2626 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24

2828 SECTION 1. Arkansas Code ยง 5 -27-601, concerning definitions used 26
2929 regarding computer crimes against minors, is amended to add an additional 27
3030 subdivision to read as follows: 28
3131 (16) "Indistinguishable" means appearing to an ordinary person to be 29

3434 SECTION 2. Arkansas Code Title 5, Chapter 6, Subchapter 6, is amended 32
3535 to add an additional section to read as follows: 33
3636 5-27-611. Creating, distributing, possessing, or viewing artificial 34
3737 intelligence-generated matter depicting sexually explicit conduct involving a 35

4141 (a) A person commits creating, distributing, possessing, or viewing 1
4242 artificial intelligence -generated matter depicting sexually explicit conduct 2
4343 involving a child if the person knowingly: 3
4444 (1) Uses artificial intelligence or other computer technology 4
4545 capable of processing and interpreting specific data inputs to generate 5
4646 visual depictions to create a depiction of a child engaging in sexually 6
4747 explicit conduct that is indistinguishable from a child actually engaging in 7
4848 sexually explicit conduct; 8
4949 (2) Receives for the purpose of selling or knowingly sells, 9
5050 procures, manufactures, gives, provides, lends, trades, mails, delivers, 10
5151 transfers, publishes, distributes, circulates, disseminates, presents, 11
5252 exhibits, advertises, offers, or agrees to offer through any means an 12
5353 artificial intelligence -generated or computer -generated depiction that is 13
5454 indistinguishable from a child actually engaging in sexually explicit 14
5555 conduct; or 15
5656 (3) Possesses or views through any means an artificial 16
5757 intelligence-generated or computer -generated depiction that is 17
5858 indistinguishable from a child actually engaging in sexually explicit 18

6060 (b) Creating, distributing, possessing, or viewing artificial 20
6161 intelligence-generated matter depicting sexually explicit conduct involving a 21

6363 (1) Class C felony for the first offense; and 23
