| 23 | 21 | | SECTION 1. Arkansas Code § 22 -6-601(a), concerning the sale procedure 19 |
|---|
| 24 | 22 | | for public property, is amended to read as follows: 20 |
|---|
| 25 | 23 | | (a)(1)(A) The several state boards or commissions having supervision 21 |
|---|
| 26 | 24 | | of the affairs of the charitable, penal, correctional, educational, and other 22 |
|---|
| 28 | 26 | | commissions, except the State Highway Commission, the Arkansas State Game and 24 |
|---|
| 29 | 27 | | Fish Commission, the Arkansas Natural Heritage Commission, the State Parks, 25 |
|---|
| 30 | 28 | | Recreation, and Travel Commission, the Division of Higher Education, and 26 |
|---|
| 31 | 29 | | institutions of higher education, and the executive heads of all state 27 |
|---|
| 32 | 30 | | offices, departments, divisions, and agencies, all referred to separately as 28 |
|---|
| 33 | 31 | | “state agency”, may sell or purchase, for cash in hand and upon compliance 29 |
|---|
| 34 | 32 | | with the provisions of this section, the lands, in whole or in part, 30 |
|---|
| 35 | 33 | | belonging to or under the supervision or control of the respective state 31 |
|---|
| 36 | 34 | | agency or belonging to the state and held for the use or benefit of the state 32 |
|---|
| 37 | 35 | | agency. 33 |
|---|
| 38 | 36 | | (B) State agencies may purchase lands, so that the lands, 34 |
|---|
| 39 | 37 | | in whole or in part, shall belong to or be under the supervision or control 35 |
|---|
| 45 | 41 | | or benefit of the state agency. 1 |

| 46 | 42 | | (2) The provisions of this section shall not apply to: 2 |
|---|
| 47 | 43 | | (A) The sale of land by the Commissioner of State Lands; 3 |
|---|
| 48 | 44 | | (B) The transfer of state lands to political subdivisions 4 |
|---|
| 49 | 45 | | of the State of Arkansas; 5 |
|---|
| 50 | 46 | | (C) The transfer of state lands between state entities; or 6 |
|---|
| 51 | 47 | | (D) The exchange of state lands for other lands which are 7 |
|---|
| 52 | 48 | | suitable for state purposes if the Secretary of the Department of Finance and 8 |
|---|
| 53 | 49 | | Administration has made a recommendation to the Governor that the exchange be 9 |
|---|
| 54 | 50 | | made and if the Governor has approved the exchange ; 10 |
|---|
| 55 | 51 | | (E) The State Highway Commission; 11 |
|---|
| 56 | 52 | | (F) The Arkansas State Game and Fish Commission; 12 |
|---|
| 57 | 53 | | (G) The Arkansas Natural Heritage Commission; 13 |

| 62 | 58 | | SECTION 2. Arkansas Code § 22 -6-601(c)(1), concerning the sale 18 |

| 63 | 59 | | procedure for public property, is amended to read as follows: 19 |

| 64 | 60 | | (c)(1) In the event that a state agency elects to sell certain any of 20 |
|---|
| 65 | 61 | | its lands or to purchase lands, the state agency shall certify submit its 21 |
|---|
| 66 | 62 | | proposal for the sale or purchase of land to the Building Authority Division 22 |
|---|
| 67 | 63 | | its proposal for any sale or purchase for approval before obtaining an 23 |
|---|
| 68 | 64 | | appraisal of the land . 24 |

| 70 | 66 | | SECTION 3. Arkansas Code § 22 -6-601(c)(2)(A), concerning the sale 26 |

| 73 | 69 | | submitted under subdivision (c)(1) of this section is approved by the 29 |

| 74 | 70 | | Building Authority Division, the state agency proposing the sale or purchase 30 |

| 75 | 71 | | of land shall obtain the services of a qualified appraiser to appraise the 31 |
|---|
| 76 | 72 | | lands so proposed to be sold or purchased , with notice to the Secretary of 32 |

| 77 | 73 | | the Department of Transformation and Shared Services . 33 |

| 79 | 75 | | SECTION 4. Arkansas Code § 22 -6-601(c), concerning the sale procedure 35 |

|---|
| 94 | 88 | | agency director shall certify the proposed donation request to the Building 10 |

| 97 | 91 | | Services shall forward a recommendation to the Governor. 13 |
