26	26	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24

28	28	SECTION 1. Arkansas Code § 5 -27-601, concerning definitions used 26
29	29	regarding computer crimes against minors, is amended to add an additional 27
30	30	subdivision to read as follows: 28
31	31	(16) "Indistinguishable" means appearing to an ordinary person to be 29
32	32	an authentic depiction. 30

34	34	SECTION 2. Arkansas Code Title 5, Chapter 6, Subchapter 6, is amended 32
35	35	to add an additional section to read as follows: 33
36	36	5-27-611. Creating, distributing, possessing, or viewing artificial 34
37	37	intelligence-generated matter depicting sexually explicit conduct involving a 35

41	41	(a) A person commits creating, distributing, possessing, or viewing 1
42	42	artificial intelligence -generated matter depicting sexually explicit conduct 2
43	43	involving a child if the person knowingly: 3
44	44	(1) Uses artificial intelligence or other computer technology 4
45	45	capable of processing and interpreting specific data inputs to generate 5
46	46	visual depictions to create a depiction of a child engaging in sexually 6
47	47	explicit conduct that is indistinguishable from a child actually engaging in 7
48	48	sexually explicit conduct; 8
49	49	(2) Receives for the purpose of selling or knowingly sells, 9
50	50	procures, manufactures, gives, provides, lends, trades, mails, delivers, 10
51	51	transfers, publishes, distributes, circulates, disseminates, presents, 11
52	52	exhibits, advertises, offers, or agrees to offer through any means an 12
53	53	artificial intelligence -generated or computer -generated depiction that is 13
54	54	indistinguishable from a child actually engaging in sexually explicit 14
55	55	conduct; or 15
56	56	(3) Possesses or views through any means an artificial 16
57	57	intelligence-generated or computer -generated depiction that is 17
58	58	indistinguishable from a child actually engaging in sexually explicit 18
59	59	conduct. 19
60	60	(b) Creating, distributing, possessing, or viewing artificial 20
61	61	intelligence-generated matter depicting sexually explicit conduct involving a 21
62	62	child is a: 22
63	63	(1) Class C felony for the first offense; and 23
64	64	(2) Class B felony for any subsequent offense. 24
