2525 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 23

2727 SECTION 1. Arkansas Code Title 27, Chapter 15, Subchapter 3, is 25
2828 amended to add an additional section to read as follows: 26
2929 27-15-318. Pregnancy Parking Act — Temporary special certificate 27
3030 during and after pregnancy. 28
3131 (a) This act shall be known and may be cited as the "Pregnancy Parking 29
3232 Act". 30
3333 (b) A woman who is pregnant, as determined by a licensed physician, 31
3434 may apply to the Office of Motor Vehicle for a temporary person -with-a-32
3535 disability special certificate. 33
3636 (c) The temporary special certificate shall: 34
3737 (1) Conform to the requirements under § 27 -15-304(a)-(c); and 35
3838 (2) Expire one (1) year following the date the pregnant woman 36 HB1770

4242 (d) The Office of Motor Vehicles shall: 2
4343 (1) Develop an appropriate form, including a provision for a 3
4444 sworn statement of pregnancy, for use by an applicant to request issuance of 4
4545 the temporary special person -with-a-disability certificate for a pregnant or 5
4646 post-partum woman; 6
4747 (2) Distribute a copy of this subchapter to all appropriate law 7
4848 enforcement agencies charged with enforcement of the Motor Vehicle Code; 8
4949 (3) Adopt procedures and promulgate rules to advise and inform 9
5050 the general public of the provisions of this subchapter and the availability 10
5151 of the temporary special certificates; 11
5252 (4) Maintain accurate records of the annual number of temporary 12
5353 special certificates issued and in inventory; 13
5454 (5) Enter into the permanent record of each applicant, the 14
5555 temporary special certificate number, and type of allowable disability of the 15
5656 applicant in a manner that will allow retrieval of the information for 16
5757 statistical use; and 17
5858 (6) Include a notice with each application for a temporary 18
5959 special certificate informing the applicant and any other person driving for 19
6060 the applicant of the requirements of this subchapter and further informing 20
6161 the applicant that the privilege to park in spaces reserved for persons with 21
6262 disabilities shall be available only when the person for whom the temporary 22
6363 special certificate was issued or a person with a disability is actually in 23
6464 the vehicle. 24
6565 (e) The Office of Motor Vehicle may promulgate rules to administer the 25
6666 provisions of this section. 26
