INTELLIGENCE; TO CREATE THE OFFENSE OF CREATING, 10 
DISTRIBUTING, POSSESSING, OR VIEWING ARTIFICIAL 11 
INTELLIGENCE-GENERATED MATTER DEPICTING SEXUALLY 12 
EXPLICIT CONDUCT INVOLVING A CHILD; AND FOR OTHER 13 
PURPOSES. 14

TO CREATE THE OFFENSE OF CREATING, 18 
DISTRIBUTING, POSSESSING, OR VIEWING 19 
ARTIFICIAL INTELLIGENCE -GENERATED MATTER 20 
DEPICTING SEXUALLY EXPLICIT CONDUCT 21 
INVOLVING A CHILD. 22

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 24 
 25 
 SECTION 1.  Arkansas Code ยง 5 -27-601, concerning definitions used 26 
regarding computer crimes against minors, is amended to add an additional 27 
subdivision to read as follows: 28 
 (16)  "Indistinguishable" means appearing to an ordinary person to be 29 
an authentic depiction. 30

 SECTION 2.  Arkansas Code Title 5, Chapter 6, Subchapter 6, is amended 32 
to add an additional section to read as follows: 33 
 5-27-611.  Creating, distributing, possessing, or viewing artificial 34 
intelligence-generated matter depicting sexually explicit conduct involving a 35

 (a)  A person commits creating, distributing, possessing, or viewing 1 
artificial intelligence -generated matter depicting sexually explicit conduct 2 
involving a child if the person knowingly: 3 
 (1)  Uses artificial intelligence or other computer technology 4 
capable of processing and interpreting specific data inputs to generate 5 
visual depictions to create a depiction of a child engaging in sexually 6 
explicit conduct that is indistinguishable from a child actually engaging in 7 
sexually explicit conduct; 8 
 (2)  Receives for the purpose of selling or knowingly sells, 9 
procures, manufactures, gives, provides, lends, trades, mails, delivers, 10 
transfers, publishes, distributes, circulates, disseminates, presents, 11 
exhibits, advertises, offers, or agrees to offer through any means an 12 
artificial intelligence -generated or computer -generated depiction that is 13 
indistinguishable from a child actually engaging in sexually explicit 14 
conduct; or 15 
 (3)  Possesses or views through any means an artificial 16 
intelligence-generated or computer -generated depiction that is 17 
indistinguishable from a child actually engaging in sexually explicit 18 
conduct.   19 
 (b)  Creating, distributing, possessing, or viewing artificial 20 
intelligence-generated matter depicting sexually explicit conduct involving a 21 
child is a: 22 
 (1)  Class C felony for the first offense; and 23 
 (2)  Class B felony for any subsequent offense. 24
