided by this section.  The requirement of approval by the Legislative 20 
Council or Joint Budget Committee is not a severable part of this section.  21 
If the requirement of approval by the Legislative Council or Joint Budget 22 
Committee is ruled unconstitutional by a court of competent jurisdiction, 23 
this entire section is void. 24

 SECTION 24. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 28

FACILITIES.  If it is found that contracting for the operation of new 30 
facilities is economically beneficial to the State of Arkansas, the 31 
Department of Corrections may, after receiving approval of the Chief Fiscal 32 
Officer, and seeking prior review and approval by the Arkansas Legislative 33 
Council or Joint Budget Committee, transfer from any line item appropriation 34 
contained in the Inmate Care & Custody appropriation of this Act into the 35

Custody appropriation of this Act to operate new facilities. 1 
Determining the maximum number of employees and the maximum amount of 2 
appropriation and general revenue funding for a state agency each fiscal year 3 
is the prerogative of the General Assembly.  This is usually accomplished by 4 
delineating such maximums in the appropriation act(s) for a state agency and 5 
the general revenue allocations authorized for each fund and fund account by 6 
amendment to the Revenue Stabilization law.  Further, the General Assembly 7 
has determined that the Department of Corrections may operate more 8

APPROPRIATION TRANSFER FOR CONSTRUCTING AND EQUIPPING.  The Department of 23 
Corrections is hereby authorized to transfer appropriations between any line 24 
items authorized herein but only for the purpose of financing construction or 25 
equipment for a facility of the department.  Any transfers authorized by this 26 
section shall require the approval of the Chief Fiscal Officer of the State 27 
after prior review and approval by the Legislative Council or Joint Budget 28 
Committee. 29

 SECTION 26. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 13 
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.  	TRANSFER 14 
OF APPROPRIATION AND FUNDS TO THE COUNTY JAIL REIMBURSEMENT FUND.  If any 15 
savings of general revenue appropriation and funds accrue during the 	2024-16 
2025 2025-2026 fiscal year in the operations of the Department of Corrections 17 
- Division of Correction & Community Correction, the Secretary of the 18 
Department of Corrections may request a transfer of appropriation and funds 19 
from any line item appropriation to the County Jail Reimbursement Fund in 20 
order to meet obligations to counties for housing state inmates.  Such 21 
transfer request shall be made upon the approval of the Chief Fiscal Officer 22 
of the State and prior review and approval by the Arkansas Legislative 23 
Council or Joint Budget Committee.  24 
 The provisions of this section shall be in effect only from July 1, 25 
2024 2025 through June 30, 2025 2026. 26 
 27 
 SECTION 27. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 28 
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.  TRANSFER 29 
OF FUNDS. The Arkansas Department of Corrections shall provide funding each 30 
year in an amount not to exceed $100,000 for a Deputy Prosecuting Attorney 31 
who will be assigned to handle the prosecution of offenses occurring at the 32 
Arkansas Department of Corrections. Upon request by the Auditor of the State, 33 
the Chief Fiscal Officer of the State shall transfer an amount not to exceed 34 
$100,000 from an account designated by the Secretary of the Department of 35

Deputy Prosecuting Attorney who will be assigned to handle the prosecution of 1 
offenses occurring at the Arkansas Department of Corrections. 2

