24	24	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22

26	26	SECTION 1. DO NOT CODIFY. Legislative findings. 24
27	27	The General Assembly finds that: 25
28	28	(1) Records published online by county assessors are for the 26
29	29	convenience of a property owner; 27
30	30	(2) Online records afford a property owner the ability to pay 28
31	31	taxes and fees online; 29
32	32	(3) County assessors in Arkansas are not required by law to 30
33	33	publish records online however, certain records are available upon request; 31
34	34	and 32
35	35	(4) Property owners may desire to opt out of having their 33
36	36	records placed online for privacy or other reasons. 34

41	41	use of electronic records, is amended to add an additional subdivision to 1
42	42	read as follows: 2
43	43	(4) "Online database" means a website with administrative rights 3
44	44	retained by a county official that is used by members of the public to search 4
45	45	public records maintained by the office of the county official. 5

47	47	SECTION 3. Arkansas Code § 14 -14-111, concerning county government use 7
48	48	of electronic records, is amended to add additional subsections to read as 8
49	49	follows: 9
50	50	(e)(1) A county assessor who maintains an online database for property 10
51	51	records shall allow a property owner to opt out of making the property 11
52	52	owner's information available on the online database. 12
53	53	(2) To opt out of having the property owner's information 13
54	54	included in the online database under subdivision (e)(1) of this section, the 14
55	55	property owner shall submit a request in writing to the county assessor 15
56	56	stating the property owner's intent to opt out of the online database. 16
57	57	(f) The Assessment Coordination Division may promulgate rules to 17
58	58	create and maintain the forms necessary to submit a request under subsection 18
59	59	(e) of this section. 19
