25	25	BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23

27	27	SECTION 1. Arkansas Code Title 27, Chapter 15, Subchapter 3, is 25
28	28	amended to add an additional section to read as follows: 26
29	29	27-15-318. Pregnancy Parking Act — Temporary special certificate 27
30	30	during and after pregnancy. 28
31	31	(a) This act shall be known and may be cited as the "Pregnancy Parking 29
32	32	Act". 30
33	33	(b) A woman who is pregnant, as determined by a licensed physician, 31
34	34	may apply to the Office of Motor Vehicle for a temporary person -with-a-32
35	35	disability special certificate. 33
36	36	(c) The temporary special certificate shall: 34
37	37	(1) Conform to the requirements under § 27 -15-304(a)-(c); and 35
38	38	(2) Expire one (1) year following the date the pregnant woman 36 HB1770

42	42	(d) The Office of Motor Vehicles shall: 2
43	43	(1) Develop an appropriate form, including a provision for a 3
44	44	sworn statement of pregnancy, for use by an applicant to request issuance of 4
45	45	the temporary special person -with-a-disability certificate for a pregnant or 5
46	46	post-partum woman; 6
47	47	(2) Distribute a copy of this subchapter to all appropriate law 7
48	48	enforcement agencies charged with enforcement of the Motor Vehicle Code; 8
49	49	(3) Adopt procedures and promulgate rules to advise and inform 9
50	50	the general public of the provisions of this subchapter and the availability 10
51	51	of the temporary special certificates; 11
52	52	(4) Maintain accurate records of the annual number of temporary 12
53	53	special certificates issued and in inventory; 13
54	54	(5) Enter into the permanent record of each applicant, the 14
55	55	temporary special certificate number, and type of allowable disability of the 15
56	56	applicant in a manner that will allow retrieval of the information for 16
57	57	statistical use; and 17
58	58	(6) Include a notice with each application for a temporary 18
59	59	special certificate informing the applicant and any other person driving for 19
60	60	the applicant of the requirements of this subchapter and further informing 20
61	61	the applicant that the privilege to park in spaces reserved for persons with 21
62	62	disabilities shall be available only when the person for whom the temporary 22
63	63	special certificate was issued or a person with a disability is actually in 23
64	64	the vehicle. 24
65	65	(e) The Office of Motor Vehicle may promulgate rules to administer the 25
66	66	provisions of this section. 26
