AN ACT TO AMEND THE SALE AND PURCHASE PROCEDURE FOR 9 
PUBLIC PROPERTY; AND FOR OTHER PURPOSES. 10

FOR PUBLIC PROPERTY. 15

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 17 
 18 
 SECTION 1.  Arkansas Code § 22-6-601(a), concerning the sale procedure 19 
for public property, is amended to read as follows: 20 
 (a)(1)(A)  The several state boards or commissions having supervision 21 
of the affairs of the charitable, penal, correctional, educational, and other 22 
institutions of the State of Arkansas , and all other state boards and 23 
commissions, except the State Highway Commission, the Arkansas State Game and 24 
Fish Commission, the Arkansas Natural Heritage Commission, the State Parks, 25 
Recreation, and Travel Commission, the Division of Higher Education, and 26 
institutions of higher education, and the executive heads of all state 27 
offices, departments, divisions, and agencies, all referred to separately as 28 
“state agency”, may sell or purchase, for cash in hand and upon compliance 29 
with the provisions of this section, the lands, in whole or in part, 30 
belonging to or under the supervision or control of the respective state 31 
agency or belonging to the state and held for the use or benefit of the state 32 
agency. 33 
 (B)  State agencies may purchase lands, so that the lands, 34 
in whole or in part, shall belong to or be under the supervision or control 35 
of the respective state agency or belong to the state and be held for the use 36  As Engrossed:  H2/24/25 	HB1499

or benefit of the state agency. 1 
 (2)  The provisions of this section shall not apply to: 2 
 (A)  The sale of land by the Commissioner of State Lands; 3 
 (B)  The transfer of state lands to political subdivisions 4 
of the State of Arkansas; 5 
 (C)  The transfer of state lands between state entities; or 6 
 (D)  The exchange of state lands for other lands which are 7 
suitable for state purposes if the Secretary of the Department of Finance and 8 
Administration has made a recommendation to the Governor that the exchange be 9 
made and if the Governor has approved the exchange ; 10 
 (E)  The State Highway Commission; 11 
 (F)  The Arkansas State Game and Fish Commission; 12 
 (G)  The Arkansas Natural Heritage Commission; 13 
 (H)  The State Parks, Recreation, and Travel Commission; 14 
 (I)  The Division of Higher Education; or 15 
 (J)  An institution of higher education . 16

 SECTION 2.  Arkansas Code § 22 -6-601(c)(1), concerning the sale 18 
procedure for public property, is amended to read as follows: 19 
 (c)(1)  In the event that a state agency elects to sell certain any of 20 
its lands or to purchase lands, the state agency shall certify submit its 21 
proposal for the sale or purchase of land to the Building Authority Division 22 
its proposal for any sale or purchase for approval before obtaining an 23 
appraisal of the land . 24

 SECTION 3.  Arkansas Code § 22-6-601(c)(2)(A), concerning the sale 26 
procedure for public property, is amended to read as follows: 27 
 (2)(A)  The If a proposal for the sale or purchase of land 28 
submitted under subdivision (c)(1) of this section is approved by the 29 
Building Authority Division, the state agency proposing the sale or purchase 30 
of land shall obtain the services of a qualified appraiser to appraise the 31 
lands so proposed to be sold or purchased , with notice to the Secretary of 32 
the Department of Transformation and Shared Services . 33

 SECTION 4.  Arkansas Code § 22 -6-601(c), concerning the sale procedure 35 
for public property, is amended to add an additional subdivision to read as 36  As Engrossed:  H2/24/25 	HB1499

follows: 1 
 (3)  A state agency proposing the sale or purchase of land shall 2 
submit the appraisal obtained under this section to the Building Authority 3 
Division for assessment and recommendation to the Secretary of the Department 4 
of Transformation and Shared Services. 5

 SECTION 5.  Arkansas Code § 22 -6-601(k) and (l), concerning the sale 7 
procedure for public property, are amended to read as follows: 8 
 (k)(1)  Before any state agency may receive donated land, the state 9 
agency director shall certify the proposed donation request to the Building 10 
Authority Division. 11 
 (2)  The Secretary of the Department of Transformation and Shared 12 
Services shall forward a recommendation to the Governor. 13 
 (3)  No donation shall be made accepted without approval from the 14 
Governor. 15 
 (l)  Before a state agency purchases real property, the state agency 16 
shall consult the Arkansas Buildings & Sites Database maintained by the 17 
Arkansas Economic Development Commission Building Authority Division to 18 
determine if there is a property available for purchase that meets the 19 
practical and financial needs and specifications of the state agency. 20
