BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 17

SECTION 1. Arkansas Code ยง 16-22-501(a), concerning the intended 19
benefit that is required as an element of the unauthorized practice of law, 20
is amended to read as follows: 21
(a) A person commits an offense if, with intent to obtain a direct any 22
economic benefit for himself or herself, the person: 23
(1) Contracts with any person to represent that person with 24
regard to personal causes of action for property damages or personal injury; 25
(2) Advises any person as to the person's rights and the 26
advisability of making claims for personal injuries or property damages; 27
(3) Advises any person as to whether or not to accept an offered 28
sum of money in settlement of claims for personal injuries or property 29
damages; 30
(4) Enters into any contract with another person to represent 31
that person in personal injury or property damage matters on a contingent fee 32
basis with an attempted assignment of a portion of the person's cause of 33
action; 34
(5) Enters into any contract, except a contract of insurance, 35
with a third person which purports to grant the exclusive right to select and 36 HB1282

retain legal counsel to represent the individual in any legal proceeding; or 1
(6) Contacts any person by telephone or in person for the 2
purpose of soliciting business which is legal in nature, as set forth above. 3
