BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23

SECTION 1. Arkansas Code Title 10, Chapter 3, Subchapter 3, is amended 25
to add an additional section to read as follows: 26
10-3-321. Reporting on protection and advocacy for individuals with 27
developmental disabilities. 28
(a) The designated Protection and Advocacy Agency for the state and 29
the designated Client Assistance Program for the state shall: 30
(1) Submit biannual reports to the Hospital, Medicaid, and 31
Developmental Disabilities Study Subcommittee of Legislative Council and the 32
Governor regarding efforts to advocate for all individuals with developmental 33
disabilities who live in a home - and community-based setting and not a 34
facility; 35
(2) Attend meetings of the Hospital, Medicaid, and Developmental 36 As Engrossed: H2/12/25 S3/20/25 HB1382

Disabilities Study Subcommittee of Legislative Council when requested; and 1
(3) Provide information requested by the Hospital, Medicaid, and 2
Developmental Disabilities Study Subcommittee of Legislative Council to the 3
Hospital, Medicaid, and Developmental Disabilities Study Subcommittee of 4
Legislative Council at the earliest opportunity but no later than the date 5
designated by the Hospital, Medicaid, and Developmental Disabilities Study 6
Subcommittee of Legislative Council. 7
(b) The Hospital, Medicaid, and Developmental Disabilities Study 8
Subcommittee of Legislative Council shall review all reports submitted by the 9
designated Protection and Advocacy Agency for the state and the designated 10
Client Assistance Program. 11
(c) The Freedom of Information Act of 1967, ยง 25 -19-101 et seq., 12
applies to Disability Rights of Arkansas, Inc. or its successor organization 13
that is the designated Protection and Advocacy Agency for the state and the 14
designated Client Assistance Program for the state. 15
