TO OPT OUT OF HAVING THE PROPERTY OWNER'S INFORMATION 11 
POSTED ON AN ONLINE DATABASE; AND FOR OTHER PURPOSES. 12

TO AMEND THE LAW CONCERNING THE DUTIES 16 
OF A COUNTY PROPERTY ASSESSOR; AND TO 17 
PERMIT A PROPERTY OWNER TO OPT OUT OF 18 
HAVING THE PROPERTY OWNER'S INFORMATION 19 
POSTED ON AN ONLINE DATABASE. 20

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 22 
 23 
 SECTION 1.  DO NOT CODIFY.  Legislative findings. 24 
 The General Assembly finds that: 25 
 (1)  Records published online by county assessors are for the 26 
convenience of a property owner; 27 
 (2)  Online records afford a property owner the ability to pay 28 
taxes and fees online; 29 
 (3)  County assessors in Arkansas are not required by law to 30 
publish records online however, certain records are available upon request; 31 
and 32 
 (4)  Property owners may desire to opt out of having their 33 
records placed online for privacy or other reasons. 34

 SECTION 2.  Arkansas Code § 14 -14-111(b), concerning county government 36    	HB1565

use of electronic records, is amended to add an additional subdivision to 1 
read as follows:  2 
 (4)  "Online database" means a website with administrative rights 3 
retained by a county official that is used by members of the public to search 4 
public records maintained by the office of the county official. 5 
 6 
 SECTION 3.  Arkansas Code § 14 -14-111, concerning county government use 7 
of electronic records, is amended to add additional subsections to read as 8 
follows:  9 
 (e)(1)  A county assessor who maintains an online database for property 10 
records shall allow a property owner to opt out of making the property 11 
owner's information available on the online database. 12 
 (2)  To opt out of having the property owner's information 13 
included in the online database under subdivision (e)(1) of this section, the 14 
property owner shall submit a request in writing to the county assessor 15 
stating the property owner's intent to opt out of the online database.  16 
 (f)  The Assessment Coordination Division may promulgate rules to 17 
create and maintain the forms necessary to submit a request under subsection 18 
(e) of this section. 19