 SECTION 28. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 6 
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW.  SHARED 7 
SERVICES. (a)(1)  The Chief Fiscal Officer of the State may create a Shared 8 
Services paying account on his or her books and on the books of the Treasurer 9 
of State and the Auditor of State for the payment of personal services and 10 
operating expenses in the Shared Services Paying Account Appropriation by the 11 
Department of Corrections. 12 
          (2) The Chief Fiscal Officer of the State shall direct the transfer 13 
of funds and appropriations to the Shared Services Paying Account 14 
appropriation section of this act on the books of the Treasurer of State, the 15 
Auditor of State, and the Chief Fiscal Officer of the State. 16 
          (3)  The transfer authority provided to the department in 17 
subdivision (a)(2) of this section may be used to make transfers only within 18 
the department's appropriation act or between other appropriation acts 19 
authorized for the department. 20 
          (4)  The provisions of this section shall be in effect from the 21 
date of passage through June 30, 2025 2026. 22 
 23 
 SECTION 29. SPECIAL LANGUAGE.  NOT TO BE INCORPORATED INTO THE ARKANSAS 24 
CODE NOR PUBLISHED SEPARATELY AS SPECIAL, LOCAL AND TEMPORARY LAW. CARRY 25 
FORWARD - GENERAL REVENUE YEAR END FUND BALANCE. (a)  The Chief Fiscal 26 
Officer of the State shall cause to be transferred on his or her books and 27 
those of the State Treasurer and Auditor of State the balance of General 28 
Revenue funds remaining in the Division of Correction Fund Account on June 29 
30, 2026 into a sub-fund created within the Division of Correction Fund 30 
Account to be used for County Jail Reimbursement or maintenance needs within 31 
the Department of Corrections - Division of Correction.  The balance of 32 
General Revenue in the sub -fund of the Division of Correction Fund Account at 33 
the beginning of any fiscal year shall not exceed five million dollars 34 
($5,000,000).  For this reason, any general revenue which would cause the 35 
balance of sub-fund of the Division of Correction Fund Account to exceed five 36  As Engrossed:  H3/12/25 	HB1174

million dollars ($5,000,000) shall be reclaimed by the Department of Finance 1 
and Administration pursuant to the same procedures as other general revenue 2 
recapture. 3 
(b) Any carry forward of the unexpended balance of funding as authorized 4 
herein, may be carried forward under the following conditions: 5 
(1)  The Office of Budget of the Department of Finance and Administration 6 
shall report to the Legislative Council all amounts carried forward by the 7 
September meeting of the Legislative Council or the Joint Budget Committee 8 
meeting which report shall include the name of the agency, board, commission, 9 
or institution and the amount of funding carried forward, the program name or 10 
line item and the funding source; and 11 
(2) The Department of Corrections - Division of Correction shall provide a 12 
written report to the Legislative Council or Joint Budget Committee 13 
containing all information set forth in subdivision (b)(1) of this section no 14 
later than thirty (30) days prior to the time the Department presents its 15 
budget request to the Legislative Council or Joint Budget Committee, or both; 16 
and 17 
(3) Thereupon, the Department of Finance and Administration shall include all 18 
information obtained in subdivision (b)(2) of this section in the budget 19 
manuals. 20 
 The provisions of this section shall be in effect only from July 1, 21 
2025 through June 30, 2026. 22 
 23 
 SECTION 30. COMPLIANCE WITH OTHER LAWS.  Disbursement of funds 24 
authorized by this act shall be limited to the appropriation for such agency 25 
and funds made available by law for the support of such appropriations; and 26 
the restrictions of the State Procurement Law, the General Accounting and 27 
Budgetary Procedures Law, the Revenue Stabilization Law, the Regular Salary 28 
Procedures and Restrictions Act, or their successors, and other fiscal 29 
control laws of this State, where applicable, and regulations promulgated by 30 
the Department of Finance and Administration, as authorized by law, shall be 31 
strictly complied with in disbursement of said funds. 32 
 33 
 SECTION 31. LEGISLATIVE INTENT.  It is the intent of the General 34 
Assembly that any funds disbursed under the authority of the appropriations 35

which this act was adopted, as evidenced by the Agency Requests, Executive 1 
Recommendations and Legislative Recommendations contained in the budget 2 
manuals prepared by the Department of Finance and Administration, letters, or 3 
summarized oral testimony in the official minutes of the Arkansas Legislative 4 
Council or Joint Budget Committee which relate to its passage and adoption. 5 
 6 
 SECTION 32. EMERGENCY CLAUSE.  It is found and determined by the 7 
General Assembly, that the Constitution of the State of Arkansas prohibits 8 
the appropriation of funds for more than a one (1) year period; that the 9 
effectiveness of this Act on July 1, 2025 is essential to the operation of 10 
the agency for which the appropriations in this Act are provided, and that in 11 
the event of an extension of the legislative session, the delay in the 12 
effective date of this Act beyond July 1, 2025 could work irreparable harm 13 
upon the proper administration and provision of essential governmental 14 
programs. Therefore, an emergency is hereby declared to exist and this Act 15 
being necessary for the immediate preservation of the public peace, health 16 
and safety shall be in full force and effect from and after July 1, 2025. 17
